Good lecture.. Just two points... 1) Equity and Equality are not same... "Equity" is when you treat those placed similarly equally, and those placed differently in a different way so that they can have a level playing field... "Equality" is when you treat everyone at par without any regard to their social/economic/other differences, thereby depriving them of a level playing field.. hence even though the term used in the Constitution is "Equality", the whole scheme shows that it's actually based on "Equity"... 2) Bentham ke jurisprudence ke hisaab se reservation ka law bilkul ban sakta hai... Not trying to be political or anything, but just saying coz the point was brought up... caste census na hone ka ek bauhot bada reason ye hai ki jaisa hum internationally dekhtein hain ki 90% resources mehez 3% population ke haath me hain, waise hi nationally bhi socially aur economically prosperous bauhot kam log hote hain jo maximum resources command karte hain... This economic and social benefit is directly linked to caste which has trickled down through generations (ancient history throws light on the genesis).. Numbers will make it more evident which a certain part of the "majority" doesn't want.... Certain historical and political factors have enabled a small group of people to benefit at the cost of all.. Alag alag minorities ko add karenge, to the total number will be huge and more than those select prosperous people who've had historical benefit which has given them better lineage, genes, contacts, etc... So reservation is not actually serving less, but more people and representation "majority" ka bhi kam nahin ho raha... Minorities alag alag leke chalenge (coz sabke peechhe discrimination alag type ka raha hai) to individually wo kam lagenge... Moreover women are almost half the population.. Even Children ke benefit me legislation se kisi ko bura nahi lagta... So again it's not like Bentham ke Jurisprudence ke according ye laws nahin ho sakte... Specially laws for benefit of children are for everyone's benefit...
