From what I am seeing, the press conference was meant to appeal to emotions and to represent herself as the victim of a hateful workplace. Apparently there's a lot of dislike and distrust for 'the bosses' among the workers, and they're very likely to side with her out of sympathy for having been 'oppressed at work by the corporate masters' themselves. I gather that a lot of people in white-collar Korean jobs really hate their work, but take the jobs for financial stability, so they're open to the idea that HYBE was 'mercilessly bullying the poor CEO lady'. And the fact that she presented quite like a K-drama is swaying emotions to her as well. But that isn't going to fly in the courtroom. We Westerners, on the other hand, have certain standards for this sort of formal situation. So we perceive her performance *as* a performance, and what we see is a messy, sloppy, immature, unprofessional woman fake-crying, swearing and rambling for a couple of hours in a press-recorded pity party. Besides that, after all these years of political conflict, we very readily recognize when lying, projecting, gaslighting and distraction are going down. We brush off the efforts at emotional manipulation and go straight for the facts; and the facts are on HYBE's side.

Finally someone talks about the put option position she has. It's crazy big and yet most people only talk about the copy concept drama. Essentially, she shorted HYPE stock, at a highly leveraged position. If stock goes down 10%, she can gain 100x the original amount. She's an insider working at the company and planned moves to cause the stock to drop, that's basically insider trading. Worse is she intentionally tanks it. Sounds like US Congress lol

It can never go that bad, because Every product of a corporation is owned by the company. Not the CEO or directors or workers. So the final ownership lies in the one with controlling shares. That would be HYBE. Worst case scenario is if members of New Jeans quit due to emotions and/or personal loyalty. Then everybody loses. New Jeans has most to lose.

When I heard about how she was handling her shares in the company.... red flags popped up everywhere as in 'insider trading' which in the US is taboo and can get you in serious trouble. I don't know the particular laws in Korea but I surmise that some of their laws were modeled after some in the US. Particularly when it comes to corporations and companies that run on a western model. As such perhaps the alleged insider trading will hold the same consequences as it does here in America... The Korean government recently (last year) strengthened their penalties for insider trading. (I looked into it during the Lee Sooman/Kakao thing.) Depending on the crime, the penalty can be up to but not exceeding ten years of prison, or a fine of up to but not exceeding 500M won. So, yes, they take this pretty seriously; seems there's no lack of it.

She exposed herself publically so Hybe's attorneys know what her defense is. Notice how Hybe has been pretty quiet. That means her attorneys have no idea what they are bringing to the table and do not know what to be prepared for. It's to bad the parents/girls have bought into her crap. you can't steal a 90's American hip hop style that new jeans use. all female k pop groups look similar and sound similar. the male k pop groups depending which company they are coming from have similar sounds too. most things are no longer unique. if you put your own spin on things that is what makes it unique. but new jeans concept is not unique at all. i mean both groups look alike. since i don't listen to k pop i would've thought it was the same group i sincerely don't care about this drama. but that women's shady practices do not fall in line with Bang PD's vision for his company. also, all this negativity better not affect BTS either.

Thanks for bringing up that HYBE was stupid generous with giving MHJ 20%. I think he had bad judgement in putting so much trust in her and I do believe he was motivated by some sort of feelings towards her. Not denying that she is good at marketing and selecting concepts and how she presented New Jeans to the world. But she has overstepped every sort of professional line in her inappropriate relationship with the members and their parents. I think she does care about the members but she is going about this in such wrong ways and being very egotistical about it all. She plays dumb when she needs to for empathy and then becomes smart and strong when she wants. For HYBE to come this far and sharing with the news so many details, they must have a lot of concrete evidence to dismiss her or even incriminate her. They wouldn’t do this if they could’ve just kept it hush in the company walls because why would they shoot themselves in the foot and lose so much money.

Did you think that Bang didn't want something like TVXQ back then happened again in his own company? Because we all know the story about JYJ leave the company and the group because of some offers with fast money. And it's all started with one of the member parent and then try to convince another members to join them and use the lacks in slave contract (as people who is get to know kpop with their businesses, old gen was like didn't know and understand about the whole contract and the parents just overwhelmed with the offers). Idols nowadays is much better to understand the contract. One of them is about that "slave contract" which old gen taught that all of the stuff is free. Also the consequences if they try to leave the company while the group still under the contract. Bang itself is an experienced producer so he knew a lot of major things while the lady looks like know some unseen minor things to shoot Hybe. At the end, it's about money after all. I wish there's no stupidity again happen, especially with popular names like them. The girls need to thinking about this wisely for sure. Hybe itself right now maybe ten times much bigger than SM in 2010. And obviously the government implicitly right behind them. Yeah, government. Korean government already makes a lot of deal through BTS popularity and capitalism in Korea is so real.

In some point Hybe has a bit more advantages so NJ really need to make a decision wisely because we all know that this kind of war affecting NJ's future. The idols always becomes the victim while the higher people busy making money over the idol's name and popularity, just like what happened between TVXQ and JYJ. The idols deep down to the never ending internal conflicts while SM, CJES, AVEX, etc still making money over the drama. Scheduling is a non issue if you are different products eg in this case groups who are not going for the same segment of the market in this case fans who like certain sounds in music, aimed at different age groups, eg different demograhic's so sometime's having 2 things entering the market place is a 2pronged attack works well. Regarding the IP issue, it may not be an non-issue even though Ador is a subsidiary of Hybe. The actual IP rights can be more complicated than what it seems to be as it depends on how the overall structure of the organisation and shareholding, as well as how the employment contract is worded.

Not all IP are the same. And the protection given by the law is vastly different. I have written many patents and had to protect different IPs personally. It included scientific, engineering, design, branding, etc. I have a full grasp on the subject. Things like concepts and style are literally almost impossible to protect because components are not fully original. It is a mix of things that exist or have existed. I can find similar style of every aspect of NJ product. From 80's 90's music style to components from other girls groups like wearing high school uniform theme. Am I saying they stole these ideas? No Am I saying concepts and such are worthless? No. Choosing different outfits and jewelry to create a great style is very difficult. However, it would be pretty much impossible to protect. I left this part out to simply the analysis. Because, what she was planning and doing was so bad in legal value that it was a non factor. What she was planning was worst possible thing that a person can do in a corporate world. This would be treason for a citizen and murder among people. This particular IP problem would be less than a parking ticket.

@@komerican-og agree with you that IP laws itself can be complex, especially without knowing much about the Korean legal position on it. I do have experience with scientific research IP and product creation IP with the latter being more notoriously finicky in terms of how courts view infringement and damages but you do have a good point that with this case, it will be harder to prove and ultimately, even if for some reason the court rule that there is infringement, the resulting awarded damages could be little or minimal; although i wont confidently say that it be less than a parking ticket but definitely not close to what MJ would have want and stand to lose overall. Which really make me wonder what goes through her mind in this whole fiasco.

Hi there! There has been news that has just come out that MHJ tried to request from Hybe that the contracts of New Jeans be amended so that it can be terminated at any time. This was allegedly done by MHJ last February this year. And of course, Hybe denied her request. There has also been news that MJH tried to sell back to Hybe her 18% shares for 30 times more than it was worth ($200M). At first, she was not allowed to sell 5% because of a clause in her contract. She requested to be able to sell even that 5%, and they agreed. I THINK (not sure) that they agreed on a price of $75M (17% more than it's worth). But when she requested to sell it for 200M, they said that was excessive and denied her request. This is supposedly the beginning of their relationship going sour. This was supposedly done around new year, or early this year. These 2 bits of information put together can look like her plan to leave Ador an "empty shell" being executed, with her now having 200M to be able to buy Ador back from Hybe after ruining it, don't you think? On the news, I've heard it said that, based on the evidence that has so far been made public, Hybe does not have sufficient grounds to claim Breach Of Trust. Do you agree? What does constitute a Breach of Trust? What kind of evidence would Hybe need to successfully claim this in a court of law? I heard that there is supposed to be an extraordinary meeting of the board next Tuesday, supposedly with the intention to fire MHJ. What grounds would be sufficient to carry out this action, and what do you think would be a board member's stance, IF the board member would be someone looking at this from an unbiased point of view? I really look forward to hearing your thoughts on this! 🙏

4th vid was my last. This left bad taste in my mouth so let me just answer your questions. 1) The request was just so darn ridiculous that she must have known, no one would say OK. 2)She was showing how far she would go so that they might sell the shares. 3) No matter how much she got, she does not have ability to buy Ador. If HYBE don't wanna sell their controlling percentage, that is it. Let say you don't wanna sell your parent's old home. Nobody can make you. Therefore, either she was willing to do illegal acts or was willing to ditch NJ for as much money as she could get. Gotta be one of them. Oh..she could be really stupid or crazy, that also is a possibility. 4) Dereliction of Duty or insider trading falls under Criminal Law. So this has different rules than Civil Law. Hybe's legal machine has been after her from the start on both counts. And you never open up all the evidence before the criminal hearings. Right? So saying the evidence at present time is not enough...is a moot point. However, the text message alone is pretty darn damning. Dereliction of Duty and Insider trading is on top of the worst list on Corporate law. That would be Murder among people and Treason for a citizen. Just planning it is a grave offense. I believe they should have more evidence and are willing to go all the way. For two reasons. One, so that you can send her to jail. This usually quiets everyone since it proves that she is a criminal. Second, whatever that sticks can be used as an Ace in dealing with MHJ. Nobody wanna go to jail. Hybe is a corporation and its goal is to make money. They will leverage prosecution for what is best for the company. 5) Proving intent and proving actual act is different. I believe intent part should be pretty easy but actual part, I am not sure of. Hybe needs to show that she has started the ball rolling. However, planning alone carries pretty stiff repercussions. Just think of conspiring and planning a murder. We were joking is not gonna cut it. Not in text form with a VP who also should NEVER EVER do such things. 6) Hybe do not need anything to get rid of her. She can cry and do all the things possible to maximize compensation. That is it. Just think of a person getting fired. He can even sue the company for firing him without a reason. That is the extent of it in reality. But look at her, she allegedly diverged sensitive company info, did not respond to audit... disregarding her duty (just responding immediately is a legal duty in itself), asked for ridiculous stuff (like freeing NJ) and crazy compensation. Now, would anyone have a problem firing her? Would there be a Judge who would fault the owner in firing an employee for these reasons? Hell no. At least not in a sane world.
