One of the K1 Visa Interview requirements is an Affidavit of Support or Form I-134 from the petitioner or US Citizen, in this video, we are going to take a look at the K1 Fiance Visa Income Requirements and How much money does the petitioner has to make in a year to sponsor his foreign fiancee to the USA. According to US Department of Health and Human Services, you have to meet at least 100% of the latest Federal Poverty Guidelines so you can sponsor your foreign fiancee to move in the USA. These income requirements are set by the US government to make sure that your foreign beneficiary does not become a public charge upon admission to the United States. If the minimum requirements are not met, the US Citizen has the option to use a joint sponsor.

my recent tax transcript was over 38k. should i include my mom who is currently living with me on the count of household size? for 3 it says 25,820 on 100% hhs. is it safe to say i wont have any issues with the aff of support? im currently on medical leave due to back pain. i asked my employer to state that im on medical leave for atleast 3 to 6mos on my certificate of employment. will i have a problem despite having above minimum hhs requirement if they dont see salary on my paystubs?

Another question is, is a former filipino, who's married before in the philippines but already divorced here in the US, the former filipino is already naturalized when the divorced was granted. I'm confused between the difference between the 100% and 125% of HHS poverty guidelines. If someone is not an active military, shouldn't the focus on the 125% side of the chart?

Hello, this HHS Guidelines are used by all the Intending Immigrants, and Immigrants of United States seeking to adjust status from Permanent Residency to Citizenship and they have to meet 125%. However, K1 Visa Sponsors used the same guidelines but they only have to meet at least 100% to be considered just like the requirements for active military personnel. I'm not really sure why K1 Visa Sponsors are favored (not sure if that's the right term) but this has been going on for a while.

Hi Ms. Jolly, what if yung petitioner(fiancee) ko is nakatira sa parents house niya 3 lang sila, Mom & Dad & Siya and doon na din sana kami if maapprove yung k1 visa ko, Yung Mom niya and Siya lang ang may work sa kanila pero yung dad niya is retired na with Pension. Hello Alexis, the health insurance is not mandatory but it would be ideal to get one as soon as your fiancee is getting ready for the application of greencard after marriage. If your focus for now is her entry to the States, not having an insurance won't be a problem.

Hello, ideally, USCIS is looking for employment type of income because it is considered as stable income. Showing the savings and assets are still helpful but won't guarantee an approval to USCIS. It really depends on the Consul, some are lenient and some are totally strict with the guidelines.

Hello Kenia, as far as I know, Consular Officers focus on your present income so your situation won't be a problem. However, Consular Officers may ask your previous W2'S and transcripts to come up with final decision. At the end of the day, it is completely up to the Officer's judgment whether or not your income is enough to support your benefeciary and not become a public charge.

Correct. I134 is only needed during her interview at US Embassy. It doesn't go with initial filing (i129f).

Hello, the use of joint sponsor is not a bad thing as long as your sponsor can meet the total income requirements of the combined household size. I would highly recommend for you to get a job first or wait until you have a steady income before applying for the petition so you can at least build more credibility as a petitioner. USCIS wants to make sure that you are capable of sponsoring your fiance (Public Charge Rule) through looking at your income and assets.

Another thing.. I went to go visit him about a million times on a bus most of the time but I no longer have the bus tickets for proof. And me and 1 of my daughters have a passport card, not a book so it dosen't show the stamps of our travel but I assure you it was awhole lot of times :) what can I do in this case?
