Article 239 clause 5 says: ”No amendment in the constitution shall be called in question in any court on any grounds whatsoever ” Clause 6: ”For the removal of doubt, it is hereby declared that there is no limitation on the power of the Parliament to amend any provision of the constitution” My Question to Miss Reema Umer: 1-If the cited provisions are so clear in their words and do not require any interpretation, then how come any constitutional amendment be challenged in the supreme court, let alone be considered the possibility to be struck down even if that amendment would be infringing upon fundamental rights ? 2- Wouldn't that be a clear violation of the letter of the constitution? 3- In (2015 PLD SC 267) while the Supreme court was deliberating on the 18th and 21st amendment, The ruling confirmed that while constitutional amendments are generally valid, they cannot violate fundamental rights and essential features of the Constitution, such as judicial independence and if it did so , it would be subject to a judicial review. So my question is A- Isn't this judgment itself a clear violation of the clause 5 and 6 of the Article 239 ? B- Doesn't this judgment amount to the re-writing of the constitution ?

پاکستان کی سپریم کورٹ میں اپنے رشتےدار دوست ججز بھرتی کیے جاتے ہیں ۔پھر بڑا حساب کتاب لگایا جاتا ھے کہ کون کب اپنے ھاتھ کا چیف جسٹس بنے گا۔26ویں آئینی ترمیم نے ان سب کا روزگار ختم کر دیا ھے۔

باقی اکٹینگ اس لئے لایا ہے کیونکہ وہ ٹیکس کیسس کا ایکسپرٹ ہے۔باقی واپسی پہ وہ اسلام آباد ہائی کورٹ کا چیف بنے گا۔

وکلاء کہنا بلکل غلط ہے یہ پی ٹی آئی کے کارکن ہے جو آئین اور قانون کے بر خلاف ہے۔لہذا آپ لوگ انہیں وکلاء مت کہیں۔
