This is what I like, no F around judges. Probation IS a defendant’s second chance. Screw it up and you do time.
@Meela234

I know some people think it's unfair to violate them when they don't report, but they agreed to those conditions instead of serving time in prison. These are the same folks who find the time and transportation to go to parties and to the drug dealer's house. They act contrite in front of the judge, but when they are in the streets, they shrug it off and go about doing whatever, then ask for a 10th chance to do better.
@Shylade
@Shylade Жыл бұрын
Agreed. They had a choice. Probation with all of its terms or jail. If you violate you go serve the sentence or a part of it. If they didn’t like the terms they can choose jail. Those who see it as a freebie end up without a freebie long lol .

Very well said. Quite a few I’ve seen think it’s not a big deal…they just didn’t call…but it’s more than that. As you said it’s something they agreed to do as part of the deal they received. Also I think it’s showing if a person can follow directions and do what they’re supposed to do. And it really is a simple one….probably one of the easiest things to do…I don’t see how it isn’t. At some point a person has to start thinking and doing for themselves….question every little thing to make sure you understand. This will not be a popular thought but it’s just an opinion but some of the prosecutors here seem to lack a backbone. I love the fact this judge holds people accountable and does tell them they do have a chance if they work at it. I actually think the second guy maybe should have done some jail time.

I am currently on probation for 5 years. I get off in 3 months finally. To see someone try to blame others for why they can't make it to their appointments to check in is nonsense. I absolutely hate to see anyone go to jail (with the exception of chomos and wife beaters), but this dude was given a chance, shown mercy and blew it. Is what it is.

I'm not excusing anybody's actions but I work at a USA prison and sometimes when these guys get probation there are so many restrictions attached that there's no way they can meet all the conditions, nobody could, so they just don't show up for their probation meetings. They have to work a 40-hour per week job, get their GED, go to X number of AA or NA sessions or both, do hundreds of hours of community service in a short amount of time, meet with their probation officer once a week (which in my state costs $30 per visit), get drug tested, attend counseling sessions and on and on and on. And most of them don't even have transportation to get anywhere. Again, I'm not sympathetic on crime but when you tie their hands how can they possibly meet all the requirements? Just keep them in prison instead of this kind of revolving door.

Agree.. probation is a total waste of time. If you do the crime, then do the time. Maybe folks would take our court system seriously instead of using probation like a get out of jail free card. Bet the backlog of cases would also diminish once folk had to be accountable.
@mrshappilymarried1
@mrshappilymarried1 Жыл бұрын
Yeah just do the time because they certainly find transportation to go rob, steal and kill for a number of selfish reasons. They manage to waste 40 + hours a week hustling, begging and borrowing hundreds of dollars daily/weekly to get the drugs or alcohol they crave. They move around town and even state to state wreaking havoc all over the place destroying the lives of innocent people without giving a damn.

Usually I think she's way out of line when she rejects plea agreements. I think that should only be done in extenuating circumstances, the judge should have to state on the record why they're rejecting the agreement, and the sentence should be appealable where the appeals court can throw out the sentence and reinstate the plea agreement. However the first case is a good example of when rejection of an agreement is actually warranted.
