Thanks for reporting this as it keeps the subject alive; but unfortunately I won't be buying in Spain until we can stay at least 6 months of the year. We need to get this rule changed.

Fair enough. You’re welcome. Bear in mind that if you want to stay more than 6 months you’ll have to get a visa and residency anyway and pay tax. Even if they change Schengen law you won’t be able to holiday for longer than 182 days a year altogether.

Ideally I'd like to spend the winter months in Spain and staying just under the 182 days a year. This has to be advantageous to Spain as we'll all be spending half of our annual expenditure in their country.

@@youtoospain as well as visiting the Town Hall to get your Padron, then the police station/bank/police station (you can't pay the police directly) to get your NIE, then your driving licence - not even sure of the current status, but I believe you will have to change that. Oh, and you can't take your UK registered car away for more than 90 days. Have fun!

@@colinparkinson6818 the non residents I meet come to Spain for just under 6 months altogether but they spread it out over the year. They’re spending the same money as they would if the 6 months were all together, so I’m not sure it would benefit Spain enough to allow that.

I can see that you don’t want to get people’s hopes up unduly, however in this case there is a certain degree of substance behind the noise. I run the 180 days in Spain campaign and we have an opportunity over the next 3 to 4 weeks to really encourage this to happen. If you’d like some more information about this then please get in touch

Well, as you've no doubt seen, I'm in the 'don't hold your breath' camp, but I'm always interested in people who are at least attempting to achieve the impossible in a positive way. After you've seen tomorrow's follow up video about the French amendments, which I've been quite disparaging about, let's see if you still think it's worth a follow up

Oh yes, I'm not into holding breath about this. I've been working on this for 4-5 years now with other people so it's certainly a slow burner, but things are really picking up pace. This goes in flurries of activity. We don't really like the French Senators' plan that much, for various reasons, but what we are happy about is that the situation has been recognised and that it is now being talked about. We consider it positive overall. Our proposals (and those of our French sister campaign) are far more egalitarian@@youtoospain . Nevertheless we have a unique opportunity right now for the next 3-4 weeks to influence this and show the French government that this would be popular. Thats the issue, I think. Brexit removed freedom of movement in both directions, so I cant see the EU going for it, and as its an EU issue rather than a Spain specific one it probably wont get much traction.

Don't hold your breath, this is local politics from the tourist dependent areas. The rules are not EU, but Schengen and to implement would require the border posts being replaced with Portugal and France and that won't happen over night.

Why ? I travel throughout europe often spending a year here or there. You can not get citizenship at a drop of a hat. Schengen is not across the whole of the EU.

Of course this isn’t about people who want to emigrate permanently. This is about people who want to life in two countries or who travel frequently for work or pleasure to other Schengen countries

Why should people give up their identity? I have a certain sympathy for people who chose to keep their own British Citizenship because Spain requires you to give up British Citizenship (but not if you are French or South American or Portuguese). Remember that giving up British Citizenship might make it imposible for you to live or work in the UK or care for family members in future.

We know how Spain can change it: by issuing an extended visa for 2nd home owners. Them saying that the EU has to solve the problem for them does not bode well.

I think that you got to the point at 9:10 in the video. They could create a new visa and they might do just that, but it's not going to be next year (or indeed anytime soon) and may depend on a better relationship with a new UK government. The fact that the Tourism Minister has mentioned this a number of times probably means that they are testing the the water to see what people think about the idea. Give it a few years and it might happen - there's not any downsides to doing it for either Spain or the UK, nor will it negatively impact other EU countries. We can only hope that these type of issues will start to improve as we get further away from Brexit!

Just curious... which visa(s) allows retired US citizens receiving a decent pension, and passive income streams, to live in Spain for 4-6 months? (Not really interested in permanent residency at this point just want to stay several months at a time, while we determine whether/not we would actually want to live there.)

Well, the Non Lucrative Visa would allow you to do that but it’s designed as a long term residency visa, and the time, effort and fees required to go through the process would put anyone off doing it just to be there on an extended holiday. Besides, you’d need a long term address to gain residency.

I'm British and emigrated to France. The French that I have met (given the size of the country, a very small sample) don't talk about Brexit at all beyond a shrug that says "nutters be nutters."

You can be a resident without being a citizen. Another option is to move to Ireland for a few years and get Citizenship there eventually, or if you have a Irish parent or grandparent you can apply for foreign born citizenship.

An expat is a legal term meaning a person who lives in a foreign country temporarily. Many of these expats only live in Spain during the British winter period, therefore they are expats not immigrants.

On our last visit the Spanish used a stamp in my wifes passport that was totally unreadable, and upon leaving we asked why . The officer really didn't care and to me I think till etias comes in they really couldn't care less.

The Spanish could issue a Royal Decree. There are already different rules between France and Spain in relation to residency

Royal Decrees are only created when there’s urgent and extraordinary need. However extraordinary Brits think they are, the Spanish King won’t see it that way.

@@youtoospain royal decrees are routinely created all of the time it's how the Spanish legislative system implements secondary legislation all of Spain immigration law is implemented by royal decree not at all urgent

@@boodori1210 the whole point of Royal Decrees is that they are temporary and urgent, they are decrees to make something law that can’t be put in place quickly enough by normal legislative means. Then they must be ratified by parliament within three months. I’m not sure where you’re getting your information from but I’ve looked through quite a few RDLs and they don’t fit your description. Perhaps you could provide examples?

@@youtoospain bs .Royal Decrees are normal legislative means eg Spanish Immigration law. The basis is the Organic Law (ie. passed by Parliament) 4/2000. Organic law is deliberately vague rather than bog Parliament down in minutiae some time later the sitting government issued royal decrees that filling the detail, for immigration that’s RD 557/2011 . it’s the equivalent of a uk s5autory instrument

My wife was an asian and then she become a spanish citizen. But our marreige certificate still for the old asian name and we married in asia. So my question is. Is she will be able to take me to spain after she become a spanish citizen? By showing asian marriage certificate ?

I believe so yes, it would need to be translated by an official Spanish translator and apostilled. I would get in touch with your nearest Spanish embassy to confirm this, and to find a translator.

Spain already has a bilateral treaty with USA. We’re asking for Brits in Spain before Brexit to be protected and we’re asking for new arrangements for all UK passport holders. If Spain wants to go further that’s up to Spain

@@youtoospain The community, nobody has much, including me, but the gathering of folk and the small cafes, the genuine sense of family is worth everything. My old lady neighbour who must be in her nineties always calls buena dia, with the smile as though she is still eighteen. The old man who pokes his nose through my fence every morning and says ah desayuno, si senor. The kids going to school at 8 am, noisy but wouldn dream of wrecking my flowers. The policia local. policia national, and Guardia civil gather in the cafe in our square and thats the only time we see them. We have lots of small paseos where people pass at all times of day or night with no problems. I learned a long time ago after holidaying here for 20 years that I was finally coming home. Gain legal residency before brexit, pay all your taxes, register your right to vote in local elections, and enjoy the life in a small human community and rediscover what really matters.

Spanish citizsnship isn't granted just like that unless you are a millioner.....the rest need to prove long time stays in the Country plus a deep knowledge of the Spanish Language and General Culture which has to pass a written text......not an easy thing to overcome....😮😊

Because they don’t want tens of thousands of people buying property to leave empty for the majority of the time when there are housing shortages. That’s the main argument in government for getting rid of the Golden Visa. Besides, the BLS visa centres in the UK are full up every day with Brits applying for Non Lucrative Visas. There’s no extra encouragement needed.

@@youtoospain Norwegians have the same freedom of movement rights as EU citizens so do Icelandics and Swiss. After 3 months they have to apply for residency but they aren’t restricted like UK nationals needing visas etc.

@@youtoospain, I was involved in the Remain campaign, and I recall hearing of the travel restrictions and limitations of migrant's rights. Still, I am also involved in higher education, which has suffered hugely and, so was more focussed on such issues. It is ironic that a sizeable proportion of Brexiteers with overseas interests voted Brexit because of their fear of imigration when they too could be defined within this. I genuinely hope that Brits with holiday homes will be able to return to the warmth more often, but equally, I wish our young people to have the benefits of travel and working overseas that we enjoyed for many years.

Flamenco is just in the far south of Spain..I mean far south. We have "jotas"..Try to understand..I am from valencia and i never ever heard flamenco music in the streets..Why ARE YOU SO DUMB?????.We have "jotas valencianas " as folk music.....PLEASE . have you heard bagpipes in Colchester????????.... It’s not just about a continuous winter stay. Many younger people travel all over Europe for work and pleasure (and to visit family) so the 90 in 180 day problem is a huge problem for any frequent traveller.

I don't disagree@@madgringo9263 that the UK left the EU. We know this and are acutely aware of it every single painful day. However the people who are complaining now are not the people who chose to end FOM, leave the EU or the EEA. They didn't even vote for Brexit. So we must continue to create the case for rejoining or easing restrictions, so that UK politicians realise the error of their ways and understand how unpopular their Brexit (especially hard Brexit) is. If we are unwilling to explain WHY we need mobility in countries like Spain, then it's hard to see how or why UK politicians would voluntarily choose to rejoin the EU; after all, sharing sovereignty like this very slightly weakens the influence they have over UK affairs and when politicians have been elected, they often want unbridled power.

Can`t say that the 90 day rule is a problem . Just obey the rules and your ok ,initially a bit more paperwork for residency and your ok . I did this bit of pain to begin with for couple of months then I was given 10 yr residency .

Well you’re half right, I love living here and like everyone else who arrives I do get smug about it and can’t help posting pictures. I don’t enjoy that it’s now more difficult for some others to move here, if you watch the live shows especially you’ll see how much effort I put into helping people achieve that. As the video points out, this is repeated news. The only new thing is it’s in the news again right now, that and the raised hope this time amongst expats. That alone is worthy of a good rant. As for poor clickbait, look at the viewing figures compared to my usual first 24 hours. I think it’s proved to be very good clickbait. 😀

We are not entirely certain that's true. Brussels only has competency on short term immigration up to 90 days. Beyond that, individual member states are fully "sovereign" for want of a better word. The only thing Brussels mandates is that Schengen states must allow any citizen of an Annex II list country (there are around 65 of them inc UK), into their country for AT LEAST 90 days (or the balance of 90 days) in the even the traveller has not already had 90 days in the past 180 days in a Schengen zone country. So we believe that Spain could certainly grant national permission to enter Spain over and above this. Indeed, Spain already does this for 18 non-EU countries like New Zealand, Canada, Singapore, Japan, Honduras etc. - Andrew - 180 Days in Spain Campaign

You're not alone. Because people don't like the impact of the 90-in-180 day problem, they view it as a restrictive rule from Brussels. Of course it suits member states to have people blame Brussels in their minds too. Remember there are eurosceptic politicians all over Europe too. But the reality is quite different because if the 90-in-180 Day Schengen visa waiver didn't exist at all, then Brits would have no visa-free access to Spain at all. Normal rules for all foreigners would apply. No holidays without visas. So the Schengen Visa Waiver is a very good thing for all Brits right now. It's more accurate to complain that the provisions of the Schengen Visa Waiver are not adequate, then it is to complain about any supposed 90-in-180 day rule, because essentially it is not a restrictive rule at all. We hope Spain will choose to introduce a Spain/UK-specific National Visa Waiver that works in a similar way to all the pre-Schengen bilateral treaties that exist for New Zealanders and Canadians and Japanese etc. 18 countries have bilateral agreements with Spain and we have reason to believe UK gov might (finally) be exploring such a possibility now. We are trying to nudge them in that direction.@@manuelfg2902

So you keep stating without explanation. Spain cannot unilaterally change an EU law. Third country nationals can’t remain in Spain for longer than 90 days. Spain can of course create residency visas and even tourism extension visas, but they can’t change the Schengen law.

Even if you have a Irish passport you are not permitted to stay for more than 90 days without having a private health insurance if you stay for more than 180 days you automatically become a Spanish Tax resident..I take it you are Ducking and Diving/ living under the radar Illegally in Spain if you are staying for 9 months you are classed as a Tax evading illegal immigrant.

@@youtoospain Nothing will. Zero chance that 27 Schengen countries are going to introduce legislation to allow foreigners to stay in their countries for half a year without any control. The far-right would have a field day with that and it would destabilise politics in all 27 countries without any benefit to the countries themselves.

It will be a test then of whether Spain really is sovereign over its own territory. We think it is, even as an EU member state

@@andrewhesselden What test? Spain has clearly sovereignly agreed to limit its visa-free period to 90/180 days. It has the sovereignty to issue longer visa-based permits like all EU/Schengen countries have. That is, the test is whether Spain is willing to leave Schengen for a few British tourists, and the results of that test are already in the Tourism Minister's comments.

The suggestions we are making do not require Spain to leave Schengen. It would fit with the current arrangements.

Actually I do live somewhere else and have done for 29 years plus. So you see I am not a Brit in the sense you think ................ I just have a British passport and family there. So in the country where I live, a resident for 29 years plus, I am welcomed and do not get asked "Why are you coming here"? This is purely an EU vindictive instruction and bare in mind I have been visiting Finland and staying on and off since 1996, but all of a sudden in 2022, did I became maybe a member of Al Qaeda? or ISIS? .... that's how I am treated! Actually no, as they are all welcomed and given housing, health treatment, money etc.

Spain is probably able to change this themselves, because the Schengen Treaty just stipulates a minimum, not a maximum.

@@XyZCwP not if you were a UK citizen and therefore an EU citizen no. To be in the EU is to be in a privileged position, you have freedom to travel and work in other EU countries, and IPREM is the monthly amount you need in Spain in order to register as a resident there if you’re a member of the club. If you’re not in the club, the figure it’s 4 times that amount. It’s that high to control how many people move there and avoid the state having to pay benefits to those who arrive with not enough to sustain them for an extended period.
