He takes most people he is questioning by surprise i think because he comes across as a kinda old man thats meandering and mumbling a bit with that accent....and then he just cuts to the heart of the matter and blows the lid off the whole reality of the problem with such brilliance its mesmerizing to watch. And then he comes out with one liners that are so succinct and appropriate...i try and use them in my daily discussion. One of my favourites of his is "the guy is just like a Rock, only Dumber...". You are a very special man Mr Kennedy.

Is the woman sitting behind him having an affair with the cameraman? Because she cannot take her eyes off the camera! We have laws that protect business information and we have laws that protect trade secrets. So why do we need corporations to tell we the people and other corporations they're not allowed to work together? We don't. Use the laws that already exist to prevent people from stealing from your company. Don't steal their ability to work from them just in case. Non-compete agreement should be illegal. They're not a two-way street they're a gun to someone's head. If you want this job you'll agree to not work if we fire you. How is it the government does not understand what a figurative gun to the Head is?

As a nurse with a home health agency, I had to sign a “non-compete” agreement. I don’t agree with it but I get it. They wanted consistency with their nurses for continuity of care. Otherwise many nurses jump to the next home health agency that pays more or offers a bonus-which gives the company a bad look (since patients get attached and comfortable with a stable nurse in their homes).

Contracts of Adhesion - Exactly. In the absence of relative equality in bargaining power between parties, a non-compete agreement is a contract of adhesion and should be illegal.

25 yrs ago i was fired for refusing to sign a non compete. 18 months later i started a business to compete with my former employer. To date the company i started has done 100 million dollars worth of business. I warned them. Thank u masco

I learned this in Business Law 50 years ago. Knox and Murray's Ice Cream Parlor. They were partners. They had a falling out. Knox bought Murray out with a handshake and understanding that they would part ways and move on. Murray bought the big house directly across the street and opened Murray's Ice Cream Parlor. Knox sued for non-compete since all of Murray's business was at Knox's loss. Knox won a settlement. Both businesses existed for decades thereafter - directly across the street from one another. No price wars. No hostilities. They both died friends. They split the business when they were together, and split the business as competitors.

I've never signed a non-compete agreement. They never fired me, and 18 month later, I left that job and started my own junk removal businesses in florida. I was working as a W2 employee, but the employer was paying me as 1099 independent contractor. Today, I received a text message from this former employer saying that I violated the non-compete agreement and he is going to sue me if I don't close my new business. While I was working for that company, I was making $180 a day. Most of the time, I worked from 9 to 14 hours a day without benefits and no overtime pay Does anyone in here know if this becomes a legal issue or not?

My wife was once asked to sign a non-compete that given her resignation or dismissal would for two years restrict her from working within her chose field. Which is cancer research... She didn't agree to it. They still hired her because they needed her. Meanwhile, I offered to sign one last week because I'm developing a program, paid for by another person, and I'd like to use parts of it for something else. I offered to sign a non-compete limiting me from using it for certain specific purposes that might be seen as competitive with the guy paying for it. They're great business tools when used fairly, and fairness shouldn't be so complicated.

I would somewhat disagree. Noncompete agreements should only be able to exist if the employer is required to continue to pay the employee their full salary during the term of the noncompete or until the employee is able to find full time employment or business ownership.

When non-compete agreements were very uncommon, American technology leapt forward and America was very competitive. What used to happen is that researchers working for Company A would have a good idea, but management were for whatever reason not interested. To the boffins with the idea would leave and form their own company, develop their idea, and do very well out of it. But Company A would do well too, because they had been around a while and customers knew they were good. Sometimes Company A would undercover a common product problem, and put their boffins onto solving it, which they did. This would make Company A outcompete Company B, so B would offer A's boffins more money and poach them. So the intellectual property got transferred, and both sets of customers benefited, the two companies kept their market share, and everyone actually is happy. Really, if a company finds it necessary to get its workers to sign non-compete agreements, mostly its a case that they risk workers leaving if they aren't paying enough, or not providing good work conditions, or they have some leverage that prevents people from leaving.

The issue isn't the existence of non competes, the issue is government agencies unilaterally declaring them illegal despite having no congressional authority to do so. There are definitely places where non competes are important. The real reality is this isn't really about anything but allowing foreign business owners to swoop in and steal workers from companies in order to put American businesses out of business. America won't be competitive under the Democrats, it's designed that way, to stop America from being competitive. You try to start up any business in America that would replace something America gets from foreign countries, and you'll be shut down and your money will be tied up in red tape for years, if not decades. They've designed the system so Americans can't create anything to compete with foreign imports.

The example used by a former employer, somebody working there thought management was crap, and started their own business in a related area, so management wanted to stop anybody else doing that.

@@liam3284 and that's exactly what an employee should do if they don't like management - leave, go to another firm or start their own. That's the ethical thing to do. For an employer's point of view, they are usually better off without the disgruntled worker anyway - they can replace him with somebody better. For an employer to try and prevent a worker from going to another firm or start one, is restraint of trade - restraint of trade is illegal in most if not all Western countries.

The way non competes are used is like if buying groceries at Wall Mart means you sign a contract prohibiting you from buying groceries at any other supermarket for the next 12 months. Even if Wall Mart shuts in your town or goes bankrupt, they will still threaten to take you to court for shopping elsewhere. They have always been routine work, worded to be as broad as possible, and entirely one sided, binding the employee, and providing no obligation for the employer.

When did he lie about this? For example: It's widely known that former Virginia Governor Ralph Northam said that in at least some cases: "the infant would be delivered, the infant would be kept comfortable" and then "a discussion would ensue between the physicians and the mother" [i.e. a discussion to kill or keep alive the infant]. Even if the infant was born non-viable, this language is disgusting. "Keep it comfortable"... sickening. We all know what he was hinting at. Senator Kennedy isn't pulling this stuff out of thin air. Pro-choice politicians are just so abortion-obsessed that they feel free to spew their dangerous rhetoric without consequence.
