He might've been on drugs, who knows. But that sniffing was him pretending to cry...very poorly tho. People only do those cry sniffs/gasps when they've already cried heavily for over a minute or two at least. And the sniffing shouldn't have that horrible dry whistle sound either. The nose gets runny with true heavy crying, I think bcuz the tears also drain into the sinuses from the inside as well as coming out of the eyes and it softens mucus causing your nose to run. So if nose is dry, that means there wasn't tears.

When someone expresses that they'd like a lawyer, is it ethical or even legal to try to talk them out of it? I thought all questioning (he asked why he wanted one and what good did he think a lawyer would do- he wanted Josh to answer questions, not a lawyer.) I thought they had to shut it down completely. Or is that only after an actual detainment or arrest? Of course now we know he did it but at this point she was still considered missing.

It is actually a misconception that the police have to stop talking as soon as a suspect says anything related to "attorney". "Spontaneous utterances" or other unprompted responses are allowed as evidence, according to the Supreme Court. It also works if the suspect starts talking to the police voluntarily. These are the reasons that police will do things like sit in the interrogation room and fill out paperwork silently with a suspect across the table: it is to make the suspect start talking to them again without a lawyer present. There are also cases where the request for a lawyer was "unclear" according to the police, and the courts have upheld that their continued questioning was legal (in reality, they were just being obtuse and using linguistic gymnastics to violate a person's civil rights). When the police want to talk to you about anything other than your name and what you are currently doing at this current exact time and in your current exact location (e.g., "I am John Smith and I am trying to get back into my house because I locked myself out by accident"), then you say "I want a lawyer." and repeat that in response to every question until you are talking to your lawyer.

@@BDaltonYoung Thank you, someone who actually knows what they're talking about and backs it up with source info. Not only that but even when they are legally obligated to stop asking questions, in many instances they can still make statements all they want. Statements such as "If you don't have anything to hide, you would want to talk to us. Asking for an attorney is something only guilty people would do, and we are just here to try and help you." If you start talking again after that, then you are agreeing to continue the discussion. A smart cop will verify that you indeed want to keep talking at that point, which we've seen innumerous interviews.

Not true, you're given a lawyer if you can't afford one (for crimes only I think). Everybody who winds up in an interview room can say they don't wish to talk without a lawyer and the interrogation ends. Now when it comes to convicting and punishing a rich person, that's different, but everyone gets a lawyer.

Maybe, if the police would have followed the law this dude would be in prison and the boys would be alive.
