Hello po. Regarding Article 1205 on the rules when the choice has been given to the creditor and there is loss through the fault of the debtor before creditor has made the choice - the explanation in this video (from time stamp 30:45) is not in keeping with Hector De Leon's book and from the way the law is written: "if the loss of one of the things occurs through the fault of the debtor, the creditor may claim any of those subsisting, or the price of that which, through the fault of the former, has disappeared, with a right to damages" So sa example sa video kahit ang piliin pa ng creditor ay yung specific laptop o yung specific tablet - either of the remaining - the creditor is entitled to damages. Yan po yung sinasabi sa libro ni De Leon and I think mas tamang expalanation yon ng batas. The right of the creditor has been diminished or taken away through the debtor's fault and in accordance with law, he has the right to claim for damages.

Re: Alternative Obligations (Creditor’s Choice) Kapag po nakapili na ng item si creditor among the choices (thus simple obligation), tapos nawala po yung certain item (1) due to debtor’s fault or (2) due to fortuitous event, pwede pa po pumili ulit si creditor among the remaining choices or kailangan na po ng panibagong obligation?

Kapag po nakapili na si creditor among the choices, at nawala because of debtor's fault, nasa kamay po ni creditor yung magiging action, either pipili na lang ulit siya sa remaining choices o kaya kapag gusto niya (creditor) talaga yung napili niya, ang magagawa lang ni debtor ay ibigay ang same "value" of the lost item plus the damages. Kapag naman po fortuitous event, di po kasalanan ni debtor kaya si creditor mamili na lang sa alternative, at kapag naging isa na lang yung choice ng creditor it becomes simple obligation po. Di ko po sure kung tama, yan po ang pagakakaintindi ko, itama niyo na lang po pag mali

general rule, if the problem didn't state the obli it is presumed as a joint obli. so a b and c (the debtors) should proportionately pay x and y

A, B, and C are solidarily liable to pay the amount of P3Million to BPI Bank, subject to the following terms and conditions: - A shall pay in monthly installment of P3,000.00 starting January 1, 2021 - B shall pay her total obligation on February 1, 2021 - C shall pay his obligation if Leni Robredo becomes president in the next elections. Assume that nobody has paid any outstanding obligation. a. Today (March 20), BPI bank sent a demand for payment. How much may the bank ask for and who may be liable to pay? b. If B becomes insolvent today, what is the effect to the obligation? c. If the bank remits/cancels the debt of B, how much may the bank demand from A today (March 20), assuming no payment was made yet.

This is how I understand it based on the video, hope this will help :) a. The bank can demand for the payment to anyone because A, B, and C are "solidarily" liable to it. As to how much, we have to assume that each of them has P1M to pay. B shall pay her obligation on February 1 (today is March 20), P1M; and A is paying in monthly installment of P3K (Jan-March 1st) [3k x 3 =] P9,000. The bank can demand P1,900,000 today (March 20) b. Nothing, but if A pays for the whole obligation (P3M) and B is insolvent, then C needs to pay A the half of it (P1.5M) c. The whole debt will become P2M if the bank will remits the debt of B. The bank can demand P9,000 from A (even on B and C) because that is what is due today.
