We didn't know that Kyle's Dad, Grandma and Friends all lived in Kenosha, 20 minutes from where he resided with his Mom part time in Illinois. 4. We didn't know Gaige Grosskreutz, a felon in possession of firearm, aimed his gun at Kyle first, as he admitted on the stand. 7. We also didn't know that in the State of Wisconsin, it is legal for Kyle to have a gun, even at 17 (which was why the gun charge was dismissed). 8. We didn't know that Kyle did not cross state lines with a gun he wasn't supposed to have. The rightful gun owner did, as he was legally permitted to do. 9. We also didn't realize that Rosenbaum was a 5 time convicted child rapist and that Huber was a 2 time convicted woman beater. 10. The moment the prosecutor brought the “lone survivor” and he admitted he was only shot because he pointed his loaded gun at Kyle, the trial was over.
@thespanishinquisition40783 жыл бұрын
correction: the trial SHOULD HAVE been over. This is a jury trial, so a rogue jury is still a perfectly likely outcome. And take into account, jury selection was brazen bullshit, with neither side really filtering anything, meaning it is what is called a "random jury" (that is, a jury that has not been screened for bias during selection), and with such a jury as some online lawyers like barnes pointed out while talking with viva frey, statistically, there's just a flat 2/3s probability of a split or "hung" jury meaning no decission is taken and it needs to go to retrial. Yeah that's right, game was literally rigged from the start, as soon as jury selection ended the most likely outcome was the entire case was pointless and kyle will have to go through all of this shit again. That's how dreadful his lawyers were, they fucked the only part of their job they had to be good at.

I listened to the trial and Kyle had such amazing self control, presence of mind, and positive threat identification. His first "defense" was exactly what any good teacher would encourage, he ran, trying to remove himself from the situation. He only fired when his attackers left him no option. He also didn't randomly engage anyone who wasn't threatening him.

Honestly, I think Kyle's defense was following the maxim "Never interrupt the enemy when he's making a mistake." If the defense team _had_ objected to the questioning of his right to silence, I don't think we would have gotten the gold that is the Judge tearing the prosecution a new one.
@jodyethridge75763 жыл бұрын
Defence team did object to things the prosecutor said/asked. But, as you said, "Never interrupt the enemy when he's making a mistake." And if the Judge is ready to jump on the prosecutor for stupid stuff the prosecutor said.......happy landings, judge. Sort of, "Never interrupt when the enemy is getting ripped a new one."
@damoclesecoe71843 жыл бұрын
I agree. We have incomplete information since we aren't part of the defense (within the courtroom) nor can we observe the jury and judge their reactions to the prosecution. I got some third-hand information that the jury was looking bored (arms crossed, not looking at the prosecutor, not writing things down) while the prosecution was speaking. This is however hearsay so take it worth a grain of salt.

Defence was very confident in putting Kyle on the stand. Most would continue exercising the right to silence, that is a very high risk strategy and it paid off.

@@The_Gaming_Hamster Just because some politicians wrote some words on some pieces of paper doesn't mean you don't have the right to defend yourself. It means that exercising your natural right will result in them punishing you. You still have the right to defend yourself, but they don't want you to defend yourself because they're immoral pieces of shit who think they have the authority to control you.
