Isaac you are exactly correct! For the ones who do not know this yet. When you hire an inspector to inspect the house you are buying the inspector is only responsible for inspecting the primary. So if the inspector gives you the green light that everything is ok and up to code they are talking about the primary only. Isaac is doing all of us a huge favor by informing us about what could happen to anyone. I personally have done a lot of research into this type of situation and have learned a tremendous amount thanks to Isaac.

Isaac you have done good 👍🏻 As a spectator it is extremely frustrating to think that no one else is being held accountable but you (the new owner). Not the real estate transaction professionals (this includes a lawyer), the town administration for not following through with permitted properties. Assessors obviously don’t do their jobs in your town. They assess from a distance (never visit the properties - otherwise they would have picked up on structures that were illegal). It doesn’t make sense. You paid professionals to do the transaction - the town has some stranger put a bug in their ear “hey this property at such and such address has illegal structures” and they come flying out of the hive in attack mode 🤦🏼♀️. The TOWN should have cited the previous owner on ALL the illegal structures and un-permitted work. Yes - do you need to make the repairs - absolutely But you should not have been responsible financially to do electrical inspections, structural inspections, engineering inspections…… The Town should have placed that financial burden on the previous owner. They attacked the Wrong person. Sorry I’m venting 🤬 I’m so fired up!!!! Be proud of yourself Isaac 👍🏻 You have handled this exceptionally well. 💪🏻

You have to know the inspector's scope of employment - are they just looking for safety hazards - like poor wiring, incorrect venting on a furnace? They seldom go as deep as the as-built engineer because they aren't going to open the building envelope. You might, when you hire them, ask them to do a permit search, etc. But you will pay for their time and you can do it yourself - those records are public. Buyer Beware.

If you look back at the whole process, there was a single point of failure; it was your attorney. It's not your fault, you did what you were told to do. Any competent real estate attorney would have and should have caught those open permits. I commend you for taking responsibility of the situation and getting the job done. The world needs more hard working folks just like you Isaac. I have much respect and love your self preservation attitude, you'll do just fine in life. Hey Issac ... I think most people like myself mentioned getting a lawyer because we hate to see you being taken advantage of. I know different states have different laws, but like North Carolina, for example, has laws to protect the home buyers. In NC if a homeowner sells his/her home, they are required by law to list all items in a Disclosure document of all known issues with their home at the time of the sale. If they don't and the buyer (1) can prove there was an issue that the buyer knew about before selling their home and (2) the house was not a "but as is property", the buyer can force the seller to repair the issues. Use me as an example, when I bought my home, the homeowner had the gas turned off. After closing on my home, I noticed the gas fireplace did not work. I contacted my realtor and she contacted the seller. She said that I could have sued the seller because they did not disclose the issue and I could have sued the inspector I paid to inspect the house. But when she contacted the seller, he immediately paid for the repair. I did not have to sue anyone. Knowing this, it hurts my heart to see you being taken advantage of. When this sh**storm first started, I couldn't see any bright spots but the way you have handled it has been a total revelation to me. I wonder if you realise just how much you have grown in wisdom? Once you move on and mabe get a different place I reckon it would be a good idea to check building codes before you purchase....Do they vary state to state?

Yes they do vary but there's universal. Each city, county and state decides what they want to adopt or not from the universal standards. Like they base the Electrical code on the 2021 code etc but they can change the universal distance from A to B from 8" to 7"

You might say you went to real-estate college and paid the fees for that. I'm thrilled that you are so close to having a much more valuable property as well safer for your family. Although, it was a low blow to have it discovered, not in any way your fault, every $ and all your time and stress will be value for you in the end. Keep that in mind, it's a positive.

Issac. Sorry for all your troubles with the building. YOUR VIEWERS should use your situation with the inspectors as a learning moment and learn some steps how not to be taken down a rabbit hole. You will never win telling an official or inspector what they can go do, or what you are not going to listen to from them, IT WON'T WORK OUT WELL FOR YOU THE OWNER. in 2006 i was almost sold a pig in a poke that had a foundation disaster in progress with standing water around foundation when it had not rained / termites damage was visible, and needed a new roof as a perfectly fine home for sale by a local relator that had the listing and them needed to sell the property really bad to recoup money already invested in multi showings of it. I had a couple friends of the family that knew the local inspectors and they steered my friends away from the listing, and that steered me away from this and a couple other properties that company represented. YOU are so right about do your own work and research. call an inspector to come out and offer them lunch for a cursory stop and opinion on a property. the worst they can say is no.

Issac I hope you thorougly think about your future plans regarding the house. You have put a lot into your home. I think you should consider keeping it as your home base. I believe you are going to pass all inspections . Interest rates are higher now and you liked the property thats why you purchased it. In addition then school system you all mentioned was good. Praying for your wisdom.
