Sir agr jkssb na preference k basis pa seprate list banayi hoti To boht sara candidates aesa tha jinko apna district ma selct hona k chances tha. But jkssb na district cadre ma b all 20 candidates k name mention kiya aur top 1/4 ratio ma wohi liya. Maxx candidates to har disctrict ma selct hua ha. To wo sab to last ma apna home district hi prefer kragay. Ab jinka chances bantay tha in hona k district ma wo to shorlist hi nhi hua DV k liya.

Sir 14:00 mein clear karta hua actually inhone har ek category ke 1:4 candidate lia hai. Sabse pehle inhone om ke lia hai fir baaki category ge. Example deta hu jaise udhampur district hai om ki seats hai140 ×4 =560 student cut off lugbug 50 tak. Jab aap niche jaaoge list mein to fir aapko st dikhenge uski seats 24×4= 96 cut off lag bag 39 tak milega , fir uske baad obc waale candidate aayenge aur jo pehla bacha hai uske mark 50 kuch hai. Jo last st tha 39 uske the uskeniche obc waala aata to uske 50 hai. Isliye marks mein mein upar niche hai kyuki har ek category waalon ko ikhate rakha gya hai. SRO-99 AND CONCERN OF HIGHER QUALIFIED UNEMPLOYED YOUTH. SRO-99 is the order from GAD since 7th April 2008 and defines rule of qualification eligibility to fill class iv vacancies. Under SRO-99 min qualification to fill class iv post should be 10th and maximum 12th. Does it mean higher qualified persons are not eligible? Yet it does not mention anything about higher qualification. To know this point we have to analyse it from 2008, how govt. departments, the then recruitment agency (employer) , analyse it and implemented it. In 2014, GAD itself invited applications for class-iv posts in J & K secretariat (subordinate ) service, under Adv notification no: 01 -GAD of 2014 under SRO-99 qualification eligibility criteria. However note(2) of notification mentions no weightage shall be given to higher qualification as it was necessary to mention that time because those who had higher qualification should apply on 10+2 basis as their higher qualification wouldn’t be considered. In 2014, Govt. Of J & K Directorate of Agriculture Kashmir invited applications under notification no 02 of 2013 for class iv posts under eligibility qualification : “Min 10th and max 12th whereas no weightage shall be given to Higher qualification in terms of SRO-99 “ in 2015, Govt of J &K office of chairman Divisional level committee invited applications for class-iv posts under adv. Notice no 01-of 2015 with same eligibility qualification by giving no weightage to higher qualification in terms of SRO-99. There are almost 15 departmental recruitments of class-iv through different SRO’s but same qualification eligibility criteria SRO-99 where no weightage were given to higher qualification. So from these recruitments till 2018 ,we can conclude that higher qualification was no barrier to class-iv posts under SRO-99. However it was necessary to mention that “no weightage shall be given to higher qualification” because shortlists were prepared on the basis of marks obtained in 10th and 12th. On 15th Sept. 2018 under SRO-404, section 124 governor directs that the selection of class iv posts borne on establishments of all the Govt. Departments shall be made solely on the basis of a written examination to be conducted by Jkssb , whereas the qualification for recruitment of class-iv posts shall continue to be governed by notification SRO-99 dated 7th April 2008. After the constitutional changes in Jammu and Kashmir , GAD came up with new recruitment rules of class iv under SO 184 in which chapter II section 5 defines procedure for selection and subsection (2) defined as “ The board shall invite applications for the said posts from the persons who are domiciles of the UT of Jammu and Kashmir, and are within the prescribed age and possess min and max. Educational qualification as prescribed in notification SRO-99 of 2008”. From this it is clear that although recruitment rules of class-iv have been changed in which higher qualification eligibility is still same SRO-99 in which higher qualification was no bar to apply for class-iv posts. On 26-06-2020, JKSSB come up with class-iv notification, adv.01- of 2020 for 8575 posts and known as special recruitment because of special rules first time in j and K history mentioned under SRO 184 . The rules are separately for district, divisional , UT cadre posts in which home district to be given 10 points, home division 10 points, widows/orphan girls and no govt. employee in family 5 points, casual workers engaged for 5 years or more to be given 5 points etc out off 100 . The 6th point of terms and conditions of notification defined qualification required , written as “ As per SO 184 of 04-06-2020 read with SRO-99 of 2008 dated 07-04-2008, the min. and max qualification for application to class iv, posts under Direct recruitment shall be as , Min matric and max. 12th” same line mentioned in SRO-99 which had never stopped the higher qualified aspirants to apply for class-iv posts and the selection being on the written basis only ,which itself mean that there is no weightage to higher qualification. Higher qualified unemployed youth applied on the basis of 10+2 under SRO-99 by surrendering their higher qualification , keeping in view the higher rate of unemployment in UT , and under the declaration as follows, “ I further undertake that I shall not claim any benefit of any qualification/category that have not specifically indicated in this online application form” What does it mean? Doesn’t it mean no weightage shall be given to higher qualification other than 10+2.` Majority of higher qualified aspirants approaching to overage or have crossed it or have less than 50% marks in graduation and not eligible for other posts could be their last hope to get employed on class iv post. And those who are highly qualified and working as causal labourers also applied for class iv job with the hope of additional weightage of 5 points under S.O 184 . Some of the aspirants got ambiguity when asked for higher qualification forwarded their concern through grievance to GAD and in response GAD made it clear on 04 November 2020 through grievance to one of the aspirant that “ for these posts class 10th as min. and class 12th as maximum has been kept as eligibility, however any person who has qualification higher than this can also apply.” So here all ambiguities, confusion, new rule, SRO-99 under new rules in UT got clarified and therefore higher qualification to class iv post was never bar to apply on the basis of 10+2, and same in UT new rule. On 25th may 2021 jkssb came with shortlist of written fastrack recruitment of class iv but prior to one day i-e on 24 may 2021 jkssb chairman gave his statement on electronic media TSL (media channel that max 12th means max 12th , not above than that, and we would filter out graduates which raises concern for unemployed higher qualified youth. However this is not first time any notification mentions max 12th to apply for class iv. Besides departmental recruitments jkssb recently are in process to recruit candidates for class -iv Pandit migrant vacant posts , in which qualification eligibility is also min 10th and max 12th. Nothing mentioned other than this, but yet not issue with it. Jkssb is the recruitment agency and it is the GAD which frame rules, statement of jkssb chairman on TSL was not in his domain and had issued that time when everything was clear on ground from GAD regarding Higher qualification It is necessary to mention that a notification dated 10-09-2013 to director consumer affairs and P. D dept. Jammu and Kashmir from govt. of Jammu and Kashmir CAPD dept. civil secretariat Srinagar on the advice of law dept. regarding qualification for filling up of class-iv vacancies which mentions as “Department is advised that higher qualification cannot be a bar for applying for the post. Barring higher qualification is illegal and violation of constitutional rights”. Since 2013, there has been no such amendment in fundamental rights which made illegal as legal and unconstitutional as constitutional. Besides barring higher qualification would discourage future generation to pursue their goals and achieve higher qualification. By one statement from jkssb chairman on media channel has put unemployed youth in ambiguity and mental distress, and GAD is silent in this matter, which is apex body in this matter and the interpretation section of S.O 184 defined as “ if any question arises relating to interpretation of these rules the matter should be referred to Govt . in the GAD whose decision thereof should be final” . GAD should come forward and make it clear keeping in view the SRO-99 with respect to previous recruitments so that this fastrack special recruitment will end up smoothly otherwise this will also face hurdles as previous recruitments which takes years to be completed. author: ARSHAD AHMAD

Sir those candidates who are OM but having less marks like 28,30 are in the list. Because they belong to ESM (Ex servicemen) category and you can see in Advertisement 1 of 2020 that there is horizontal reservation for Ex Servicemen. Page 21 of Advt. 1 of 2020 explains: i/ The horizontal reservation for Ex-Serviceman and Physically Handicapped persons to the extent of 6% and 4% respectively means the reservation which would cut across the vertical reservation and the persons selected shall have to be placed in the appropriate category by making necessary adjustments.
