46:00 An individual is said to be resident in India in any previous year, if he: For that year, his period of stay in India is182 days or more, in case of an individual who goes outside India & whose Total Income exceeds 15 Lakh Rupees, 120 days shall be considered instead of 182 days. On the basis of the above rules and some additional rules, an assessee is classified into 3 categories, 1. Resident (R) - all income of the world will be taxable in India. 2. Resident but not an ordinary resident (RNOR)- all income deemed to accrue or arise in India is taxable. 3. Non-resident (NR) - only income arising out of India is taxable. (diff. tax rates) Having asset outside India only have an impact on Resident and RNOR (if he receives such rental income while living in India) but not on NR(i.e. who stays less than 120 days in India). The above rules are grossly simplified just to address the context.
