Very unfortunate situation here. The plaintiff seems like a decent person, yet his son decides to ruin his relationship with his father to be with this deadbeat. She is absolutely taking advantage of the courts and the system to get free money for nothing. I know a lady whose husband died when I was in middle school, back in 2003 I think. It was the first wake I remember attending. She got together shortly thereafter with a guy that used to work with her husband and she didn’t marry him til maybe about eight years ago? The defendant is is not working because she gets $3500 a month alimony, which she would lose if she remarried, but is de facto the plaintiff’s son’s wife. I don’t believe they will ever get married because of the alimony.

Even if you mistakenly thought it was a gift, why would you not pay him back the $250 after he asks for it? The $3500 free money you get each month can easily cover it. So entitled. Well as a junior myself, it sucks. My father was abusive and so was my grandfather who my middle name was after. It’s a lot of complicated feelings and I’ve considered changing both my names in the past to help me on with the trauma. It’s also fucking annoying bc constantly with doctor offices, insurance issues and random situations they wouldn’t look at birthdates and would put my info under my dad’s name or vice versa.

The GF should've been made to pay ALL the debt. She alone was given the card and permission to use it only for her vet bill as a loan and therefore had a duty of care for what had been entrusted to her for that sole purpose. If that were not the case the father would not have denied the son the loan upon his request in the first instance.

The plaintiff doesn't have to accept a GIFT as payment for a DEBT. Since the defendants had the money for the recliner they had the money to pay the debt. The additional credit card debt exceeded the recliner.

She was saying, "If you were so desperate to get $242 back, why didn't you point out they should give you that back instead of a chair they bought as a present?" What she seems to overlook is they had used his name to get enough credit to pay for the vet bill and were like, "Wow, he's so nice for having agreed to pay that" which he didn't do. They had sold it as "We just need it under your name" with the implication they were paying it off. He probably thought, "Guess they're doing good with money now and thus they're going to pay me back and bought me a thank you gift for helping them in that time of need." He gave them the card expecting them to pay it off (he just lent his name so they could get credit) but they were hoping he would just pay it off when the bills arrived. Hence the lawsuit. And really they should have been found responsible for repaying all of it but because the son used the card fraudulently and he was simply a witness and not the defendant, Judy only found her liable for the vet bill.

The reason he only got 242 is because he's suing the wrong person. First thing's first, the defendants are NOT married, so they can not legally be considered one person in this. Second, it's clear that they had a decent relationship because after they did get money, which the dad knew about, they got him a chair, and he accepted it. That lends credence to the defendant's statement that he was okay taking the chair because they were family. The nail in the coffin is actually the fact that he's suing the woman instead of his son, who committed fraud against him. Essentially, JJ understood that the whole case was out of spite against the girlfriend, but can't do anything to her because the son did the spending.
