I live in MD and I have a DUI when you refuse a breatherlizer (as I did) Later you have the option to have a suspended license for 12 months or a breatherlizer in your car for 12 months I chose the breathalizer because I had to get to work. The worst 12 months of my life!!

Miranda Rights are only applicable if you are under "arrest". The officer told Karen she was being "detained" not "arrested". There is a difference. Detainment does not warrant Miranda Rights. The police can ask questions such as "where were you going?", "where are you coming from?". Neither of these questions are incriminating. The person being detained has to consent to a breath and blood test. If they do not their driver's license is immediately suspended for 1 to 2 years depending on your state and the number of your other DUI offenses permanently revoked.
