I did some research and found this on Wikipedia, hope it helps: As far as I know, none of Shostakovich's works are in the public domain. His First Symphony was premiered in 1926; while it is possible that some of his student works were written before 1923, any later works would not be in the public domain as he has not been dead for 70 years. The waltz in question is from the Suite for Variety Orchestra, which was written much later and is therefore not in the public domain.
