I'm not a legal professional, and I can't provide legal advice as each town and city may have different regulations. However, I can share our personal experience. Our property was trespassed by the city, and initially, we were unaware of our options. It's important to note that you can take action in such situations. Contact the police and report the incident because generally, nobody is allowed on your property without a valid reason, such as imminent danger. As a property owner, you have the right to ask them to leave.
In our case, we learned about these rights after the incident. We reported the trespassing to the police and also addressed the issue by writing a letter to the city manager and the head of code enforcement. Additionally, conducting thorough research is crucial. Obtain public records related to city activities before the trespassing incident, including emails and text messages mentioning your property. This information can be valuable when pursuing legal actions.
It's important to stand your ground, as they may claim they had the right to trespass. However, in most cases, they require your permission or a search warrant, similar to any other law enforcement agency.

After living in three different communities over the last 40 years and never had an experience with code enforcement. Many of my friends and neighbors have and and I found code enforcement is one the most corrupt agencies any city and town have. Most are unqualified and only got the job by political favor. I have always found they are only looking for a payoff. The worst people to deal with are HOA Condo Commandos.

In my opinion it sure seems like there are some people in code who are not educated or think they can getaway with things. Like trespassing. They come in with guns a blazing but they could call and talk to the citizens first, It seems like guilty until proven innocent.

in my opinion very true we now think, 99% positive there are 4 houses involved and when one complains then the others do as well. so the city gets complaints in saves about the same things.

In the state where I live Nebraska if you put up private property no trespassing signs and they come on your property they are automatically trespassing and you can have them arrested it doesn't matter if there a law enforcement or a private person. They must have a warrant signed by a judge to come on your property. Research the trespass laws in your state and see what trespass laws are in place

Yup if anyone from the city comes on our property uninvited we will call the police. Others wonder on our property from kayaking or rafting and need help we assess people before we call the police. we had to warm up a kayaker just the other day, and take him to his car at boom town.

'They must have a warrant signed by a judge', is exactly write, NOT signed by some "clerk" or "officer of the court". An "ACTIVE" JUDGE. I have dealt with lawyer offices over "support pay", every letter from the lawyer was NOT SIGNED by a judge. I wrote a "canned" letter advising said lawyers, and never received another request.

You have rights. unless there is imminent danger they should not be coming on your land without Permission. I would google your city code laws because they might be different. I am not a lawyer and don't know what Tampa Code is. But in my opinion any law enforcement needs to have a warrant or imminent danger to be on your property. I can only tell you what I would do if someone came on my property again, I don't give legal advice but if "karen" or Code is walking around my property I would report trespassing to your police department you can do this online add photos and/or call the police when she or anyone you don't want on your property is on your property. i would also contact your city manager to let them know what is going on.

I had an issue with code enforcement due to a horrible neighbor. They didn't like the fence I put up (the old one was literally falling down, plus due to the hill, it was like a fishbowl as they had a walkway right next to the property line so that they could see into my whole backyard). I got a complaint about a tree near the front of my property. There were three items mentioned, but one was dead vegetation, yet nothing was dead. They complained about the height over the street, but it wasn't in the street. Everything was bogus. I complained and then they changed the three items slightly, but it was still bogus, so I filed a complaint against them. I also talked to the city manager. A supervisor came out and it was a bit funny as the code enforcement idiot was also there. He stood there silently as I talked to the supervisor. I asked where in the code that it listed the required clearance above the sidewalk, she said that there wasn't anything listed. I asked about the dead vegetation, showing her both letters, she said that there wasn't anything. She ended up saying that there wasn't any violation, that they would write that up and send it to me for my records and left. Never heard anything more. It would have been interesting to hear what she said to the guy. Yes, it is always best to push back and make them back their position, if they can, otherwise it documents their abuse.

Good for you! you can try to pull the records but In my Opinion they do not seem to follow up unless they get riled up about an issue, and my neighbors know exactly what to say to get the city all up in arms. 99% are lies and execrations. People seem to use the city to bully neighbors and create stress . This seems to be how this new world works. but again that is my opinion. I am sol glad you stood up for your self!!!

where i live they will crawl over your privacy fence and search for cars with expired tags and tear down your fence and tow it away till you pay the tow truck and pay them for destroying your property as well .the code enforcement officer and chief of police both said the rights of the constitution dont apply here .

Boliver, what you're describing has been going on since the early 90s. It's the BLM and affiliates that have been empowered by the UN, totally against the 1948 Universal Declaration of Human Rights. The US has been a corporation since Woodrow Wilson signed the Federal Reserve Act in 1913, and all people are treated as chattel. Meaning you are nothing more than livestock on land that no individual owns because you're only considered as a Tennant. The continued payments for land taxes, tells them you're compliant, because the fraud they operate under, is covered up by red tape. United Nations, Tri-Lateral Commission, Reserve Bank, International Monetary Fund and a few more, are all involved in this decades old, forced land grab.

check the 1968 and 2008 United State Supreme Court Case. They must have permission or a signed warrant from a judge to enter.

Omg so true..I was being forced to let them in..I told him not without a warrant..Animal control came on my property took my dog and then called code enforcement on me..This was about 4 days ago..I've been pissed..I had a house fire..two of my rooms were damaged..structure is still good..he then proceeded to say he was calling the fire marshall..I told him go ahead..idiots..

This sounds a bit more complicated. I am so sorry about your fire and loosing your dog. I can't give legal advice and not knowing all the details File police reports, when they try to enter your property call the police and have them come out. With this fire thing may be more complicated. Taking your dog I would think they would have to have a good reason and I would ask for paperwork or reasons for this. I would also call the sheriff because I believe but I am not positive, a dog is property. but again, I do not know all the details of your situation and I am not giving legal advice every town and city are different. you may need to get a lawyer involved. It absolutely is not true that code enforcement has a free pass to enter your property. If they enter your property without permission and you catch them, get it in video. Nor is it true that if you have a contractor in your home, that contractor acts as your agent in your absence: they are not allowed to let any inspector into your property. And if you have an inspection scheduled, the scope of their inspection is that item they are there for, they can't walk around and have a looksey, the only additional violation they can cite, is if it has to do with , health, safety or dangerous situation.

your are absolutely right!!!That is why I posted the video! We did get them on video entering our property. The code enforcement told us several times that they have this right they lied. This is one of the issues we have had with code enforcement. They now know we will not stand for that anymore! If they told us this, they have also told others this.

@@froszzy4914 you do realize that the police have no authority without a warrant to enter a property, even the curtilage area of property. If you are issued a fine (by the building department) , absolutely demand a court hearing, depending upon the state, once a court date is requested by HO, all future citations for same enforcement cease. Obviously if you are putting on an addition, no permit , easily to view from the street/sidewalk.. then you screwed up. Further, if the code enforcement officer writes the citation, he or she is only code enforcement, not a building inspector, which need to be ICC certified.

Great question! We actually have gotten a lot of public records and we do know at least 5 families who are making the complaints. Most of them we have never met or spoke to or even had any contact with. I will share some of the complaints that they have made smearing our name with the city. They are extremely exaggerated and many of them out right lies. Although we get very upset we will not put names on social media because we dont want to shame them. We believe they will eventually they thei comors will show themselves. These people are also known for being complainers not just against us but against several other people as well.

Put up security cameras and a sign stating anyone from code enforcement who enters the property without permission agrees to pay the home owner $5,000. Anyone who refuses to leave after being told to do so agrees to pay $10,000. Is this legal? IDK, I just pulled that out of my ass but it sounds good to me.

@@SmittyAZ You are too funny , As a matter of fact we have had complaints bout a grandfathered in sign on our property! In My opinion these 5 homes across the river from us are grasping at everything and anything to report on and the Code is loving it because they seem to get excited to bust people even when the reports are lies. but not everyone in code is bad and we do have to remember that they are doing a job and these people know how to use them to their advantage. We must know our rights! or they will be railroaded for sure!

I have cameras at the front of the property for now. and I do report any one who is up to no good to the police. I have also filed trespassing report against someone in Code.

We live in a rental property, and our next-door neighbor, who serves on the municipal council, advised my wife to seek an abortion since my other children let the cat escape and into his yard. He was a complete jerk from the start, and the code enforcer tried to come to him twice in a row. He called and threatened to take the landlord to court if we did not let him in. Even though we have been completing the necessary repairs, my elderly (82 years old) landlord is unable to accomplish them all. In light of this harassment, what can we do?

Code Enforcement (CE) tagged my trash can for being at the curb a couple days after it was supposed to be picked up. The city ordinance says my resposibility is to get the trash cans out by 7 AM on pick up day and get them off the curb 12 hours after being emptied. The city's reponsibility is to see that the trash us picked. My recycle container was not emptied so, by the city ordinance, I left it at the curb. The CE threatened me with a $500 fine. I went down to their office and explained that since the can still has stuff in it I don't have to move the can. The can stayed out on the curb for six days, just in time to go out the next day for regular pick up.

I am not a lawyer, So I do not give legal advice If I were in this situation. and I am not clear on your entire situation, If it was me I I would have called my local city garbage pickup let them know they missed my can. Follow up with an email and photos, with the local garbage pickup if necessary, Contest the citation if they come after me for money and go to a hearing. every city is a bit different so if it had come to that I would look up what your city does to contest the fine.

Get out and take pictures of your local leaders residences and you will probably find so much more to complain about ( one issue at at time) than anyone does with your place. Ive seen the code enforcement officer in Theresa NY leave his toddler unattended in his pickup parked along side a road while he creot around the backside of a citizens property to " investigate".

Code Enforcement is great if they follow their own rules. we get why they are here. Sometime the person they are going after may not know what they did wrong or understand, instead of bringing the charge against someone they need to approach and talk to people. in my opinion. Calling yourself "the boss man" does not make you the "boss" of anything in the real world. It is unfortunate your Parents neglected to teach you the ways of the world. Being someone's "boss" or supervisor implies that you are responsible for compensating said person for their efforts. I highly doubt that is the case here.
