Kim Kardashian SUED by Donald Judd Foundation

After highlighting her "Donald Judd" dining tables and chairs on her KZbin channel (they weren't by Judd by the way) the Donald Judd Foundation sues Kim and demands she destroys them!

While it was most likely an oversight on the part of Kim kardashian and or her team to not credit the tables correctly, there is enough of a history with this family to not give credit to artists and creatives, to expect them to donate their work to bolster the kardashian brand in such a tone deaf way, or to outright steal designs people are fed up with how the Kardashians operate. At this point, association with this family is detrimental to any organization that wants to build positive noteriety. Any company that is trying to be perceived as offering classy quality product does not want proximity to this tacky tasteless family.

I think they don’t want to be associated with her. Not everyone is just looking for a quick buck at any cost. Integrity seems to have gone out the window with consideration of others before yourself.

Christopher - I agree with you that we should always stand by the artist(s) and their estates and their right to protect their work. I also agree with you that once Kardashian stated that she would redo the video to clarify the comments about the furniture that this should have been enough. I also think that any cease and desist or law suits should be aimed at the designers who created these pieces "in the style of" Judd's work. As an aside, if I ever with the Lottery I am definitely getting a full set of the Judd table service!

Kim is the one that stated that this was a Donald Judd table. She could have said "in the style of Donald Judd ". She should be held liable.

Maybe you’re forgetting to consider that the Judd foundation doesn’t want or need all three points you’ve raised? I’m assuming that majority of art people or institutions (unlike fashion brands) especially outside of the USA are not very keen on having Kardashian fans as their fans too?

They obviously can partner with whoever they want - but I think this is a much better alternative than selling work from the Foundation’s collection- which they have also been doing.

Years ago. when I was in the design industry it was extremely common practise to do knock offs (not identical but similar) because there was no way the budget would ever allow the price of the original. Looks like that is what Kim did. As the original designer, I can see them not being happy about this.

Oh! I totally forgot to ask - (and if this is not the place to ask this just let me know) with regards to the Warhol Foundation v Goldsmith ruling, what are your thoughts on the fact that no one (as far as I know) in the Supreme Court have backgrounds in art? Do you think that they should have been ruling on this case at all? And .... do you think that they should have brought in someone from art law to give thoughts and comments?

First - I don’t think you can expect the Supreme Court to be experts on everything. That’s not their job. That’s up to the attorneys. And I’ve listened to interviews with the Warhol Foundation attorneys who certainly do have art backgrounds - they just weren’t able to convince the panel on this one.

Definitely a grey area. Every time I've been interviewed, the final publication includes some technical errors. So any party could have been at fault. I agree with you, that both sides could have made different decisions for a better outcome. The jokes goes: Everything I know about the Kardashians I've learned against my will.

From the reporting I’ve read - Kim’s invoice from the design firm said “in the style of Donald Judd”.
