The messaging about the Social Security Fairness Act is terrible. It is going to be signed, but what opponents of this bill needs to point out is that, under this new bill, an ex-school principal who never paid into Social Security, and who receives a $5,500 non-covered pension, will be eligible to receive a $3,700 survivor's benefit when his spouse passes away. An identical ex-school principal, who had identical lifetime earnings, who paid Social Security taxes for their entire life, would not be eligible for the same survivor's benefit, because their Social Security retirement benefit would be too high. How is it fair to give the non-covered pensioner the survivor's benefit, but not the person who paid Social Security taxes their entire life? It isn't!

@@PhilLee-qn7gr …Social Security is a government run insurance program. It has a progressive benefit structure which is justified with a regressive funding structure. The Social Security Fairness Act undermines the social insurance character of the Social Security Act by giving what is essentially a welfare benefit to a group that is among the least needing of the welfare benefit. At a minimum (it still would have been a bad idea), Congress should have mandated that all State or Local Government entities pay into Social Security. Do you notice that none of the State or Local government entities advocating for this change have said they are going to start paying into Social Security when this law is passed? Pardon my language, but I think that is what is called “freeloading”.

Right now, if you have a poor woman, who was a stay at home mother for most of her life, who receives a $700 monthly retirement benefit, and her husband only receives a $1,000 monthly retirement benefit, when the husband passes away, she only qualifies to receive a monthly survivor's benefit of $1000 per month, even though both the husband and wife paid into Social Security for their entire careers. To give the ex-school principal who never paid into Social Security a monthly survivor's benefit of $3,700 is even more absurd when you have individuals like this poor widow all over the country. I hope the poor widows of the United States unite to demand justice after this law passes! I am a member of the Democratic Party, but I'm pretty disgusted at them for passing this ugly law. They caved to the pressures of union groups like AFGE without stopping to think about what was really in the public interest.

Here in orlando metro area if you call SSA for appointment, they would ask you to just go to office without it and if you go there, you have wait in line and they are receptive to just simple things. Many times they don’t let you in the front door because it is all crowded. If you get an appointment (which I did after months, I was still stopped at the front door until office get in touch with whom I had appointment was ( so make sure, with whom your appointment is, in which office, on what floor and the time or you would be turned down at front gate).

I was told that i was not eligible to make a claim from my ex husband’s SS if it was not granted in our divorce settlement. We were married 20 years, nearly 10 of them while he was actively in the US Navy. He is now deceased, and i am 81 collecting my own SS. He remarried, and i do not want to reduce what his widow gets, so i hesitate to open this can of worms again.

It has been said many times in this channel that no one can include a statement in the divorce decree about exemption. You contact social security ( before January 6! Hurry so you are not delayed). Tell them his information and you will receive benefits. I don’t know how far back they go but I believe you will get back pay. Please do this today! @angiensek7696 So sorry for your loss. I can’t imagine how difficult it must have been to lose your husband so young. Don't know when Ed will get back to you, but this may help you, (I don't work for SS, it is to be taken as helpful hint only) I think, you can start receiving survivor benefits as early as age 60, but your monthly benefit will be reduced if you start before your full retirement age (FRA). If you wait until you turn 62, you will be eligible for a reduced benefit, but not the full amount. You can also choose to wait until your full retirement age or even later for an increased benefit, up to age 70. Your survivor benefits will be based on your husband’s earnings record. You can file for benefits when you turn 60 (or 62, if you prefer), but it doesn’t have to align with the age your husband would have turned 62, assuming he completed the required 40 credits before he passed away. Receiving survivor benefits while you have a pension: Yes, you can still receive survivor benefits even if you have a pension from work. Social Security survivor benefits are not typically affected by whether you have a pension. However, recent changes to the Social Security Fairness Act have reduced the impact of the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO). Depending on your specific situation, it may no longer have as much of an effect, but it’s a good idea to check with Social Security to confirm how your pension might impact your benefits.

@@manclt704just a note that survivor benefits do not grow beyond full survivor retirement age. If you have your own earned benefit, it's worth checking with the SSA to see which one will be higher- yours at 70 or survivor's at age 67. You can start whichever one is lower (yours can start as early as 62 and survivor's can start as early as 60 or 50 if disabled) and let the one that will be higher max out, then switch. Both benefits are subject to reduction (and earnings limits) f taken prior to FRA.

In our town, SSA built brand new building with 40 service windows but barely 7-10 would be open for service. Isn’t this waste of money? Also, why in downtown, where it is crowded and parking on premises is $10 for just half an hour. Isn’t this ridiculous and waste of $$$? In suburb, it would cost less to build, can provide easy parking and spare fund can be used to hire more employees and provide public transport to get there for over half of Americans who can’t afford a car in retirement.?

Critics of Social Security who claim that the trust found is being given away to people who haven't been paying into the fund are about to proven correct. Congress has just passed a law to give a welfare type of benefit to all the police officers, teachers and other government employees who never paid FICA on their primary jobs. Those public servants are asking for a welfare bonus on their FICA-covered side hustles. Note the police, teachers and other government employees who did pay FICA on the primary jobs are not eligible for the bonus. So much for "fairness."

I worked for 14 years and paid social security then I became a police officer for 32 years and retired. I do not get all my social security because of my pension. I am penalized about 60 % which leaves just enough to cover my Medicare each month. This bill allows me to get that 60% which is money I paid into social security like other people who aren’t penalized. I believe that everyone who paid in should receive their money and maybe even with interest that our money generated over those years.

I paid in 52 years all my life. Why should you get the same? That is not fair. Thus the fairness act us a crappy name. I took Survivor benefits for 1 year from my first husband's benefits while taking care of my second husband with brain cancer (both died from cancer) for one year. I did this at age 60 for one year. I went back to work at 61. This was 2-3 years ago. I will work until I am 70 as I can't afford to do it any sooner. Does my benefit "level" start from my need 3 years ago from my husband's survivor benefits? OR does it start at 70 when I can actually afford to retire?

We have the right to go into that building in the lobbies, and corridors, and have the right to ask questions of our public servant and video record the interaction, and you can also make a public records request's. Know your rights! During business hours! If you are not let in and denied service. They are breaking the Law!! Public building! It is ours! File lawsuits, if you can afford it. @@karenhaley58you are correct, the person that died had to be alive for the entire month in order have been considered eligible to receive the check. I think of it like having to earn the check by continuing breathing for the entire month. If you stop breathing before the month ends at midnight on the last day of the month, you did not qualify that month to receive a check the following month as we are paid in arrears.

If the payment went through after the date of death, payment will be clawed back because SS can't pay a dead person, even if the person was in fact alive the entire previous month. Executor/spouse can file a form to get the payment reissued though (I think it's form SS-1724).

@@LavonMeiser-ev1ie sounds logical. that will never happen but you do have a point. 6.2% of wages for decades is alot of money saved - not put into the system. Like almost 2 years of salary worth. They don’t have it. So no - they get off scott free. But they do get their pension and a full first tier social security check. Without reduction. . They should let average non public workers avoid paying fica for decades and allow them to throw that money into their own individual IRA /401k retirement accounts all those years to grow their own weak version of a pension check. . And still collect a nice sized social security check without reduction . Not gonna happen. Would totally bankrupt social security But what was fair to the 3% should be fair for the 97%. All we can hope for is the “fairness in Fica contribution returns act” now. Hope they do that We went from one kind of unfairness to another kind of unfairness. They should have just modified the reduction calculation formula to account for various individual situations. Not eliminate the entire thing. Terrible unfairness. I agree with Dr Ed on the unfairness of it all. Who is gonna pay for the $196 billion for the passing of this act over the next 10 years? I am afraid we all will unfortunately. 23% across the board social security check amount cut is looking more real. Raising the FRA to 70 for younger workers sounds horrible. It’s really outrageous how they rushed this through all together next to the federal budget funding crisis and right before holiday recess. I am sure they all wanted to go home. Those original legislators that passed this WEP decades ago originally , surely could not all be wrong.

If your ex-spouse is deceased prior to age 62 and never filed for his ss, you can claim their ss under survivor benefits as early as age 60.

You will have to continue paying FICA as long as you have earned income. It is used to pay benefits to SS recipients.

First, file SSA form 561 reconsideration for appeal Then attach why you don't feel you were overpaid and if it would cause a hardship or whatever the case may be.

Well, it used to be included on the letter that also said when to expect your CDR. I understand now though, that the SSA is lazy and doesn't even put any of that information, correct? You'll need to call and have them send you the letter that says specifically what your Disabling deciding factor/factors were.

I was receiving disability in my early 50' My spouse died when I was 55. I recieved the widow beneath. But when I was 67 they took it away and gave me my own social security. No extra and they said I made more money then he did. Does it sound right.

IV Ozone therapy. Not covered but cured my mom of lung cancer. Before her stent was put in she got IV hydrogen peroxide therapy.

There are some ways around this if you have the right type of Cancers and if you've got the time to fight it. What Stage and what kind? I'm from Iowa and 2 of the qualifying Cancers. Maybe I can help.

Will for years I received letter saying amount I would get if I became disabled, then when I became disabled I was told by social security that I hadn't paid in enough. They finally put me on it,but said they had to file it under what was left from my dead mothers. So last I worked was 2016 I believe it was,so I didn't pay in any taxes,so you said we had stimulus check coming? I'm confused about what I can receive from that

@DebLindley-xg8gz apparently you don't have any clue to what I was asking him,cause in the other video he was talking about stimulus that people was intiled to get saying if you filed taxes in 2017,I done did my taxes for that year,and I was on disability back then going into 2018 but none told me about any stimulus checks at that time,I was asking how I find out.

The stimulus check Dr weir was speaking about is the one that was handed out to everyone during covid. If you received that money during covid that everyone in the country received, then you are not eligible to receive it again.

I'm a widow too. I think, but please check on this, that you can't draw both. You can switch to your SSA if it is higher than your husband's. But please check on this to be sure.

my son in law was married fir 17 years to my daughter they have two daughters one 10 and the other 16. He had a stroke in April 2024. She filed for disability she said he was approved and they would call her back for a meeting and now he die a week before Thanksgiving leaving no life insurance or 401k. She needs guidance and help what to do next.
