I'm with Agility on this one. These brokers are all too eager to exploit any loophole or technicality to screw the carrier. I noticed the brokers didn't dispute the charges, they are just hiding behind a technicality. They have been getting away with these shenanigans for too long and are a major reason why the business is as it is. These carriers had the balls (all due respect) to engage in the same tactics the brokers engage in, and if more carriers did that then the brokers might think twice before pulling their stunts. We as carriers can't negotiate our way out of a fuel or repair bill, but they can look for any bs reason to trim our pay? Just my two cents, hope you have a great week Miranda..

@@gilbertoavina6156 Integrity and professionalism doesn’t seem to exist in this business. The fact that you agree with a shipment being held hostage says a lot about your character!! So, getting robbed is ok?!?! Yeah,,,, No, I’m sure answer is no because it doesn’t feel good. Once you receive/sign a rate confirmation, that is a legal contract agreement between you and the broker. Reading is fundamental, and if you DIDN’T READ all the fine print, you need to go back to school. Some customers charge-back brokers for missed delivery appointments, so the mere fact that you agree with holding the load hostage; will be same energy you project will be returned!!

There are occasions when holding freight is acceptable. The term hostage is a favorite go to term when brokers don't get their way. Example, We did a load from IN to SC, when we arrived, the receiver was not able to receive due to flooding. So after 2 days of waiting, the broker wanted the load returned to shipper. For $1 a mile. I said no. Same rate for return and 2 days standard detention pay. I was threatened with "holding hostage" etc etc. But it was not at all a hostage situation, I did however require payment in full upon arrival for redelivery at the original shipper. But as ai told the broker, they were more than welcome at any time to take possession providing the paid detention and milage pay equal to the per mile rate of the original rate con. They do not own our equipment, we do.

Dear,if it comes to brokers,it’s no morality matter! I’m in this industry for 20 years, I’m an hard working owner operator and I pretty sure this trucking company or more likely a logistics company dispatching all those owners that were cheated many times for a long period of time by this broker,this company just tired of all this BS and they saw this as the only way to get their money back! It’s hard to judge,while not being in someone’s shoes, but everyone one of us,I mean us hard working owners,at some point might do the same way to get our money back and teach such a broker a life lesson! Glory to all owner operators in this country!!! Thank you!

So then why it's acceptable for brokers to hold payments but for carriers hold loads is not acceptable, we need to treat this brokers as they treat us

1:23 I believe it was an ingenious scheme. The brokers have united under a mutual agreement to manipulate the market. But what if the tables turned and the market oppressed them? Imagine if truck drivers banded together and took decisive action to challenge the brokers. The brokers are reaping significant profits, so why shouldn't we make them pay us fairly? The government seems indifferent to our plight, and no one is stepping up to support truck drivers. However, if truck drivers start devising their own strategic measures to put brokers on notice, it could force a change. Increased unity and action among drivers could drive rates up, creating a fairer system. I support their initiative wholeheartedly. While professionalism is important, it's hard to maintain it with those who are intent on waging economic warfare against us. Across the industry, professionalism should prevail, but when faced with aggression, it's time to fight back.

I got a broker that charged me $100 dll becuase driver didnt pick up the phone, but my dispatcher was responding and broker wasnt responsive over the wekend,, i agree with agility

Ive heard brokers have been abusing these fines for this and that. TQL stands out on this subject i think. I see way to manying load posts with to many requirements to take a load. My though is i wouldn't haul a load with all those appointment times, lateness, etc.. There's just to many variables that enter into to the load. Off the top being pulled over by the cops, for no reason, and the list goes on, foreign drivers, DEF problems, etc etc etc

No offense Miranda you are definitely my favorite EE (Eastern European) but I am getting lots of 3+ dollar a mile loads cause I have found a few brokers that have been screwed by Russians and Ukrainians along with other nationalities- they call me to stack loads 2-3 weeks out I rarely use the load board anymore. That being said I support immigration because most people are good and help our economy grow- but it seems a little out of control

These two years. All the TONU , layover and deyention pays isnt exist anymore. Now they are making it so big only 24 carriers violate the rule. Please count the shaddy brockers and tell me the numbers i bet you the list is long. I just get lied 300 miles on the load board. Once i signed RC and realize the real laoding miles,they threaten me they will file a freight guard report on me if i dare to cancel which it still has 6 hours prior the pick up. So tell me more about this.

That and trucker tools is always crashing on my phone and I get random texts asking to start tracking. Even when it was already running.

@@alextinpin3577 I made one broker put in writing that tracking issues were not on my company and that they would pay out the entirety of the load, otherwise the load would be returned to the shipper.

At first I wasn’t for it but unionizing and making a statement is the most activism I’ve heard in trucking in the last couple of years . Hopefully we can unite and create change without the extremes to grab attention. And also keep American industry bc unless everyone just wants to become port drivers keep buying the cheap goods. When we lose company’s we lose jobs and loads, over time less money in circulation .

As a small carrier we ALWAYS READ the rate confirmation to avoid these types of problems. We have been in the industry for 25+ years and have encountered many situations with VV, Reefers, ect and know all the ins and outs so we know how to protect ourselves. We make sure to have paper trail of communication on any concerns we may have on certain loads and won’t load until all bases are covered. I agree with Miranda maintaining a professional level ensures that these types of issues don’t happen. Some carriers lack this type of expertise. If any carrier is having to hold a load hostage is due to the fact they are not thorough and unprofessional. Be advised that a blacklist goes both ways.

This happens because a lot of carriers don't read the rate confirmation. Anytime you sign an agreement or contact people NEVER read...smh this is ridiculous.

As a small carrier, what can you really do if being systemically harassed by the big broker? I too hide behind moral, business ethics. And they just get more impudent as there's no punishment. Someone has to get their hands dirty to draw attention from government decision makers. And I won't be surprised those carriers are not "affiliated", but organized cause they've had enough. NOOA, for example, evolved from a broker boycott to an association.

The trucker could hire a lawyer if they dont get paid .......... but ............ the lawyer is going to ask the trucker to deposit a retainer fee. Then the lawyer will then take small amounts at a time as billed hours are accumulated, they take small amounts out of this lump sum amount....... Now then...... Why are truckers not smart enuff to ask for a retainer fee before any loads are pulled... ? They then hire a lawyer and pay a retainer fee before any work can be done for the trucker??? ....... It is a million dollar Question.

I agree that we shouldn't hold any loads hostage. However, brokers often hold us hostage with their loads when receivers are unable to accept them. For example, Convoy once made one of my drivers wait 4 days to unload, even though the driver was on time for the delivery. It seems like this is just part of the industry, but it definitely feels unfair at times.

i know exactly where he got stuck 🤣 Normal Illinois, Rivian company. Personally i was there for 5 days . One driver was there for a week and he got so fed up and blocked the main gate and said either you off load or im blocking this forever 😂

I don't know if it's legal to hold up a load. Being that the broker doesn't own the freight on the trailer. I'm not sure though.

Sounds like more trucking companies need to become agility affiliates because it seems like it’s a union with smart and aggressive leadership. They could really change the tide if they get big enough.

I’m a Broker and ex driver The only time I will deduct anything is when the customer charges me. I will pass on to the carrier no more no less. What I will do is black list that carrier and never work with them again. That being said some of the miscellaneous fees and deductions I see from other brokers is beyond unreasonable. If you’re going to sign that RC you need to be overly communicative when you run into issues and get in writing over email that you won’t be deducted.

I think this is a great example that shows we can be united and demand better paying rates and better work conditions. We blindly sign up broker packages without any input in those contracts. Just because we are in desperate moments that the department of transportation and brokers created to keep us at minimum wages. This is the result of it, holding freights hostage for demand of payment. It’s sad it is not even for increase payments, but for what is due. Improve the conditions and there will be no delays.

What do you think about the $350 fine from brokers when you fail to track a load and sometimes those tracking apps don't work the way they have to work they want to deduct money from carriers at all costs

Load value over $10 grand becomes a federal matter. The Chicago based carriers are known for this since they set up shop after 1995

Some of these brokers are horrible. Book loads with impossible pick up and delivery times. Could go on and on of what I’ve seen myself in 21 years. Theft and whatcha going to do? Take them to court over $300? There was one I swore I’d never book with again and turned around and did it again a few months later the later. Wish I could remember their name. They aren’t huge but not small

Sounds to me like the hen out witted the fox. I was always told that holding a load for payment was against the law under interstate commerce. Now I’m curious if that’s true.

Miranda is right, the new current receivers shouldn't have to pay for brokers' bad practices in the past. This goes to show that brokers must be regulated and not allowed to do whatever they want. I am an O/O and i have been ripped off by brokers multiple times, they are a disaster to this industry. Some of them have the audacity, and lack of shame to post videos on this platform, crying as if they are victims, all the while they are destroying the trucking industry.

They could have made it worse for the brokers and sent the BOLs to the shipper for payments not received. Shippers are required to pay a carrier who holds the original BOL not the broker.

Hope this doesn’t become standard but it probably will. I remember everyone thought paid parking would never be a thing and basically overnite it changed bc people saw they could make money. Lots of companies are gonna do this now.

I'm sorry for it's about time carriers fight back. These brokers have been getting away with brokering loads multiple times, skimming of the top when the carrier is the one doing the hard work. It's the drummer that gets screwed in the end and it's time comes gets involved in spinning these brokers from taking ANY MONEY of the load isn't picked up by a carrier. They shouldn't be getting a damn dollar if they can't get the load to a carrier. Then these fees they're charging are mostly ridiculous. It's not the driver's fault there's a shortage. Especially if they didn't load it. On top of this, the detention is a nightmare to be paid and shouldn't be. They've been getting away with a lot of crap. I don't feel sorry for them at all. They're the ones hurting this industry

Brokers that charge a penalty for late deliveries are often trying to force illegal driver operations. I can understand when a carrier events a load but then disregards an appointment and sends a driver home for a weekend is at fault. Dont take the dispatch to begin with.

This was crazy 😂 basically he collected old money for his and his friends mcs that brokers deducted or didn’t pay money for in the past. He used a good mc and collected back a lot of money some were just deductions and bet you most were their fault but if brokers were not such scumbags this would not be happening. CH Robinson does a good job on not holding your money back but others like TQL just hold your whole balance for anything.

And no way, it is legal to hold a load whatsoever. Of course it’s a legal matter before they hold the freight hostage but when they get into the contract of hauling the load, then it’s a federal issue between the broker and trucking company. They just called the wrong authorities if they called the FBI they could’ve actually got the carriers for holding the freight hostage, being Interstate carriers subject to federal guidelines when they put that freight on there truck not local

2 wrongs don't make a right. Is unprofessional of course but entertaining. What people aren't talking about is that they are not holding the broker's freight hostage. It belongs to someone else. With all these truck's and capabilities wouldn't it just be easier to back solicit the freight? IF it still doesn’t pay enough then the broker was never the problem. All this squabbling seems like little kid's. When you are hauling freight your customer is the shipper.

they been doing this since forever, the brokers used to open up shop for 30 days and then dissapear with o.o. money back when trucking used to get paid every 30 days. they either do that or they close down and got an llc and open in a new name . All the brokers and companys are the same ones with new names lol. the cold part is the police cant do shyt about it if its on private property it becomes a civil matter. you gotta take em to court This is why truckers will hold freight hostage because they for whatever reason feel that this broker is the same ones who scammed them before.Trucking is a big time gangster buisness through and through.
