As per subsection 2 of section 184 of the companies act 2013 it is said that every director of a company either directly or indirectly if concerned or interested in any contract or arrangement or proposed contract or arrangement entered into a to be entered into a) with a body corporate in which the director either individually or aur ine association with another director holes more than 2% of the shareholding or is a promoter, Manager or CEO of that body corporate or b) With a firm in which such a director is a member owner or partner is the case maybe. It has not written the word director in either of the situation does that mean the director can hold the directorship in both the companies and it does not required to disclose this interest while having the contract or arrangement between the companies ?
