Jason Gates The contention of the plaintiff was that the defendant broke her phone and therefore owed her the money. Since the loss was accidental, under the law she cannot compel the defendant to pay, and the defendants under no obligation to pay despite what she promised. The rulings in these cases are based on law, not our feelings about what is "fair". The defendant needs to get accident insurance on her next phone.

so the judge could have ruled either way. On one hand yes she could have agreed to pay for a portion of the price of the phone. %00 or what ever would have been too much especially since it was a phone that was used so it would have depreciated in value anyways. The question is is the defendant responsible. If it was how they described and it slipped and especially if they were both moderately intoxicated it actually can void any responsibility. Reasonable care was made because it wasn't like she was saying .. hey hold on to my phone for the day and she lost it. Bottom line the girl who is the plaintiff spent way to much money trying to recover something that wasn't even worth the money that she spent. She should have cut her losses or got her friend to pay her by the sunday.. and chilled..should have not shown up at the job and probably cut the loss in the first place or... get a good case.

First case, not sure about the ruling becuz even tho it was an accident it still was gonna cost to get fixed or replaced. Reallly no different from having a car accident and even tho it was an accident, dat person is at fault and they have to pay or their insurance. Not even halfway into the second case I knew dat the plaintiff wasn't gonna win becuz the defendant brought the boat as well, which makes him a victim too. Why sue somebody dat actually brought and had ownership of the boat as well? You sue the seller's, not the buyers smh

In the first case there was proof that the defendant agreed to pay for the phone she broke but didn’t provide evidence of negligence? What would have been the outcome of the friend accidentally crashing a car ? She would have been liable especially if she had agreed to pay. Love Judge Faith but didn’t agree with her judgement and in recent seasons of the show feel that some of the judgements have been emotionally based rather than solely legal, factual and street sensible.

The first case is so ridiculous. The plaintiff asked the defendant to do her a favor. Then got mad when an accident happened. The defendant said things she didn’t mean and should’ve have said regarding when she wasn’t goxing to give her the money. Then the plaintiff drove 2 hours to have a $70 dinner at her job and drove 2 hours back. Then she told the defendant was done speaking to her. Then she had the defendant served with a lawsuit at work. If someone dropped my phone if they were doing me a favor I would be upset but I wouldn’t expect them to pay for it. I asked for the favor. They didn’t just pick up my phone and do whatever they wanted with it without my permission.

It’s pretty simple. On the first day, the original buyer had taken a picture of the boat. The next day (or any other time within the 4 day course) the original buyer went on vacation. When he comes back, he finds out that the boat was stolen and finds it. The thief could have told him when he bought/took it or legal documentation of when he bought/took it which tells you when he bought/took the boat. That answers all your questions.

Yes you're right but then the plantif should be accountable as well for being intoxicated. Therefore going to a concert to drink and then handing a phone over without full capacity and control of yourself, means you can't blame the other for negligence. Too bad too sad. stop being a petty pad.

I don't think it matters. I mean if I go buy 75 dollar sneakers and someone owed me 200 dollars for a deposit or whatever, it's still owed to me whether I can afford other things or not. It's my money, not theirs. This is a different case though, but I'm just saying because I'm in the middle of an unreturned deposit because the lady "does not have the money yet".

well by the logic of the judge in the first case, ima just go around dropping people’s phones and I shouldn’t have to pay because it was an “accident”. even if I agreed to pay for the item I dropped, I shouldn’t have to pay. if I drive my car into someone else’s I shouldn’t have to pay because it was an “accident” 😂😂 like what

It was the way it happened tho. It seemed that they were drunk, they both had the phone in their hands when it dropped. It was sort of both of their faults that it broke.

this judge always in her feelings. the girl agreed to pay the 150 and she should have. the phone was damaged because of her, now the plaintiff has to go get a new phone out of her own pocket.
