Why isn't there some system to ensure someone notices that a defendant hasn't reported to jail and a judge is informed so they can issue a bench warrant? It is crazy that he was unlawfully at large for two weeks and a bench warrant was only issued because his lawyer mentioned it at the next hearing .

Devils advocate………your advocating ppl be punished for accusations, not convictions, there should be a middle ground, in other words your ok with you losing your job and house because you were accused of a crime not convicted?
@michaelwillis8966
@michaelwillis8966 Жыл бұрын
I'm sympathetic to your position, but here is the main point: they haven't been convicted of the crime, only accused, so suffering such a significant negative impact when there is no proven guilt can be interpreted as unjust and extras legal punishment. Its punishment without conviction, which is illegal and immoral. I'm not saying that ANY punishment, detainment or imprisonment before conviction is unjust, illegal or immoral, but each case needs to be observed and decided individually. Unless the person is violent, potentially violent, or a flight risk, they should be given the benefit of the doubt, and not risk loss of employment and housing just for being charged with a crime. If jailing this individual runs the risk of his losing employment and housing, it may be too extreme a punishment to imprison him before conviction. I'm sure the judge has a good reason to order his imprisonment order. I wouldn't second guess him after the fact. I'm just saying that the benefit of the doubt, and preserving individual dignity, has an equal place in our system alongside the seeking of justice.

@@MommaMe5I think the OP shows ignorance - Very very few people without a need of formal attire own it - Of those who find themselves in court, few have enough time or space to come up with the cash to buy or borrow said attire in time for court… I’ve worked with offenders for years and it’s not carelessness that makes them dress poorly, it’s often the fact they’re right at the bottom of the barrel of life! I don’t want to hear how you’d find a way, bootstraps theory doesn’t work for most! Many get stuck with limited tools and a lack of knowledge to know they have options…. Anytime a person finds themselves in heartfelt confusion over others actions, assuming no one was overtly harmed, it might be something they should check themselves over

Bird's eye view - a job concerns a private entity, breaking the law involves society at large through courts representing it. Employer might've let the jail thing slide had it been explained to them. And in any case it was the defendant's own responsibility that he got into trouble with the law.
