Seriously? Most repos are not because you've missed a payment by a couple days or even weeks. Most repossession orders from reputable credit companies like GMAC, FoMoC, Wells Fargo, and Bank of America are posted after the loan is 60 days in arrears or more. Multiple avenues of contact have been exhausted, and the loan company sees no other recourse than taking the car/truck/suv back and selling it at auction to recoup some of its capital that's tied up in the vehicle. I repo'd for GMAC back in the 90s and a couple small BHPH lots tied to the area I was working. Most, if not all vehicles, I went after were 90 days or greater in arrears with GMAC and 30 days plus with the smaller BHPH lots. These vehicles were repossessed mostly from people who very clearly had no intention of paying on the vehicle after they got them. Wanting a free ride for as long as they could keep it.. Most of the BHPH vehicles were no longer operable at the time of repossession due to intentional or negligent care for said vehicle. The results of such behavior are, higher interest rates, more stringent loan qualifications, and less than idea vehicles being dumped into the market at a premium cost. Right now, July 7th 2023 some 17% of all vehicle loans are currently at or exceed 60 days delinquent for cars 2015 and newer.. And with 1.7 Trillion in student debt, second only to mortgages, and unsecured debt, i.e. credit cards and personal lines of credit rapidly approaching 800 Billion dollars it is no wonder car loans are rapidly becoming the next great ripple in financial disaster for Americans..

Thank you for the info. Im in Pennsylvania. They snuck on the property, got in, went ripping out of the driveway throwing gravel, my dad was yelling (thought it was me) they never stopped. I called police and they said it was repoed and so I called company. They took it over an hour away with ALL of my tools to make any money and everything of importance, and said even same day, i can have my stuff but I have to make an appointment, bring any keys, fobs, etc I own, and pay 125 and THEN they'll let me get all of my personal belongings. This was Monday and its now Friday and I've just got a vehicle able to haul it all but am short on finds now and don't feel I should have to pay the 125

My 21 year old daughter went and bought a car her own, she gives them 2100,00 she thinks shes being financed two weeks later they call her with a story that they need to put new plates on, instead they take the car back and only refund her 1000. I once had a car repossessed. I didn’t care. They didn’t conform to something, i stopped paying, and drove it around for almost a year before they eventually took it. I saved over $8,000, and bought a nice ass car with cash. And at the same time, paid my insurance a year in advance!!!!!

Did they take it and you got it back or is it up for repo and they just haven’t found it yet? If they never repo’d it and your loan is caught up they have to remove it as the car was never in their possession. If it was taken and you got it back it will not drip until 7 years.

In my opinion your worse than repossesion firms... you steal cars legally as in impoundment from apartment complexs then force scrupulous fees to get there vehicle or you own it. Repo companies take possession for what 400 flat max and that cover property and storage... repo companys pick up cars from thieves such as your self for thousands of dollars while the registered owner takes the hit for that on there credit so don't act all high and mighty.

I have pulled many disabled cars from streets at police direction as they were or a potential traffic hazard, many of these tows I do not charge if the owner is down on his luck and broke. I winch cars that get too far over and get stuck on a rail intersection just one mile from my location FOR FREE! Just last week I towed a truck owned by Capt. My neighbor car got repo at 3am -5am. I was awakened by the repo guy and his truck banging against my fence and tree on my property. They were trying to get the car from the backyard of my neighbor house and making noise I couldn't go to work the next day from all the noise and banging. Is that breach of peace?

I owed just under 7000 and I received a letter stating my balance was 0 . And that I will not have the defaulted loan on my credit nor with the agencies . Well recently I received a check for 10,500. I called the loan company and all they say is I overpayed on my loan. My question is then why was my vehicle repossessed????

Cheryse, You can sue them for breaching the requirements of the Uniform Commercial Code, which is in effect in every state except Louisiana. You can claim any damages they have caused you, or you can claim minimum statutory damages equal to ALL Finance Charges + 10% of the Purchase Price. If the vehicle was expensive or if the interest rate was high, that can sometimes be a very large number. You need a consumer rights lawyer who deals in repossession. You can call my office for a referral in your area, or you can go to www.consumeradvocates.org. To prove that you never received the notices, you can testify in court as to the delivery or non-delivery of the notices. Be sure that you never changed your address after you signed the contract, or they could have sent it to the old address. Best of luck and God Bless!

@@ambercheryse9761 That may suffice under the UCC, but most secured contracts have a provision requiring written notice of any change of address. So if that's the case, then the contract governs. If you moved and never notified them in writing, then they may be allowed under the contract to send the notices to the old address. You should talk to a lawyer in your area about this.

But again attorneys can only act whats in the best interest first and foremost to the courts. Attorneys can not truly fight for your constitutional and amendment rights and or require the law to enforce your rights. I have no idea what state you are in, so I cannot answer that question. In Alabama, they are not required to give you a copy of the repo order. However, if you are present physically and object to the repossession, they cannot force you to consent to the repo. They have to leave. If they cops are called, be sure to video it, because some officers get bribed to assist with repos, even though it is unconstitutional.

What if the company puts you into repossession illegally? I'm currently dealing with this issue with Lexus. They failed to credit my account for payments made and then instead of properly crediting my account. They subtracted more payments from my account than I actually made as well making me 2 months behind in the hole, which is forcing me into a repossession. I've been waiting since April for them to fix it. Every time I call, they say they're gonna fix it, but they have now put me into reposition and refused to take payments when they created the financial issue in the first place. Is there a video regarding this?

The mortgage have a lien holder order what is the difference??... nothing you just can't take any property without a court order nothing in the legislation code or US title gives anyone permission to take any personal items without a court order. Sir, you are the first person that I have seen that talked about this. no attorney or lawyer will represent me. they moved my mother's truck and damaged the back of her vehicle after leaving iton the road. she was so distraught I had to have an ambulance show up at our home because her blood pressure was in the 200 range. the company refuses to even my mom's car insurance company any information so she can make a claim over the damages. i feel so helpless and i dont know what to do or who to call . I am not licensed in Florida, so I can't advise you on this. Personal injury lawyers are likely unwilling to take the case because it would be very hard to prove that your mother's injuries were caused by the repo man.

I assume you're talking about the letters that explain what they did with your vehicle. They're required to send them to your last known address, so they may have sent them to an old address. But if they don't send them, they're potentially liable for statutory damages.

Read your loan contract. Usually only 2nd hand cars sold by unauthorized new car sales dealerships or roadside stands are the only companies who actually install a kill switch so the vehicle doesn’t start if you’re 25 days late & haven’t contacted them. I’ve had 9 new cars loans, 3 boat loans, and other loans from the credit union I’ve been with since coming of legal age & they’ve never sent a repo person, shut off brand new cars, although I did have automatic payments set up on the majority of them. It sounds like it may not have been the credit Union but a contract with the sellers.

Only the secured creditor or its authorized agent is allowed to repossess in Alabama. Police can seize vehicles for other reasons, but those aren't technically repossessions.

As I have no idea why the cops were at your house or what sort of legal problems you were facing, I can't give any assessment as to what may or may not have been legal. In Alabama, a creditor can't repo someone's home. They can foreclose and sue for ejectment.

In Alabama, they usually let the police know ahead of time, but I don't believe they're required to do that if they can repo the car without otherwise breaching the peace.

We mainly call them in after unless we want to call first but it's a waste of dispatch time unless we repo the vehicle. It is required to call in tho with in 2 hours from what I gather here in Indiana

Depends on your state. In Alabama, the statute of limitations for breach of an installment contract is 4 years.

All this can be avoided if you simply pay your vehicle loan or if in default you keep in touch regularly with the lender and don't lie to them. Also remember the bank can call the loan and demand payoff at any time once you default on the loan. No they don't have to give you 30 days. And If you piss them off or act like am idiot or play Google attorney with the repo agent the agent can recommend to the lender to ask for payoff due to a troublesome debtor. So keep playing the you touched me , you breached the peace game and you may win a battle or two but I guarantee you WILL eventually lose the war. Also if you can't pay your car loan how do you expect to hire an attorney? And a few ambulance chaser attorneys will do it pro Bono but only in certain situations. Spend less time trying to avoid the repo man by simply honoring your agreement and if you can't then give it back. When you don't pay your electric bill what happens? It gets shut off but let's get mad at them and try to engage in litigation because they did so. Smh

This is simply false. I have had many clients who fell behind honestly due to circumstances beyond their control: they lost a job, or the car itself broke down and they were unable to get to work and had to spend money fixing the car. These people did get in touch with the bank and explain the situation, and the banks still repo the car. I've even had clients who made an agreement with the bank to catch up the payments, only to have the car repossessed the next day. But I'm glad to know that you have a good job with financial security so that you've never had to experience any of these things.

Say a Buddy paid 30,000 dollars for a car that cost 45,000. He defaulted and the dealer is trying to repo it. He is considering taking the engine block out and keeping it. Any thoughts or recommendations on this legalities? After all he did pay for over half the cost of the car and all the dealer will do is keep his money he paid and resell it.

That depends on your state law. I would never advise disbaling or sabotaging the vehicle, as that could be illegal.

The way he's looking at it is if they take it back they still are going to seek what he owes plus have possession of the vehicle which they will re-sell to someone else while he has nothing to show materially plus a repo on his credit report. He figures at lease the engine block will suffice since after all he did pay for it plus they will trying charge him money and also took what he paid a good percentage on. Any thoughts on the consequences since this isn't the first time I've heard of this being done either; but now I know someone who might go this way?

That depends on what state you live in and where the RV is located. You may be able to repossess it, but just beware that you may have an obligation to safely store the stuff inside the RV. In most states, you can sue for the full balance due on the contract without repossessing first. But to be sure you'll need to talk to a local lawyer.

Rudy, The SoL for an illegal repo claim depends on the facts of your case and what state the repo occurred in. In Alabama, it's usually a 2 year SoL for conversion of personal property, or a 4 year SoL for breach of a sale contract.

What do you do when it is painfully obvious there was a breach of the peace ( They are caught on Security Camera in the act) and it was late at night with both myself and the manager were fast asleep in our beds, neither of us had a clue as to what was happening and they had to hack a PIN code on a secured gate of the parking where the gate was obviously closed as it clearly shows in the video, and neither the driver or the assistant were or are legal residence of building and they took my personal property and my wife with the car. Alabama, like most states, has enacted the Uniform Commercial Code, which requires that any assignment by the original creditor be provided to the debtor upon request. Also, the assignee cannot demand payments until they have notified the debtor in writing. The property is not paid in full unless and until you actually pay the amount due under the contract.

In most states, they aren't allowed to keep your belongings or charge you a fee to get them back. They should return your belongings to you promptly when you request them within a reasonable amount of time.

My car was reposessed and I called to make an appointment to get my belongings. The guy on the phone said he would need my keys. So I said "I can't get my stuff back unless I give you the keys?" And he said "that is correct." Now this is before the auction. The loan agreement is also in the glovebox wich I need to review because they say I defaulted and that the loan started in August of last year, but when we got it, the dealership said our first payment wasn't until November. There is also medication in the car. Can I take legal action for being told I can't get it without giving them the keys?

@@dudemorris7769 oh no, I made the payments every month. When I got the suv in August 2021, the dealership told me the first payment was due in November 2021. Then In August of 2022, they sent a notice saying I was 3 months behind. A few days later I woke up and it was gone. Where I live by law, if they don't send prior notice of reposession, they must notify law enforcement within 2 hours. I called and they never did, so I thought it was stolen. The notice after didn't arrive within 3 days and by law it has to. When I called my lawyer, he told me to call the repo yard in the meantime to get our things. That's when they said they couldn't give me my wife's medication, loan agreement, or any belongings unless I gave them the keys. Wich I knew was extortion, so I called my lawyer back and told him and he said that's illegal. He asked the name of who I spoke with, and said he'd call me back. He ended up getting it back and returned the next day at no cost to us, the 3 payments removed, and they paid his lawyer fees. 👍

Actually, I do work pro bono sometimes. I suggest you stay in touch with your own lawyer to make sure that you're doing everything by the book. And as I've said before, not all repo companies are breaking the law. But it definitely does happen quite frequently. If repo companies never screwed up, I wouldn't be in business!

I have a repo out on my truck, and I also have a contract with the bank that they are in default of, which ofcourse means that the repo is an illegal action. Would you "in this specific case" still attempt to repo the truck if I let you know that the bank is fraudulent in their action? Because what will happen is I will have to file a motion to prove their standing, then I'll also have to fine the repo company, and I will then have to put a lien on the company for damages until the company pays me by charging the bank to pay them. And I will end up going after the Repos insurance company for that bill, raising the premium substantially. Are Repo companies ever worried about that? Because I'm sure it will cause a rift between the Bank and the Repo co.s

@@808estate2 Honestly, if I got the power of attorney for it, I'd still go after it, and I would retain ownership until you or the lienholder provided proof of ownership and payment for the tow and storage, or we'd put a lien on it. Photos are always taken beforehand, so you'd have to prove we caused any damages. As far as our insurance, no, not worried at all cause we deal with cases like this all the time, and it's up to the debtor to prove everything.

Vince, the law on what exactly constitutes a "breach of the peace" depends somewhat on the law of the state where the repossession occurred. In Alabama, forcibly keeping you inside the vehicle during the repo would DEFINITELY be a breach of the peace. Same if they physically removed you from the vehicle. You need to call a local lawyer who knows repossessions.

@@robbyj105 Two repo dudes once tried to take my Uncles car. He lives 20 miles in the middle of nowhere and 10 miles down a dirt road. The guys hooked his car up, he locked his gate and called the sheriff. A deputy arrived and my uncle unlocked the gate. After taking back and forth the deputy told the repo men to drop the car and leave the property or they will both be arrested and charged with trespassing. Every property along the road my uncle lives on is marked as private property/ no trespassing and fenced off. There are at least 6-7 no trespassing signs coming up to my uncles property alone. He had it clearly marked and yet these guys decided to go at it anyways. The deputy was ready at the time and even got his handcuffs out. It did not matter or not if the car was up for repo. What mattered is these guys disobeyed and trespassed. Long story short my uncle paid his car off in full the following week.

I'm not a trust lawyer, and since I have no idea what state you live in, I can't give you legal advice. However, in Alabama, the answer would depend on who owes the debt and whether or not there's a valid security interest in the vehicle.
