I disagree with a prosecutor ever offering deferred on a DV case. A conviction of this type of offense should always remain on someone's record.

Take it up with the legislature. They passed a law creating a special type of deferral specifically for DV cases. It would be inappropriate for prosecutors to nullify that law by always refusing it.

The Police Union has been very anti DV staying on your record, thus preventing firearms use, as it would affect many officers.

That’s why we have judges making these decisions. I know someone whose jilted g/f claimed DV and they arrested him until trial. A charge is not guilt. And the prosecutors make it so you have no choice to plead guilty to make it go away.

There should be much more severe consequences for people that are initially given probation instead of jail time, then basically spit on the court by failing to meet the terms of probation.

There is almost always a longer sentence for having probation revoked than what the person would have done if they just went to jail in the beginning.

Last time I got a speeding ticket I came dressed as if I were going for a job interview. The girl that was in front of me on the other hand dressed like she was about to go clubbing wearing very short shorts and a crop top to appear for her court case. The Judge was less than impressed and held her in contempt of court right there on the spot.

DV shouldn't be a misdemeanor but a felony. This behavior is close to serious bodily harm or redrum. It sends the wrong message, a slap on the finger. The Judge talks to his fans, I love it!

Yes it does. I think they drink to calm their nerves and don't even think they will get caught if they play it cool. He said the gum was the dead giveaway! Life lesson: If you drink, don't drive. If you drive, don't drink. If you have a court date, don't chew gum in the courtroom!! LOL

@@julianokleby1448 Thing is, she didn't seem intoxicated. Speaking from experience, most hardcore alcoholics can blow a .20 and seem sober, this chick seems like someone that meets the definition. Fortunately, I was never arrested even though I was driving at a .25 or .30 regularly for at least 30 years. I am also sure that when I was working compliance for credit unions (I also served as the person to go to court on small claims cases we filed against debtors) I walked into court to testify on behalf of the CU at a .11 or higher a few times, nothing was ever mentioned about it. There isn't a hard and fast rule that if someone blows over a .08 they can't be arraigned in Michigan, I would have arraigned her then sent her to jail to sober up.

Only if it's real. The Johnny Depp case should show you that everything isn't always as reported. The first time a girl gets hit, it's abuse. The second time, it's a choice. If a man is arrested for true domestic abuse, he should get jail time, and the woman should be ordered to stay away from him for life. If she gets back together with him, then she goes to jail for a year.

My daughters baby daddy showed up drunk to child support court at 9am. Judge made him blow right there. She took his keys and reset the hearing.

@@davedammitt7691 she planned it that way actually. She was grown. Unfortunately the stress of a child didn't sit well on the father. She had no problem with raising her alone though. She cut her losses with him pretty quickly, moved on and 12 yrs later is very successful and child is very intelligent and sweet.

This why I could never be a judge as respected and honest Judge Middleton is you know dam well he’s had some wild nights in his younger years and me as another human being I could never judge anyone else if I made the same mistakes in life.

I was really confused when he stated a DV conviction carries 2 points on your driving record. As well as a suspension of your driver's license. I'm glad he clarified what he stated. I thought that was outlandish of the legislation of Michigan.

It is actually possible. Telling from charts that show alcohol level progression I know I was at a .11 or higher at 9am many times, probably thousands. She didn't seem drunk or even impaired in the courtroom. She would have bamboozled most judges into thinking she is sober.

Drunks do. I talked with a guy on KZbin who had CPS on his back and who had multiple DUI cases. He drank and toked before court to make court less stressful. When I told him that was a bad idea, he scoffed, because why wouldn’t he drink and smoke before court? After all, he was drunk and high the rest of the time.

All things considered, you might sympathize with some of these people because of childhood trauma or whatever, but when you, or one of your loved ones, are on the receiving end of a serious car accident caused by drunk driving, you wish they had been locked up for a long time earlier.

They suckered that guy to plea to.DV without an attorney. That case would be dismissed if the victim doesn't show like she didn't here. That guy should never have plead out , he should have asked for a dismissal or a lawyer.

Methadone can definitely be a life saver. But I think it only helps when you’re at a place where you want help. Otherwise, it’s just another source. I would like to see clinics offering therapy along with methadone to tackle both the physical addiction and also the mental/emotional reasons that lead to drug use to begin with (if there is any, that is). I’m glad you’ve found help. Opiate addiction is a nightmare. Keep on keepin on! 🖖

Come on sir, we all meant it more a funny compliment than anything else. But man, this judge has gotten harsher and harsher and it is said, because he appears to actually be losing sight of the reality of especially young people and tenants in South Michigan rather than gaining wisdom with age. But he is an old school lawyer, too so...sight.....

I feel bad for the 23 year old. Dont get me wrong she is deserving of what she got so far. At 23 she is still dealing with trauma from her childhood. She probably hasnt come up against adult problems yet. I feel bad for her because whats coming is tough! Life!

He originally grew out his hair during Covid since he was unable to find a place that was open so he could get it cut. Then he decided to just leave it long. Love Judge Middleton.

The more I watch Judge Middleton, the less respect I have for him as a judge. I think he's a good man, but a lousy judge. With him on the bench, St Joseph County Michigan is a great place to commit misdemeanor crimes, very little punishment.

It’s quite obvious that the county that he presides over is not an upper class district. So if he was to get tougher, and jail more people than he does the county would be a ghost town. The business owners would go broke and the infrastructure would collapse. Not saying that they don’t deserve more punishment but there has to be a compromise. I’m certain he’s not the only Judge in America with the same problem, so if you want harsher punishment, then be prepared for the consequences of having half the population in prison, which leads to more problems in over crowding and then perhaps more prisons having to be built. Good luck with that.

What law prohibits you from showing up to court drunk? Alcoholics should not be adjudicated in a negative environment. The disease of alcoholism requires compassion and reason to treat.

You can't show up to court drunk because if you're drunk you can't participate in your own defense or understand the proceedings Maybe she needs to be put in jail and given inpatient treatment there. I don't care if she has a disease or not, she could be driving around or otherwise endangering the public public. "Daddy was mean to me when I was a child" is a BS excuse.
