The witness stated that Kelsey fire the gun during a fight, had gun shot residue on her hands, was granted immunity so she could confess but wasn’t granted the correct immunity to fully protect her, Kept pleading the 5th & had motive. The reason her & Meg lied about the fight is because it lead to her firing the gun. There was a massive amount of reasonable doubt and he should have never been found guilty.

Sean Kelly changed his story multiple times and changed it just enough to help the prosecution after they secretly spoke to him to half hazardly claim he at least out a finger on a wean which to do that you have to acknowledge Kelsey actions and they ignored just to rush a verdict out before Christmas. That witness switched his story a day before after talking to prosecutors. There’s 100% something off about this case. The witness was sure that two women were fighting and the girl fired the gun first. It’s highly plausible Tory was just trying to control and direct Kelsey’s arm and the witness lumped him in with Kelsey and said they were both shooting. Tory VOLUNTEERED to get dna tested. Someone who knows they fired that gun let alone touched it is not going to do that. If he fired that gun 5 times, his dna would be conclusive. There is so much reasonable doubt in this case

DNA being inconclusive on a gun isn't uncommon at all. All you'd really need to do is wipe it and/or hand it to someone else in many cases. It's only reasonable evidence someone else did it if someone else's DNA was conclusive which wasn't testified to. Hence not really reasonable doubt when the other evidence points Tory.

Not at all. Juries can disregard all, parts or take what they think is credible and matches other evidence. It's up to the lawyers to highlight how something fits within evidence and cross to highlight if it's not accurate to facts. Varying levels of inconsistencies in testimony isn't uncommon especially with ancillary details when the events happened years ago, for example it happened at night vs afternoon. They originally saw two people but it was 3, person was wearing blue but it was black etc. There are also cases where witnesses interview to something but don't remember at trial ( for various reasons) and cant testify to that etc It's up to the people making the case to argue if any inconsistencies are material and/or if that makes the whole testimony unreliable.

The independent witness was an old scared white man who saw 4 black people acting a fool outside his home. Tory could very well just have been standing next to Kelsey and he included him as the shooter just like he said they were all fighting when it was just Meg and Kelsey while the men tried to break it up. He prob thought just cause Tory was on trial, he must have done something wrong and there was a reason. I also find it funny how a defense witness was seen in a back room with prosecutors right before testifying. He said they were BOTH shooting, one person shot that gun and he was clear the girl fired first.

The job of the prosecution is to prove guilt beyond a reasonable doubt. 1. His DNA was not conclusively on the gun. As the subject matter experts from both the prosecution and defense explained, if he shot a gun 5 times, then his DNA would conclusively be on the gun. 2. Every witness, apart from EJ, has a different version of events. This is crucial because it means no testimony can be believed. As a witness, your credibility is everything. 2b. They should have questioned Mr. Kelly about his eyesight; Does he wear glasses? How good is his vision at night? Why was his original statement, Hours after the event, drastically different from his account 2 and half years later? Come on, which testimony would you believe? My recollection of events two years later is worlds apart from my original testimony. 3. EJ explained Kelsey was known for carrying self-defense tools, and he saw something that looked like a self-defense tool in her bag when he moved her bags. 4. Kelsey was given immunity and still pleaded the 5th. 5. The position they were arrested in was not the seating position they originally occupied. 6. The gun magazine had a female DNA profile on it. - This is key for anyone who messes with guns. 7. Kelsey's DNA was never taken and compared to the DNA on the gun. 8. The LAPD did not collect all the evidence at the crime scene. Despite what was claimed by the witnesses, how did Tory Lanez (who was coming from a pool party, dripping in water and having shorts on) shoot a pistol and, as stated by the eyewitnesses, without leaving conclusive DNA on the weapon? His defense attorney failed to lean in on the DNA portion. I can promise you if Tory Lanez DNA was objectively on the gun, the DA would never have let that go. DNA is the glue of the case. If I was his defense attorney, I would have put the witness testimony against the DNA to prove my client did not even touch the gun and had this case dismissed. If the client did not touch the gun, He couldn't own it, he couldn't assault anyone, and he couldn't definitely be the shooter beyond a reasonable doubt. Granted, there is more evidence. However, the question in criminal law is not is someone innocent BUT does the evidence substantiate Guilt BEYOND a REASONABLE doubt? All the inconsistency mentioned here does not suggest guilt beyond a reasonable doubt. To argue differently is an emotional cry, IMHO.

He testified a spark coming from near two women, and on top of everything he said he doesn't know if he saw a weapon, and he was focused o. The safety of his son. Neither women mentioned the fight, and Kelsey flipped on her own interview. Only person who was consistent was Meg, but the witness testified events that she didn't mention, she didn't remember going back to the party. Then the hairdresser testified to how drunk they all were, and how Meg is as a drunk. The only way to believe he was the one who shot beyond reasonable doubt based on the evidence presented in court is if you cherry pick portions of testimonies to suit what you want to believe happened
