I really hope she does approach a lawyer with this so they can explain how copyright, fair use, and libel work. You can't post your copyrighted work publicly, give blanket permission for anyone to use it how they see fit, and then later claim someone infringed on your rights. If she refused permission for it to be recorded, the meetings would fall under the same laws (I believe...I'm not a lawyer) as private phone calls, in which case recordings might fall under wiretapping laws. But that's not the case here. Not to mention, your content is transformative af so absolutely falls under fair use. Glad KZbin understood this and sided with you. I really hope they start keeping track of false copyright claims and punishing people who repeatedly make them.

FYI, NONE OF THIS is a trademark issue. Briefly: A trademark is a word, phrase, mark, or similar that is used to identify goods and services to the public. Examples: the Amazon arrow, Adidas, the Nike swoosh, John Deere green on a tractor only, the music that plays before an HBO presentation. You can't use someone else's trademark in trade, or in a way that is misleading or deceptive. So you can talk about Make Wellness all you want, show their logo in your video (as long as you've made it clear you're NOT Make Wellness and don't own the mark), etc. Things that are NOT trademarks or trademark-able: a book, a video, a business, an idea. The test is "consumer confusion." In other words, if your average consumer saw this, would the consumer be confused about the source of the goods/services? Here, there is no doubt at all that there's NO confusion that you are NOT Make Wellness. COPYRIGHT is for "works." There's a complicated bunch of law about what a "work" is and I'm skipping it, but there is an automatic copyright on "works" once they are "in fixed form.": Examples: a blog, a book, an audio recording, handwritten poem, video of choreography, a dress design. With copyright, there is an exception called "fair use." That's educational purposes (you can talk about a book, write a book revie that includes quotes, etc.) and commentary, parody, and a bunch of other stuff. The test for infringement is more complicated and is pretty fact specific, so I'm skipping it. You cannot copyright an idea, an invention, a physical object, a name. It's more complicated--you can have a registered or unregistered trademark, and same for a copyright--but this isn't business advice so I'm not going there. If you have to silence critique about you and/or your products, then maybe the person doing to criticism is not the problem. I do hope they get help and out of MLMs but we all know thats very hard given the person needs to want to leave the cult or want to get help for their mental health and can not be forced. I've filled out many dmca because of my art and N eff tees, thats... Not how it works? I do understand that it can be confusing at first especially if you are an older or inexperienced with the internet.
