Samples are treated a bit differently. The samples are detected by a program used to identify other songs. Even if the sample was made to sound nothing like the original, it will still be flagged. I did recognize the melody but didn't think of the sample so it should've been written in the credits as one. Imagine people singing your well known melody but not being able to refer to you in credits (with no royalties). I wish that was handled better because I enjoy the sample, but she could've used naughty girl, baby boy, green light. I thought the sample was an interpolation of Naughty Girl originally.

I'm sure Kelis would feel differently if she was receiving a royalty from the sample being used in the song. But she was not, as she has no publishing rights for Milkshake. She was just the artist who sang on the track, financed and produced by others. Personally I don't think it's fair when a successful song is associated with a specific artist that others can benefit from people's familiarity with a beat, sound or rhythm from the song but not actually credit the artist who made the original song popular in the first place. I understand it's business, but as this specific situation demonstrates, it's a really easy way to piss someone off.
