Good video! Trademarks last for a decade, but can be renewed in perpetuity, if the paperwork is filed every ten years. This allows Nike to control the trademarks and trade dress of their shoes from here until the end of time. This, as you mentioned, differs from the design/utility patents which would inevitably run out after 20 years.

Let me start by saying I’m a huge supporter and love all your videos including this one because you bring the education back into this for the newer collectors. Im not here to defend his brand but I gotta play devils advocate a little bit. I can’t speak on order fulfillment because my pairs came quick but as far as quality, what are we really talking about? JB quality control is pretty bad as well and we all know it (that sole bending is weird tho I’ll have to check to see if mine do that). I have a couple pairs of kiy’s shoes and over all im not mad about the quality at all when compared to my AJ1’s. Are they bootlegs? Sure. But let’s be clear, it’s all cheap, His product as well as JB’s. A while back you made a video talking about how it only takes a couple dollars to even make the shoe and the truth is we are overpaying for all of it (shout out to the designer folks out there because y’all in this too). I get being a Nike purest and I don’t fault anyone for it but I’m not loyal to a brand so much where I wouldn’t look for other options because for me it’s more about the aesthetics anyway, all of it is just bad quality though. In my humble opinion Nike isn’t that much “better”, they are just the originator and that’s the important part here because if the quality was in fact better people would still talk shit because, well, it’s a bootleg. When we talk about “hype” let’s all just do our own due diligence and look at what has happened to the market over the past 10-15 years. This industry has been driven by hype for a good while now and if people can capitalize on it they will do just that (not saying it’s right but that’s the culture now with resellers and all that). I said all that to say, no matter the price, buy what you like and stand on that because even if you don’t support the knock offs, a lot of y’all are out here just riding waves anyway. I invented a directional spinner which I presented to omega and they bought my idea to reality but unfortunately it never made it to mass production just a prototype that go great reviews at SEMA in 2003.

Trademarks do not expire. They last forever as long as you keep using it. A patent does however expire and is used for an invention. A trademark is used to identify the source of a good or service (swoosh, nike, nike air, jordan, jumpman, etc). The air force 1 design is not trademarked. So bape could get away with it because the patent had expired and they didnt use any trademarks like the nike swoosh. However, nike tried to argue what's called trade dress. Basically, do people think they are buying an airforce 1 when buying the bapestas. This was not the case. Now what nike have later done is to trademark certain design lines on the airforce 1, dunk and jordan 1. Distinct lines on the foxing and so on in some sort of 3d trademark. These will last forever and will essentially preclude anyone from designing version of these shoes without making significant changes to those features.
