Injustice by non restoration of Commuted Pension - What is the present position?

,.I am a retiree of June 2008.My pension was commuted in 2008 first after retirement and after that my pay was revised 4 times increasing my pension 4 times after commutation.Now major portion of commuted portion has been restored 3 times Only 2 portion of commuted value of pension amount of Rs.258 will have to be restored in 2025. and 2026 Can I get back the recovered amount of commuted portion?

Existing Govt.do worry for those only who have countless wealth and is not worried about common pensioners who have sacrificed for development and building of our Nation.Govt. plays deaf even blind role in solving the problems of pensioners especially regarding bank pensioners.

Still govt. has not issued any orders to stop recovery of Commutation. Govt has asked a detailed report from DOP&PW. Issue was raised in the parliament also and the matter has been referred to MOF. But the latest is not known.

@YoursKayveeyes sir I mean the deducted amount not the reduced amount. For example my father is reduced 6273 per month. So after 15 year's the amount will be around 11 lakhs and something. So is 11 lakhs going to be paid back to me

Bank should give statement of bak recovery statement, do we will be note the transperancy in the account. The 15 years period has been decided arbiteraly not mathematical. In the banking account, account must be clear.if excess amount is debited where or in which account is credited. If credit balance is there that may be given to poor pensioners.

It's most unfortunate that employees on opting for commutation and recovery for 15 years are fighting legally to restore commutation pension. It brought to all that, commutation of pension is not at all compulsory for any employees on retirement. After getting commutation of pension at the time retirement and claiming restoration of the same after 12/13 years is totally unjustified, unethical. Majority of pensioners invest the commuted pension in banks etc and earned compounded interest and double the same in 10! years and still 5 years left for return. Even considering the total recovery of 15 years, the return of commuted value is significantly higher. Such applicants by their actions doing injustice to retiring employees. If such trend continues, government may stop commutation at the time of retirement. It must also be borne in mind that, recovery of commutation is stopped in case of pensioners dies and government has to forego the remaining amount. Ultimately it's public money and can't be utilised in this manner.

No Sir. The insurance coverage has been wrongly calculated as per the old LIC table even though the life expectancy has been raised to 69 years. The demand is genunie. Most of the employees are getting sizable amount due to this commutation. It is not unethical but clear exploitation sir. I will explain in detail shortly

14.40 dt 15.10.24 1. Payment of deficit pension fixed due to noncognisance of spl allowance which rightfully ranked for banker's pension as per Honourable Supreme Court order made lower pension void ab initio. Hence there is wrongful lower fixation and consequent lower DA which wipes approximately 50% of banker's pension. Hence, correct restoration has to be made by making case studies with SBI LIC visavis our own pension. Why has lawyers left this out? 2. There is no Payment of any extra amount to pensioners regarding /excepting by way of book adjustment of commuted amount and it's recovery from PENSION FUND which is the pool account of bank pensioners. Hence proper restoration of commutation by duly recovering it's dues and not more should be rightful way of justice to already wronged bank retirees. JAI HIND

sir, you have said that the state govt.s like Kerala, MP, Odisha and Punjab caused orders for restoration after 12 years. At present only Kerala State is implementing restoration after 12 years and Punjab after 13 years. MP and Odisha states have amended their rules for restoration after (15) years.

Bank should provide the Statement of Commutation. If balance is nil recovery should be stopped immediately. If outstanding is there then pensioners should be allowed to clear the outstanding balance and recovery stopped forthwith. The issue will be over. No necessity of Court Order/ Government.

The existing orders should be amended. Banks are not responsbile. The commutation is linked with insurance and the remaining amount has been adjusted arbitrarily for the same by the Govt

The present government policy is to recover any dues immediately and continue till। the staff or ex staff notify excessive recovery। Any dues।to staff and pensioners will be delayed or denied।
