The tax implications of having them pay for your personal phone stop most people doing that. It's classed as a taxable benefit because they are paying for personal use as well and in the UK that has to be declared. As an ex company accountant (I'm disabled now) I would not agree to that.

If he worked for the guy for 5 years and admits that the card was on file, then him playing stupid and telling them to just use the card on file, he knew what he was doing was wrong. We have a business and there was a time we had Nextel 2 way radios for each of the trucks and then we eventually switched to company phones for each truck. Each phone had a set plan, unlimited so there was no way that anyone could go over minutes and data usage and it seemed to be working just fine until.......the phones started mysteriously disappearing. Each time one disappeared, I called Nextel to have a temporary hold put on them and if they didn't reappear, I had them shut down completely. They might have gotten by with taking the phones but there's no way in hell, even if they changed the phone numbers that I was footing the bill for them monthly. This was right around the time that cell phones were just picking up traction and not everyone had a cell phone back then. We actually had one guy that didn't work for us anymore, was stupid enough to contact us and tell us that his phone wasn't working anymore. No crap, stupid.

The companies I have worked for provide us company cellphones. But if an employer is requiring workers to use their own phones then they should help pay the bill. If the plaintiff had provided a phone in the company’s name then the plaintiff could have asked for it back when he fired the defendant and shut it off.
