Great video-very informative! If a graphic designer wants to form an LLC to sell their designs on products such as notebooks, stickers, etc. would those designs have to be copyrighted under the LLC or under their personal name since they, themselves, created the designs not the LLC? Thank you!

I think that the content of this video is really well thought out and the information is useful, especially to business students. A word of advice, if I may? Please don't chop up and edit the videos so much. Be yourself. Allow little mistakes and flub-ups to remain, and just say something like, "Actually, let me rephrase that." It will help you seem more confident and less robotic, and it will allow you to connect with your audience more efficiently. The frequency of the editing was a real distraction from the message you were trying to convey.

As a music artist who lives in Spain, I'm about to start releasing music under a new artist name, which I want to trademark globally prior any official release. I currently live in Spain, therefore I'm not sure how I could register my trademark all around the world. Is it a good idea to still do it through the USPTO (maybe select the madrid protocol which I heard registers a trademark in lots of countries? or should I ask for international trademarking in my national office?) - Basically, as someone who lives in Spain and wants their artist name trademarked globally (I know theres no such thing as a global trademark), what steps should I take? Thanks! Also, would my trademark be approved even though I've not I've released any songs as I'm waiting to be trademarked, or is it a must to prove sales? :)

Hi. I'm really having trouble struggling to understand copyright. I would explain it as such; I'm interested in art, in particular pixel art, but I see there are like only 4 different ways to create the eyes for a tiny pixel character. So they are going to be the same as something someone else has created. And I can see this cropping up more and more before I even begin to get into this artform, that I am interested in as a possibility for a game medium. My lack of understanding of copyright and what people in comic books, manga, etc. art probably just take for granted from many decades of building on top of each others works. So there is a style called "anime" and "manga", originally created by Osamu Tezuka. I'm just wondering can you freely use any anime eyes, say copied from a reference, maybe a manga, or a tutorial "how to draw anime eyes"? Because it is a style, and apparently you can't copyright style? I mean so many people all do the same style. But then some people are like "Don't copy my work", but they actually copied the original manga creator, or someone who copied someone who copied someone who copied them. Hehe. The other thing concerns more specifically pixel art. Pixel art is sometimes done on such a small scale, the number of pixels are so limited, there may only be one or a few ways to actually do something effectively. Like art in a space of 16x16 pixels or smaller. So there is a finite limit on how many different ways you can do something. So can they be copyright? Part of me feels like I know the answer and these things aren't copyrighted, with some exceptions if it is clear and obviously copied detail for detail a specific character for example.

Very technical question but I thought I’d try and ask. So I'm going over the copyright application and plan to submit a group of the scripts under the unpublished group category for a 5 issue comic book mini-series. Most of issue 1 is done and I am considering waiting until it's complete to submit the comic pdf along with the comic script for issue one and the scripts for the remaining issues but if I can submit the scripts by themselves and everything after is considered a derivative then I'd like to submit as soon as possible. My question is should I submit my comic book scripts for copyright or wait until I have the full comic (for issue 1 at least) and submit the script and comic together? Would any work created based on the original script be considered derivative? Thanks!

Hi Aiden, I have a question. I have a product I’m trying to manufacture but am unsure of the IP safety. It is a product that takes a animal reference from a TV show. The animal in question is a real animal. My product uses an image of that animal that I paid for the rights to which is not the same image from the tv show. And it uses a tag line that references a business in the show but doesn’t use the full business name or spelling. The IP on the show I’m assuming would be on the business name within the show, and possibly the animal but again I’m not referencing the business name, using the same spelling or their images. I’m solely using my own images and fonts and they are currently not selling any product like this. What do you think? Thank you for the video and your help!

Yes/no/kinda/it depends. It would likely be copyright infringement to just take a photo from social media and sell it. If you create a new work from an existing photo, that *might* be okay under fair use. But if I am in the photo, you'd still have a problem using my likeness without consent. It always depends!!

At the 2:01 video mark: There is no “common law” copyright. Per the 1976 Copyright Act (effective on January 1, 1978), copyright got federalized for both published and unpublished works, including those works not registered with the USCO (17 USC 301). Once an original work of authorship is independently created, affixed on to some tangible medium, it’s protected by federal law. You can use your un-registered federal copyright claim to issue DMCA “Take-Down Notices”. To enforce the copyright against infringers, as you stated, it must be registered with the USCO. US published sound recordings affixed before February 15, 1972 may be subject to state common law, notwithstanding the pending Music Modernization Act (Title II).

From my observations, artists and small business owners already have a challenging time understanding basic copyright, its registration process, fair use, etc. Using incorrect or non-standard terms can further confuse them. I’m a creative, and I’m certain none of my colleagues would understand the phrase “common law” to describe unregistered copyright claims. Other than the points I’ve included, the video was done really well(!), conveying clear information about the various branches of IP.
