I'm so disgusted with the American legal system about child support. I think that if the man signs the birth certificate under the presumptive idea that he is the father, and he isn't, I don't think that the man should be held accountable for financial assistance (child support). If he's been paying for a child that isn't his, he should be reimbursed, and the mother charged for providing false information.
@christinaraney21108 ай бұрын
Totally agree that's not right at all the courts going after who ever can pay period they don't care they want the money it's not bout the child knowing who her biological dad is now if the child was being abused or something that's a different story
@Univerzai_88 ай бұрын
And the presumptive father, should be reimbursed by the mother (every penny) and made to do community service or jail time. (if the "father" has been incarcerated for non payment of child support, she should do the time spent in jail also)

I agree; also they should have mandatory DNA testing with every birth. However, when he signed, he assumed the financial responsibility for the child; so I think the law allows this to protect the children who are innocent, so they get financial support regardless of paternity or relationship between the man and mother. So when the man gets upset with the woman he cannot remove himself from the child. What they should allow is for the man to sue the mother for falsifying information. On another note: This can go either way in another situation, because as you know, if the father has the kids the majority of the time (ex legal and/or residential custody), the mother will need to pay the man for support

The law is evil and paternity tests need to be mandatory if a woman can have a man sign a birth certificate under false pretenses and then six months after the fact admit the child may not be his. This woman is being nonchalant about it while the man could go to jail probably because there is no penalty for paternity fraud. Once a female seeks child support.. a DNA test should be ordered at the same time. Because of right now… I feel paternity fraud should be a thing. If you receive child support then later find out that’s not the father… he should be reimbursed for ALL payments he made… take her income or any lump sums she gets just like they would for a man not paying child support… that would cut down a lot of this foolishness!

Calling a child sexy especially when the child could potentially be his daughter 🤮. Disgusting. When I think of terms to describe a child “sexy” is NOT in that category.

He's legally his father even though he's not biologically his father, that's why. When you sign the birth certificate you're basically signing a contract saying you will be legally responsible for that child including paying for that child. They make it very clear that a man should not sign a birth certificate if they have any doubt they aren't the father which is why even if a DNA test is done afterwords proving a man is not the father, he has to petition the court to be removed from the birth certificate. He would have to prove that the mother lied to him and made him believe he was the father and even then they don't always judge in the man's favor. This is why if a man even has the slightest bit of doubt, he should not sign the birth certificate and ask for a DNA test. There's a very good chance that man will be stuck paying that back child support due to the fact that he knew months after the child was born that he may not be the father and didn't pursue a DNA test right away. Instead he did nothing about it for 20 some years. The woman is definitely at fault for lying to him but he's also at fault for not doing something sooner. He never would have incurred such a high balance in back child support had he taken care of this immediately when he found out there was doubt that he was the father.

It's still not morally right if the child isn't his to just take that man's hard earned money. People know the law. But mama's baby, daddy's maybe.

Why would the state pay to find a father when another man already accepted legal responsibility for the child? It's the legal father's responsibility to hire a lawyer, pay for the paternity tests, pay for the courts and then sue the mother to recoup his money. It shouldn't be the taxpayer's responsibility to cover those costs. It's a personal matter and as far as the State is concerned it isn't their problem at all. They just work within the law to enforce the law.
@camellia86258 ай бұрын
It would seem a birth certificate signed in good faith (on the basis of incorrect information) conveniently for the state overrides the truth. Why should a deceived father be the one to have be out of pocket to correct matters.

Many States to even receive Welfare,Health Insurance, Foodstamps the Mother MUST list the name or names of the Man that is a Possible Father of her Children.If she doesn't they can Refuse giving her the aid she needs for her Children to survive on.The States do this to try to get reimbursed if they can prove a man is the father by Garnshing his wages.Some States will pay for the DNA Test.

My brother had the same situation going on and EASILY racked up 20k in child support in less than 5 years because the lady was getting welfare and food stamps so they charged him for it. He had to pay 20k for an attorney and still had to pay 10k because Texas only cleared half of his rears
