My wife is working in a bank as clerk and earns nice salary near about 50000 with all allowance HRA , DA and all other benefits of medical allowance, travel allowance and various other benefits she is now demanding maintenance as I am working as officer in bank. She is Graduate and earning from last 5 years she has left home more then 1.5 year and not coming back she has filed DV under section 12 and divorce under 13. Also demanding maintenance. How can she be given maintenance when she is earning? And if she wants divorce why she wants maintenance then???

Hello Bharti....wife can seek divorce as well as maintenance....legally valid....regarding maintenance...it will be fixed as per the income status of husband...if difference is huge then maintenance will be fixed...but if salary of husband and wife is more or less same then no maintenance to wife...thanks...good luck....

Sir mai gov job me hu, dhoke se meri shadi ek character less aurat se ho gyi hai, maine usko bola sab bhula k age bado , mere sath aao aur jao kahin bhi. Usne is bat par apne ghar se 20 log bulwa k mujhe dhamaya . Mai bahaut depression me hu, aur pichle 6 mahine se nind n ane ki gambhir samasya se jhoojh rha hu. Mai naukri , ghar , badchalan wife sab chhod k iscon join karna chahta hu , sansyas lena chahta hu, aur dharm aur samaj ki seva karna chahta hu, kya fir bhi mere upar case banega , aur usko kuch dena hoga , naukri k siva mere pas kuch hai bhi nhi.

Hello Arpit....itna darne ki jaroorat nahi hai....agar aap uske saath nahi rehna chahte to divorce ka case daalo....dekho legal process se to nikalna padega....even if agar tum sanyas lena chahte ho to le sakte ho...par wife case tab bhi kar sakti hai....meri advice yahi hai ki divorce ka case daalo....jo bhi wo dhamki de rahi hai usko record karte raho....ya phir usse one time settlement karke mutual divorce leo....bhagwan bhi unki madad karta hai jo apni madad karte hain....good luck....god bless....

Hello....interim maintenance aur monthly maintenance alag alag nahi hota....same hi term hai....agar final maintenance decide ho gaya to order dekho ki kitna maintenance hai aur kab se hai....bas waha se calculate karo....jitna interim main pay kiya wo minus kar do....baki ka deo aur phir har mahine se monthly dena hoga....good luck....

Hello Ansul....wiase aisa hona nahi chahiye....yadi aapki statement nahi hui hai ki aapko 10k dena hai...ya court order main nahi likha hai to koi mandatory nahi hai....but agar aapne statement di hai ki aap 10k denge ya court order main aa gaya to dena padega...par aap court ko bataiye ki aapke pass itne sources nahi hai....apni actual income bataiye court ko...aur interim maintneance decide karne ko boliye so that aapka affidavit aur wife ka dono ka file par aaye aur uske hisab se maintenance fix ho...thanks...

Hello Bahialal...if you have provided evidence then court will fix as per your income documentary evidence...otherwise if both husband and wife do not give any proof then court can fix anything....if you have given proof that she gave false income and actual income is shown by you with proof then court will fix according to you....in 24 hma no cross examination is done at the time of fixing maintenance....you need to file appeal if you feel that court overlooked your docs and proofs...thanks...

Please guide me. I have very strong evidence against my wife about her adultery life. My lawyer is saying that at time of interim maintenance stage this evidence will not work as submitted evidence will get examined later at time of divorce argument. So till final judgment to come court may allow interim maintenance to my wife in spite of strong evidence. Please guide me is any example case are there were interim maintenance application get denied if husband has strong evidence of adultery and court consider this while giving interim maintenance order.

Hello Durganand....your lawyer is right...final maintenance is decided only after evidence and arguments....however you can use this evidence at the time of interim also....but it may not be appreciated....but you can always file appeal against interim order.....interim application denial par judgement search karni padegi....it will take time...email me at [e-mail] thanks...good luck....
