They might believe it'll give them leeway in terms of sympathy or a loophole to buy more time. I've seen cases (I think one of the cases I'm referring to actually had the same Judge- Judge Simpson) where someone wanted a tenant out and had already started eviction process but they excepted rent from the tenant even though the case wasn''t based on unpaid rent which basically screwed the evictions progress in court and they had to start all over again. So maybe that could've been another straw the tenants lawyer was trying to grasp also as it seemed like she pulling out all the stops and doing the most ridiculous shit to buy more time

This landlord is something else again. He has a painting estimate but no invoice to show the painting was done. It seems like he has bartered to get the painting done. He tried to get the tenants to pay propane for months before they had even moved in. It seems he also tried to get them to pay for propane after they left. He did not want to deal with bug infestations so he told them to leave and then tried to get money for the rest of the lease. He is keeping their rent deposit. Tenants have evidence the property was put up for rent with the original paint job. Landlord said it was listed by mistake. I do not believe him.

You forgot that he leased the entire premises to them and then told them certain buildings weren't included and 'other tenants' (his son?) would be storing things there and coming and going. Nothing in writing. No agreement from the tenants. Just his say so. And I couldn't believe the attorney arguing that the agreement said nothing about quiet enjoyment or sole access. Leasing always means that unless the agreement says otherwise.

Second, it’s criminal also to disconnect utilities included in rent. If I had all those issues with a landlord, especially with children, I’d have left immediately. I don’t know if rules have changed since I managed HUD housing in the 1990’s. There were occupancy rules for each type of apartment. It depended on how many people were living in the apartment. Perhaps she wasn’t allowed to move into a two bedroom because of household size. I also managed regular apartments for years prior to the HUD apartments. The rule was 2 per bedroom +1. Five people could live in a 2 bedroom but not six. If you have never managed apartments, you have no idea what is allowed and not allowed.

For all those bashing the tenants and assuming that they’re trying to get one over, landlords can be shady AF as well. My landlord rented to us when he was on the verge of foreclosure. I have to moved in, a neighbor stopped by and told us that, just weeks before we moved in, there was a foreclosure sign on the front lawn. He had a real estate agent, so we had no reason to question when the agent said that he had stopped the foreclosure and redeemed it. A real estate agent wouldn’t risk their license to lie about something like that, right?. WRONG! Not only was the house not pulled out of foreclosure, the $5000 a month I was paying him was not being used to pay the mortgage on THIS house. So the house was foreclosed on. It’s gone up for auction twice now and has not sold. We don’t even know who owns it. On top of that, when the house was forclosed on, that same real estate agent came here and put a “for sale” on the lawn for him. I have no doubt that that was a ploy to try to convince us that he still in the house and get us to move out. I also have no doubt that he would’ve turned around and rented it to someone else while he was in foreclosure by lying to them. How is he selling a house that he no longer owns? From what we’re told, he lives in Eastern Tennessee. That’s all we know. However, he is perpetually receiving mail from NYS Medicaid in the state of New York for him, his wife and his children. So he’s clearly defraud in New York Medicaid, but nobody can seem to find it. so sometimes it’s not the tenants fault, sometimes the landlord is a lying scumbag.

If it's not written on the lease or rental agreement. IT WAS NEVER SAID. Do not accept anything the managers or owners tell you. Have it all written and signed. If they don't want to put it in writing you have to be willing to walk away and find property where everything is in writing! The owner of the property is a slumlord light. He's used to living with things broken and in disrepair. He feels it's not his responsibility to fix the house because it would cost him money. Since the renter (might have) said some mean words to him and his family. He's going to try and screw over the couple and make em pay for it. Tattoo girl is not his type of person so he thinks they're low IQ and he thought he could take advantage of them. Nope. Someone should tell the woman with the neck brace that there are instructions on the medication bottle and she's not supposed to take them all at once. She's out of it 😂

Judge has to take breaks when dealing with entitled unrùly people. To some it might look at it as walking away from the problem when in reality is to ensure the cases are dealt with fairly. If he upset about a single person some could accuse him of being unfair to the follow up cases.

in RE: the poster's comment about no rent being paid, that is a bad assumption. The defendant is on a rent voucher program/rent assistance program. The default was not for non-payment of rent, but for an incident that resulted in criminal court proceedings that the landlord didn't want to deal with and in order to manage the defendant apparently, they gave her a bad faith last chance offer to make it appear she didn't need to be in court the next day (when they got a default eviction judgement on her for, indeed, not showing up). The landlord is being paid unless they are refusing payment. The defendant is doing everything in her power to find alternative housing, and the judge is taking note of that fact by pushing the date out to mid-July. I also respect Judge Simpson for forgiving a mentally ill woman for having an outburst the way he did.

17:23 I might have misunderstood, but I thought the lawyer said the landlord (his client) was trying to work with the defendant. Then the defendant's lawyer said the defendant's section 8 was extended while she was trying to get another organization to help her move. So that sounds like the landlord is going to get paid. I don't know the issue before this case, but it sounds like she's being evicted because of a criminal charge and not lack of payment. Plus, Judge Simpson knows these landlords and what they are willing to do and what they are not, typically. I've always seen him be fair to both sides. Lastly, the defendant's lawyer clearly said the defendant has mental issues. That sometimes makes it hard for people to regulate their emotions and they act out. It may not be that she has no respect for the court, but that she is deregulated as her lawyer explained. Just my two cents 🙂

17:36 your comment at the top of the video is incorrect. they’re not going a month without rent, and they haven’t been without rent. her rent is paid by voucher. the tenant’s attorney stated the voucher had been extended, meaning the landlord was in fact getting paid the rent. her eviction was not about unpaid rent - it was about some other violation of the lease re: conduct.

For the case where the couple rented a house on a working farm: I think there was a real potential for that landlord to get taken to the cleaners. According to the lease, the couple rented the whole property meaning the barns and sheds and everything else at the address listed in paragraph 1 of their lease. The landlord was renting out the use of buildings located at the address listed in paragraph 1. It seems to me the couple could have sued for all of the rent that was collected by the landlord for those barns and sheds. It probably wouldn't be the right thing to do to the landlord because it was not his intention to lease to the tenants the use of all those buildings, but if the tenants consulted an attorney they may find they have grounds to sue him for all of the rent he collected by essentially subletting a portion of the property for which the written lease agreement showed they, and not he, had the right of use. If the landlord continues to be hostile and cause them trouble, if I were in their shoes, I would be very tempted to consult an attorney. As I said, it may be legal, but probably wouldn't be right to do to him since it would likely put him in a very serious financial bind, but if he causes them more trouble, they are going to feel like he deserves it. I am not an attorney so maybe I'm totally wrong, but that's the way I was reading between the lines of the issues the judge was exploring. I wish I had watched this when it was posted, but maybe there will be commenters who straggle in late and will comment to either agree or set me straight.

I believe you are misunderstanding that case bc she is getting assistance through the state in way of a voucher which means that they are more than likely paying her rent currently at this place so it does no harm to extend it out a month. Bc it’s not a non payment of rent eviction it’s just a get property back. So with that said I agree with judge Simpson in the way he set this out so that way if they don’t find a new place by June 30th” which I’m sure they will “ than it gives a little more time to work something else out and not put her two children on the streets

The land lord on the second case is not going without rent they are just going without the tenants portion. she is on section 8 housing and they are paying every month. Don't know how much she is suppose to pay but they are giving her another voucher and she just needs time for it to go through. I agree that she should not have gotten to this point but it appears she has had some type of mental issues. I think it's a fair judgement as long as she is out by July 1st.

Most of us who are responsible have a budget. As soon as my check is deposited, I tithe first and then comes my rent. No ifs ands or buts. I taught my son to have a budget as well. It's the wise thing to do.

As someone who suffers from bipolar disorder & severe anxiety with panic attacks, I certainly wouldn't be able to manage living anything resembling a "normal life" without taking my prescribed medications. Also, I could potentially become a danger to myself & others if I wasn't taking my meds, so maybe you should think prior to posting such moronic comments. That's just my advice to you.

I agree with you on the case about the woman who Was getting Evicted or a bad voucher I feel like the judge's point of view is Even if you didn't say it the children are going to suffer something that might not actually be her fault They're pictured not only would she be homeless her kids would be homeless So yeah I kind of get what you mean but like at the same time You can't pick your parents

I am lost she can't pay rent but wants more time to move because she can not read 2 bedrooms from 3 bedrooms so the landlord should let you stay because you can see or read😮😮I am lost this judge gets on my nerves when it comes to landlord tenant issues

I dont get why anyone would live with repairable things waiting for a landlord to fix them? I will fix repairable things because it keeps me living in a clean decently nice home ? Why couldnt he easily recaulk the shower instead of living with it needing repair and allowing water to leak and cause mold to grow there and behind the shower waiting for the landlord ? IDK maybe im just from a different breed but I REFUSE to live in a dump waiting for someone else to fix eaily fixable things !

17:24 I have to disagree with your assessment of his judgment here because otherwise your putting two kids with their clearly mentally mother on the streets. Idk the laws or terminology but, doesn't a voucher mean that they'll get at least some payment from the county/state for the rent? Lastly, if Judge Simpson was able to let her outburst at the beginning realizing her state of mind, why are you so bothered by it? PS I love the channel!!

12:20 I would love to know why she turned down the 2 bed apartment with the voucher she had! What’s the age of her children? Surely housing would only give her housing voucher suitable to her needs! Did she just want an extra room or were her children older and a boy and a girl needing separate rooms. I shared with my brother until i was at least 10 years old!
