Hello Everybody, In this video, we will understand about the concept of Kidnapping and Abduction which is given under section 359, 360, 361, 362 & more under Indian Penal Code, 1860.
Section 359 -
Kidnapping.-Kidnapping is of two kinds: kidnapping from 1[India], and kidnapping from lawful guardianship.
Section 360 -
Kidnapping from India.-Whoever conveys any person beyond the limits of 1[India] without the consent of that person, or of some person legally authorized to consent on behalf of that person, is said to kidnap that person from India.
Section 361 -
Kidnapping from lawful guardianship.-Whoever takes or entices any minor under sixteen years of age if a male, or under eighteen years of age if a female, or any person of unsound mind, out of the keeping of the lawful guardian of such minor or person of unsound mind, without the consent of such guardian, is said to kidnap such minor or person from lawful guardianship.
Explanation.-The words “lawful guardian” in this section include any person lawfully entrusted with the care or custody of such minor or other person.
Section 362 -
Abduction.-Whoever by force compels, or by any deceitful means induces, any person to go from any place, is said to abduct that person.

@@gichikkaku5398 kidnapping is of two types 1. If u take someone from India - it could be a major or minor, indian or foreigner without their consent or guardian's consent 2. If u take a below 16 yrs old boy or below 18yrs old girl or mentally unstable person out of the lawful guardian's purview. Here taking means taking by inducement, no force required. And abduction means using force on a person (major or minor) to relocate them. This is done by using force or fear.
