Actor Jussie Smollett, 39, is scheduled to be sentenced for faking a hate crime attack. Court is scheduled to begin at 1 p.m. CT / 2 p.m. ET in Chicago, Illinois.
Jurors convicted him in December of five out of six counts of disorderly conduct. He faces three years in prison for each of the five counts.
Smollett, who is Black and gay, recruited brothers Abel Osundairo and Ola Osundairo of staging the fake racist, homophobic hate crime where he was the apparent victim, prosecutors said. He claimed his attackers yelled, “This is MAGA country,” and put a makeshift noose on him and poured bleach on him. Authorities said that he made it all up as a publicity stunt because he was unhappy with his pay on the show “Empire.”
Special Prosecutor Dan Webb articulated Smollett’s orders to the brothers like this for jurors, saying, “I want you to attack me, but when you hit me, I want you to kind of pull your punches a bit because I don’t want to get seriously hurt.”
Surveillance footage showed Smollett’s car circling the intersection of the faked attack to show the brothers where he wanted it to happen, Webb said.
Smollett denied in testimony that he made it all up.
Defense lawyer Nenya Uche argued that no physical or forensic evidence linked the actor to the alleged hoax. He asserted the brothers made up the hoax story for their own benefit. It was out of character for Smollett to stage the assault, putting himself in that position, Uche said.
“Jussie was not a person who liked attention,” he said. “Even his publicist was frustrated at him for that. It’s fantasy.”
Aaron Keller and Colin Kalmbacher contributed to this report.

The judge should have given him at least a year in jail. Then he acted like a total jerk when they took him out. That shows what kind of person he really is. His sentence was way to light.

His biggest problem is that he’s not showing any remorse. Judges don’t like that, for good reason. It shows he needs to do time.

The first lawyer is awfully argumentative. "This was a non violent crime, and he forfeited his 10k bail bond side for the ATTACK." "It is undisputed that this means the thing I say it does. Sure, the court decides, but I'm telling the court what it means, and I'm 100% completely telling you what you should decide."

I was waiting for Oprah and the Obamas to show up and tell the judge all about Saint Jussie and all his good works. I did enjoy the judge telling Jussie that his name is now a joke, bet that hurt his narcissistic feelings. He did it to himself, and still has the gall to proclaim his innocence as he left the court. 150 days prison time... not bad, but a year in jail would have been better. He was sentenced to 30 months probation, so if messes up after he's served the 150 days, he could be sent to jail for 30 months. Fingers crossed he violates probation!

5:50 His lawyer said "The judge can only appoint a special prosecutor in three DISCREET situations." How did she finish law school when she doesn't even speak basic English? DISTINCT. DISTINCT situations. Discreet means secret, private, or "on the down low." The judge can only assign a special prosecutor in three secret situations, lol. How do you know them, then? Lolololol. Edit: Discrete means separate as well, but I did not include that. Thank you for catching it. I stand corrected.

@@HYPNOTOAD291 You are probably right, but it's a useless word in that form. "3 separate reasons" vs "3 reasons" vs "3 specific reasons" Specific at least adds something to the phrase, since they are technical. Discrete does not, since, well... there are 3 of them. Like, I can't imagine a scenario where someone hears "3 reasons" and thinks "Oh, I wonder if they are the same and not separate."
