Fine example if co. Defaults in complaying with directions given under sec16 sub sec1 co. Shall be punishable with fine of 1000 thousand rs every day during which defaults continues and officer in defaults shall be punishable with fine which shall not be less than 5000 rs which may extend to one lakh rupees In this provision defaults is a nation of offence that is why fine as a punishment According to sex 12 sub sec 8 of co. Act 2013 if any defaults is made in complaying with requirements of sec 12 co. And every officer who is in default shall be liable to pay penalty of 1000 rs for ever day during which defaults continues but not exceeding 1 laks rs In this provision defaul is in nature of non compliance that why there is liability of penalty
