It's the natural progression of things, if you're opening cops up to personal liability they'll get sued every time a running suspect sprains an ankle. It's absolute insanity. Of course, a lot of money to be made (from you the taxpayer) to increase police wages, because the next logical steps is each officer would need personal insurance policies. This will harm policing further, because rates would have to go up if you had certain types of incidents, so the police would have to shy away from everything.

Everyone can have a bad moment. Training and accountability needs to start from the mayors office down. Just like any job, If a person isn’t given the proper training and direction they learn through trial and error. Law enforcement is no different. When my friend was in his 20’s he was a training officer. He had a party and a couple graduates were at it. I was there and I’m not that big. The guy tried to demonstrate pain compliance techniques by using me. I’d never told him he could do it. So when he did something I countered and told him to step off. That infuriated him and he tried something else. I countered again only with a strike to a nerve group. Then he started saying he was a cop and I was assaulting him. My friend came up and said, look rookie. This is a civilian. I saw you grab him, you cannot do that here or on the street. I’ve known him since were were 5. Don’t mess with civilians! My friend told me he was going to have a talk with him. It made me wonder how many other people are taught aggressive techniques and want to try them out. That guy had no idea, I trained 5 hours a day 6 days a week in combat arts. I know officers need to control a situation, but I’ve also seen officers grab a nerve group, that causes a suspect to pull away and they then claim he or she was resisting. I also had a friend arrested by a plain clothes cop at a street festival. We were later told they don’t arrest the person that commits the crime they arrest the whole group. My friend was walking through the group to his hotel. Someone did something and an officer grabbed him by the shoulder and said our coming with me. My friend never saw a badge so he responded “who the F are you?” The plain clothes said so you’re resisting arrest and through him face first into the curb. My friend was charged with assaulting an officer but the charge was dropped when he paid his $2k fine.

In case you have been living under a rock, civil cases are decided by a preponderance of the evidence not like criminal cases. Criminal cases are decided by proof beyond a reasonable doubt. Preponderance is basically 51%. Being sued civilly is a very risky business. Your chances of losing are good. Who has the better lawyer is what it can often come down to. That is why cops will be quitting like never before. The financial risk and physical risks have now become too high once qualified immunity is taken away.

Julian Niemiec it really is trial and error, I haven’t had problems with many officers in my life. But as someone trained in martial arts, specifically nerve groups and pressure points. I’ve seen officers grab people by pressure points. That causes a reaction where someone pulls away. When the person reacts they claim he or she is resisting. I respect the police because many of my friends are officers. But like any job there are some jerks that need to be retrained, constantly supervised or find different work.

To all the commentors saying, "If he doesn't do anything wrong, he's fine" You obviously don't understand civil law. You do not determine right and wrong in a civil suit, you determine damages owed. If an officer in Colorado tries to apprehend a suspect that is fleeing in a car, any damages that incur from the suspects vehicle to another vehicle could be brought against the officer because they were the cause of the chase. The fact that you were an armchair lawyer and couldn't look up civil law gives me pause that you would understand anything related to the judicial system. By the way, if you didn't like the police unions and how they rally behind the bad police, wait until a few lawsuits go through and the good cops start seeing the union as the only way to protect themselves.

You still lose your job since where you work the citizens hate you, constantly protest your home, and your life completely changes even though you did your job correctly. This happens to cops all the time, like Darren Wilson for example. You can do your job correctly and lawfully according to a Department of Justice investigation (even if the media and public disagree) and you will still be under fire. This doesn’t happen to nurses.

Instead of blaming the political climate, how about blaming the bad cops, or the so called "good cops" who stood by and said nothing, and the justice system which allowed them all to go unpunished for decades??? Easier to blame the victims I guess.

The justice system isn’t written by the officers. Most of the cities with the problems have been Democrat ruled for decades. The mayors office tends to use the police as a revenue generating division. The mayor and council write the laws or ordinances. You want reform start with the mayor taking accountability. The mayor requiring more training for officers. The mayor setting guidelines. Then the chief of police following those guidelines and implementing them. It trickles down. Start by voting out democrat mayors or at least balancing the council between liberal and conservative. Make them earn their paycheck.

I am a white male in my early 20's. That fact has never prevented the law enforcement where I grew up from verbally and physically attacking me on more than one occasion ( Grew up in "Montgomery County, MD"). I just wanted people to understand where I come from when I say I do not trust law enforcement at all on any level. But even with those horrible experiences I have still met some very good law enforcement officers that genuinely care and use a common sense approach to their job. (Law Enforcement officers using common sense is a very rare thing in my area). But I absolutely hate the fact that the men and women that are trying to do their best are so scared of being jailed or sued that they quit. It just isn't productive, and it leaves us as citizens exposed to the unethical law enforcement officers because those are the ones willing to use threats and violence to ensure they are never caught or punished for their actions. It's a F'd up system but we need these people. It's that simple.

Teachers aren't typically dealing with homicidal subjects, combative subjects, violent felons or individuals suffering from mental illness, drug induced violent behavior, people illegally possessing firearms, or anyone involved with criminal activity in general. Police need to be indemnified and protected from lawsuits when acting under color of law and when their actions are justified pursuant to statutory authority. This doesn't mean police are granted the right to act with impunity. It means that when an officer is required to use force up to and including lethal force when necessary, they shouldn't have to be concerned about being arrested, prosecuted and thrown in jail, or sued, for doing their job. This whole trial by media and/or public opinion attitude needs to stop. Nobody knows what it's like to be in that situation unless or until you find yourself in one. Police face these situations all the time. It's a completely different scenario with very different circumstances than a teacher typically experiences and the liability cannot and should not be the same. We're going to see officers leaving law enforcement in droves if this type of legislation becomes more prevalent in the various states.
