You're 100% right, but there's something shifty about the plaintive also. There's something about that nonsense she came out with about how it would take seven grand to fix her car but she dropped it because the defendant wouldn't be able to pay it. I think she tried to screw the seven grand out of the other one, who I admit was totally in the wrong regarding the cause of the accident. She probably thought this girl's driving so illegally, she'll cough up to avoid attracting the attention of the law. Remember, the Blue Book value was only $1800.

wait...she has no licence, insurance, and avoiding the repo guy AND causes the accident - but only pays $1800...the plaintiff could have got a lot more - the other woman should have be referred to a higher court and put in prison for dangerous and illegally driving (i guess american laws are very relaxed) As for the dog - if it was a bite it would be puncture marks not a gash -- my dog has been bitten before, i have been bitten, i know others have been bitten. It sounds like the leash did get caught on the leg, he's then yanked it back and the leash has caused it due to him being too rough.

Lady in the first case is probably being criminally prosecuted or fined for driving without a license and insurance. However, this is small claims court and Judge Faith does not have the authority to sentence someone to jail. That occurs in a criminal court under a different judge.

That’s not true. If your dog is on your property/within your control and has not history of aggression, the defendant has to proove some sort of negligence. So if you were at my house with your dog. And our dogs were playing in the yard and scrapped, I would not be liable unless you could prove my dog has an aggressive history and/or I was negligent in the situation.

The vet probably is the one who called on his dog. When my dog was injured by my other dog (they were playing rough and she jumped into his open mouth and got one puncture in her side only $400 for that one) they told me they had to call on a dog bite but they weren't going to call on mine because they could tell it wasn't an actual bite. She most likely would have had more than one puncture if it had been trying to bite her. He is a bloodhound rottweiler and she is a doberman just FYI.

The defendant in the 2nd case made sense because from the time of the attack to the time the limp was discovered, something else COULD HAVE happened 😒 We know it's most likely from the attack but because the plaintiff initially walked away with no initial complaints or damages, something else could have happened to cause the dog to have a cut/bite.

Well, the first case is really her fault. Driving around without a licese or insurance is dangerous. You have no state approved license for whatever reason, and no insurance which is even worse because if u seriously injure her or someone. Boom it falls in your lap buttttt you wouldnt pay and now its her responsibility. My friend had the same situation, its a tragic thing but the girl is honest and sweet for the most part. If she wasnt driving no one wouldve ended up in this situation. That one poor decision costed them both a good amount of money...be more responsible people

I got a 140 pound pitbull x Great Dane, Pitbulls don’t think like normal dogs, I keep my big girl at the back of my property so nothing can happen, I got a 7 foot high fence cause my girls 5 foot 3 on two legs. I’m bloody sick of lazy ass idiots who make this breed look bad. Pitbulls MUST be trained and you have to keep them in a controlled environment, if you can’t control that environment then don’t take the dog to it! No License, No Insurance, Questionable Registration.. and most definitely at fault for the accident as she admitted to it in court. She also tried to dodge paying $1500 which was FAR LESS than the repairs. I'd have gotten her put on a payment plan to pay off the full cost of repairs.
