Those Monuments he created will all be consolidated with the existing ones and lock the minerals, oil, clean water, and gas that are in them, away from America's use, but he will sell them to foreign countries. Is doing it now. Imagine Yellowstone, Rushmore, Alaska, and more, locked up from the American people. Over the size of the state of Maine. I'm not a lawyer and I know most of the answers to Sen Kennedy's questions better than most of Biden's nominees. I long for the days of learned, principled men like Judge Bork who could speak extemporaneously for hours about the constitution and law, cite precedent and teach those around them just by listening to their conversations.

In reality judges cannot know every single law of the land and the cases associated with those laws. What i dont know is how much a judge SHOULD know! Should this judge have know about the Dormant Commerce Clause?

I have watched quite a few of these interview's of ol' joe's court nominees. The majority cannot answer many of the most basic constitutional legal questions. They all appear to have been nominated for DEI reasons not for their qualifications.

Kennedy asks the right questions. State law applies until it can be legally challenged as unconstitutional. The challenge can overturn the law at the appeals, circuit or SCOTUS. the candidate should have known this without hesitation.

@@Drowko This was yet another candidate unqualified for the job. She couldn’t answer questions about the commerce clause that should have been a memory item to include case law. Then her failure to answer law precedence from state to federal makes her clearly unqualified for the position. That a layman like myself can better answer the Senator’s questions says everything about the nominee and how unqualified she is.

Speaking as a brown person here. This judge is an example of why competent people of color oppose things like quotas, diversity initiatives and the rampant activism around these. They make us all look bad. I'd rather be judged based on my capabilities and hard work with absolutely NO doubt left as to how I may have achieved whatever level of professional growth I do achieve in life.

These are not tough questions, except possibly for the Pruneyard one. The ignorance on the dormant commerce clause is totally shocking. And the discussion of the commerce clause is at the level of a beginning 1L, not someone who will be on a court of appeal.

1:03 to 1:37 Really? That's the best that they could do? Ana de Alba says that race "is something they don't necessarily control," really??? WTF. Does this foreshadow a future in which we are going to let people declare not just gender, but race??? And with even less interest in sharing any thoughts, the second lady, Irma Carrillo Ramirez, simply punted and said "The Constitution provides for equal justice for all." Ramirez' response sounded like something from a third-grader struggling in front of the class, to give a report on a book that she hadn't read! I must say, though, that given how low the bar has seemingly been set by the Biden administration lately, it was refreshing that at least these two dolts didn't stall each response with the usual "Thank you, senator, for that question." So at least there's that. But also, at *most* there's that. My sofa doesn't actually have seat belts on it, but I felt the need to reach over and fasten a seat belt anyway, as I was sure that Ramirez was going to plagiarize Martin Luther King, and blurt out something to include, "content of their character!" Again, I was pleasantly surprised. 2:09 Kennedy told de Alba, "It was a big Supreme Court case; it just came out of *your state."* Ouch! She might as well have said that after her dog ate her homework, he also knocked her TV over, breaking it, so that she has been in a news blackout, and didn't hear anything about a case in which California's Prop 12, passed by state voters in 2018, sought to regulate, by restricting pork imports, how pork producers in others states raise their pigs. Prop 12 was an attempt to force out-of-state pork producers to provide larger cages for their pigs to be able to move around more. Prop 12 was an anti-cruelty bill to let animals be able to move around a little. The Supreme Court issued a decision upholding Prop 12, thereby supporting a state's ability to regulate what is imported and sold within its borders. The Commerce Clause has the purpose of restricting states from unnecessarily hindering interstate commerce; the feds are the ones who are supposed to be in charge of that. Quoting from the Saint Louis University School of Law: The Commerce Clause gives the U.S. Congress power to “regulate Commerce . . . among the several States.” This affirmative grant of power implies a negative converse known as the dormant Commerce Clause, which prohibits the States from passing legislation that improperly burdens or discriminates against interstate commerce. Link: www.slu.edu/law/law-journal/issues/v62/no1/keegan-shea.php In other words, by saying that the feds control interstate commerce, the states can't enact laws which restrict interstate commerce without showing a damn good reason, with no other, less-burdensome alternative. As for Kennedy's question about Pruneyard (a case about a shopping mall owner trying to prevent protesters from protesting on his private property in public areas), I'd be interested in knowing what his thoughts are, about reconciling the fed's supremacy with California's constitution conflicting with federal law. Anyone out there have some legal knowledge to share?

As noted in numerous Ivy league and Tier 1 law schools syllabus; "Constitutional Law is a foundational course in the first-year curriculum. Second- and third-year students can choose courses in specific areas ...". response is similar to a grade school book report never read. How does justice any hope of finding its way to court supplicants seeking due process?

The Dormant Commerce Clause is a legal doctrine that courts in the United States have inferred from the Commerce Clause in Article I of the US Constitution. The primary focus of the doctrine is barring state protectionism. The Dormant Commerce Clause is used to prohibit state legislation that discriminates against, or unduly burdens, interstate or international commerce. Courts first determine whether a state regulation discriminates on its face against interstate commerce or whether it has the purpose or effect of discriminating against interstate commerce. If the statute is discriminatory, the state has the burden to justify both the local benefits flowing from the statute and to show the state has no other means of advancing the legitimate local purpose. For example, it is lawful for Michigan to require food labels that specifically identify certain animal parts, if they are present in the product, because the state law applies to food produced in Michigan as well as food imported from other states and foreign countries; the state law would violate the Commerce Clause if it applied only to imported food or if it was otherwise found to favor domestic over imported products. Likewise, California law requires milk sold to contain a certain percentage of milk solids that federal law does not require, which is allowed under the Dormant Commerce Clause doctrine because California's stricter requirements apply equally to California-produced milk and imported milk and so does not discriminate against or inappropriately burden interstate commerce.

It's a softer shove away than hitting or pushing is, and pushing is softer than hitting, which is softer than hitting with a baton. When you live under the lottery for life, you get angry to find the things your grandparents caused to be winning at the s&p stealing from you and slowly inching toward the lowest proved care on earth, in California while sex is being sold with marijuana, in the air you had to live thru as a 10 year old when nobody up high planned your escape into a reasonable job circuit from that AREA. And like physical fusing, the self defense the notes saying that this IS YOUR RULES FOR US- AS YOUR TEAM-whike you are in our private home, where we didn't get you as a guest yet... I can't believe we have to rehash this old mommy lesson- yes the name calling hurt your feelings. Walk away, don't dwell on it. When they don't feel a better at their future and family's 1 modest Lot, they'll quit spewing. Kids do it and we are all the same species - working and EMPLOYING these spoken or verbalized or sang degrees of force meant to attract and repulse the listener. Should the name caller have physically hit or thrown something instead? No. If I hear someone call me a bad nabe, I know to go away for awhile at least, then gently tap in to see if they're feeling any happier before I barge in and start loud talking to them as injured or wounded persons with real ERR space as VOLUME needs. Who yelled at the newborns? Think for yourself, please.
