@@nctpti2073 Street meth is a horrible drug. I don't think that it should be a crime to possess or use but it is a reasonable condition of probation to forbid it. Marijuana should be treated just like cigarettes and alcohol. I hope treatment works for the guy, he doesn't seem like he would survive Huntsville (the main prison in Texas).

This judge, whatever else she may be correct and fair on, has no idea of reality when she early on states, not implies, STATES, as though fact, marijuana leads to methamphetamine use (the old, marijuana is a 'gateway drug') trope. This may, MAY be what happens to certain people, but correlation doesn't equate with causation, and just as there are untold millions of people that can have a couple of beers and never become hard-core alcoholics, there are probably even more people that use marijuana either recreationally, or for pain cessation, who never move on to hardcore drug use. This judge might be interested in reading in-depth peer-reviewed studies that challenge her rather naive perception of what marijuana 'leads' to. Sad.

The problem is- they're not being locked up for the drug use, not using drug drugs is part of the rules of probation for their ORIGINAL crime. These people plead guilty to whatever their original crime (assaults, gun violations, robbery, DUI's, etc) and accepted probation instead of jail. So, no, they're not going to jail for drug use, they're going to jail based on the crime they originally plead guilty to committing.

You're sentenced to jail/prison and immediately go there for the full sentence...as far as you know. 1-2 months later (or a few weeks, depending on your crime) you're suddenly let out on probation. All these drug cases are such a drain of tax payer dollars. I imagine they cost a horrendous amount well beyond any court actions for rehabs to sober living and beyond. In addition, probation and monitoring costs must be exorbitant. I understand there is a huge drug problem, always has been, but it’s hit extreme heights since covid. To see cases for marijuana seems a complete waste of time, treasure and resources. Especially in personal use cases. Not all drug users commit other crimes or deal in drugs. These individuals are not necessarily a threat to the rest of us and allocating so many resources in this direction is a never ending, feckless endeavor. Our justice system should focus on the bad acts and individuals who commit them which truly endanger a community. Smoking pot is not one of them, in my opinion. Even those who use harder drugs do not necessarily pose a ‘threat’ to society. Yes, the trafficking of drugs endangers society because of the inherent criminal element. But, it seems as if the user assumes the burden for it all to make us feel as if we are tackling the issue. If we just lock up and punish the users, we will reduce/eliminate the criminal element by diminishing demand. How’s that worked out?! We’ve been beating this dead horse for decades since the eighties and the problem has just gotten worse. We need a new, innovative way to help users in lieu of making criminals out of them. Perhaps we could come together as a society and come up with alternatives. Users need help getting their lives in order, tackling the problems and deficits in their existence for which they turned to drugs to begin with.

Data published by NIDA in 2023 had about 30% of users developing an addiction to marijuana. The likelihood of addiction becomes greater when use starts before adulthood, which is increasingly common as marijuana becomes more normalized. But it is simply wrong to state that marijuana is not addictive, and all the research shows that there is a considerable degree of potential for addiction.

Despite the fact that it's still technically a Federal offense, Texas looks ridiculous for continuing to have anti marijuana laws on the books in 2023, especially since so many States have legalized or decriminalized it. Even my home State of Louisiana, just about the most backwards place in the country, has medicinal use and decriminalized personal use possession. On the other hand, alcohol is the world's worst!! It absolutely ruins people and families. I don't expect agreement with this, but opium is also a plant. Unlike marijuana, there's addiction involved, but opiates should be legal just like methadone is. No driving while under the influence and no presence of children should be allowed. Other than that... (Opiates will never be legalized because the government entities that are behind the Prison Industry, which includes the importation and distribution to the population, will never give up the enormous amount of money they're making from this.)

I love Judge Boyd and I know she's just following the stone age laws of Texas, but Marijuana? Come on now. Legalize, tax, and regulate. Do you know how much money the State of Texas would receive from the tax dollars alone? Taxes from Marijuana in the State of Nevada helps fund public schools.

Since he's in Texas in Delta 8 is legal. He should dis smoke Delta aid. Yes, he's gonna still test positive for marijuana, but technically its legal.

Not if he is on paper, legal or not. If probation says no to any meds--that is a violation. Saw that with another parolee who had a card from a dispensary. Big surprise for the parolee--to her deteriment.

@@p1st0ls44 what a stupid arguement. abusing your kids is illegal whether u are high or sober, so wtf are u talking about. No one is sitting at home saying, "Damn I wanna smoke crack, but I cant because its illegal." NOOOO. People who want to do drugs simply use drugs. Sending them to jail has NEVER stopped or fixed this problem.

This judge needs to follow the law and stop acting like a damn therapist. Marijuana is legal in most states and she thinks sending this guy to "intensive drug treatment" is appropriate??? She's a genuine asshole. I used to like her, but the more I see her the more I can't stand her.

I think and I could have misheard but I believe he mentioned that he was using something else as well. But I think she’s just trying to find a way to not just revoke him and send him to jail because technically since he’s on probation any positive drug test could mean he is revoked and goes to jail

She has to enforce what this idiotic "state" has on the books. It's incredibly backwards, costly, and pointless to boot. But she has to do her job, even though I'll bet she agrees with you and me that continuing to criminalize recreational use of weed is nonsensical. So, as a compromise with her mandatory orders, she tries to talk sense into these users, and give them alternatives to jail wherever reasonable and deserved. Please rescind your calling her an ash whole, she is clearly NOT.

@mpayne8206 Жыл бұрын
"Legal in most states" its not legal in this state, so what are you talking about? She is a great judge. Yes she sometimes is prob a little naive about addiction, but she adheres to the law. That's her job, she's good at her job. You must be a pothead? I'm asking because I've seen other people get really butt hurt about the legality of weed, and every time, they were heavy weed users.
