The difference between hearings 2 to 3 years ago and today is so profound that it is hard to bear. At that time there was a relaxed atmosphere and questions wer answered clearly, openly and without any hesitation. Today, the questionnaires can't get any answers at all, not even on the most simple questions. The respondents are evasive, off-topic, they waste time and do anything to avoid an answer. No matter what question. For example "is racism wrong?" or "should crime be prosecuted?" One would think that everyone should be able to answer that, right? Well, obviously not, because the respondents couldn't answer it. It's outrageous.

I agree with Durbin's answer, but I also agree the Sen Kennedy's point. There is also an issue of immunity. Let's say one shoplifter shoots another shoplifter. The prosecutor is likely to negotiate with one of them and grant immunity so that he/she will testify against the other one. This is a matter of discretion, and prosecutors are empowered to make those choices

The biggest problem with our criminal justice system is rather than applying current laws that are already on the books…. legislators attempt to create new laws that are already covered in the these previous laws that are already passed. Not to mention we allow way to many cases to be prosecuted at the state level that should be prosecuted at a federal level.
