Perhaps a new perspective of the constitution is necessary? It is pretty obvious the varied perspectives of cops, government actors and such, and the citizens who are sick and tired of the endless invasions, interruptions, inconveniences, and poor service but how about the men who wrote it and why? Those men wrote these civil protections as preventative measures due to HISTORY of human behavior.

you could just sense the tension with the officer returning the ID. He knew what just went down was a violation of rights and likely going to get them all in trouble.

@@LackLusterMedia I agree. He wasn't going to step out of bounds and do the right thing by trying to stop the situation. His body language was also very nervous, looking over his shoulder, AWAY from a possible "suspect"... that is not a show of experience. Also, the other guys made him return the guys ID because they did not have the balls to give it back. They knew they screwed up.

The cops are fond of telling people "You have nothing to fear if you have nothing to hide" when trying to get someone to relinquish their 4th amendment rights. I'm assuming that they're unaware that they're parroting the words and mentality of Joseph Goebbels, but it's telling that to them that concept only applies to the peons they think they rule over. When it comes to them it's just "officer safety."

I get the feeling in court, the DA/pro cop lawyer would argue that "well, he wasn't ordered to provide ID. He was simply asked and the citizen freely chose to waive his rights." Cops like these and the gov employees who aid and abet these criminals belong in prison.

could maybe argue since his car was running and not in park, it was a traffic infraction, making it a an order. most states don't require officers to tell you why they pulled you over but you must show your license/papers.

For example when cops don't have RAS or PC for a detention or arrest, then those cops are guilty of the same crimes a citizen would be prosecuted for if some random Joe with a gun did the exact same thing the cops did. Like in the Aubrey case, no legal right to detain = charges and prison time. That is the standard used against citizens, the same standard needs to be used against cops.

@@madtabby66 With respect to the number of laws, complexity of laws, and the range of situations those laws cover; plus the differences between the same laws region by region, not to forget the ambiguous laws, and they aren't wrong. The lawmakers are really determined to criminalise society. E.g. According to experts, the USA has over three hundred thousand traffic laws. It's physically impossible to get into your car, start it up, and drive a hundred yards without breaking at least one of those laws.

not exactly, there are many states in were you MUST provide your DL because you need to assure that you are "capable" by law to operate a motor vehicle, but besides that, Indeed he did a great job!

This happened to me twice in 6 days... stopped IN MY YARD. Driving a van full of tools... all lights work. I use blinkers. Follow all traffic laws to the best of my ability... 1 cop followed me for 5 MILES then stopped me when i pulled in. 1 said i was going 35 in a 25 around a 90° turn... hardly... i cant even take the turn at 25... my tools go flying around. They got me out and searched me and my vehicle both times. NEITHER TIME did they ask for ins or anything other than i.d.... bc i didnt break laws... they wanted drugs i havent done in 6 yrs... my record is expunged. Even if they ran my plate nothing would come up... it wasnt bc he was black... ive been stopped in parking spots and walking down the road... backpack dumped out and left there to pick my stuff up... im not black.. everyone gets profiled man... i wish ppl would stop running straight to throwing the racism card.... why was i stopped one time in the west part of jackson ms (highest murder rate per capita in the u.s. in 2021) at 11 at night driving home... im not black... i dont have any tattoos above the shirt collar or on my face... guess i looked black to them... idk... EVERYONE gets profiled.. little old ladies don't get searched for an hr on the side of the interstate looking for dope... bc they stereotyped the gmaw... its their job... btw i think what they did was wrong yes... i watch and love all these vids... so plz dnt think im taking the cops side...

IKR‽ I always get nervous when people confront cops because if they're dirty enough to violate rights and abuse their power, they very well might be dirty enough to eliminate witnesses and evidence. 😬 (Of course, that's probably not the case with these videos, otherwise we wouldn't be seeing them, but there's always a chance.)

How in hell is his driver license going to tell them why he's there and what he may or may not be planning? This is something that rarely, if ever, gets asked even by 1A auditors. If they have to admit it's just to check for outstanding warrants, then it's just a fishing expedition, and I would think look really bad for them on a 1983 civil rights lawsuit.

There are several reasons officers need ID...They obtain their ID/information to document who they spoke with in the event additional crimes occur in the area so they'll have a starting point. They also need to document details of the interaction. It's more than just "checking for warrants".

(Within 100 yrds, 500 yrds, 1,000 yrds, within a mile, 2 miles, 3 mile radius?) they can blame it on the guy they contacted while minding his own business and not breaking laws. @@TheWeightsOver Wrong, first and foremost, they are checking for warrants. They can just enter "John/Jane Doe" in their report or put "NA". As for "future crime" in the area, that too is BS and considered prior restraint.

I live in NC and was unaware that you are unable to obtain police body camera footage without a judge signing off in it. NC has some if the most tyrannical laws and officers of any place I have lived. And I have lived in many places.

First off I want to Thank both lackluster and James freeman for posting the fact that in North Carolina we have no rights to most of our public records. You aren't even allowed to get a police report unless everything is blacked out. I am gonna try to send this video along with another complaint to our state Governor about that. I've already sent 30 complaints this year. I've also made phone calls but never gotten a response.

Just started watching this channel after burning through all of Audit The Audit videos, I’m a huge fan. I’ve gone through about 100 or so here and this has to be one of my top 5. When he gave the ID back you’d think that he’d be big enough to admit he was wrong, or apologize in some way. Instead he walked away with his tail between his legs. And James Freeman’s phone call was fantastic.

I have NEVER laughed harder when listening to Jame's phone convo, "...I'm just going going to send some dolls and pacifiers anyway, they're quite soothing to babies." I was LITERALLY slapping my knee while laughing 😂. Camera phones have their uses and in this instance I hope that Braxton pursues this. These officers need training.

These officers need decertification. Training only helps if you are open to improving. Did you hear the chief and also the female officer in the call. For them it's about defending those officers and changing the publics mind, not correcting officers commiting a felony.

Inquiring about RAS is always good, but due to the Driver technically operating his vehicle, he is required to surrender his ID when asked

You can ask, but they aren't lawfully obligated to tell us...which I think is total BS. Also, they didn't pull him over, so he was under no obligation to give them anything as it wasn't a traffic stop.

It is BS. It's horrible because it gives LEOs more time to come up with one if there was never RAS in the first place. Although they didn't state it was a traffic stop, the LEOs proceeded as though it was one. And I assume they would have ripped him out of his car if he didn't provide ID due to them treating it like a traffic stop

If he's got a tail light out it's justified, headlight out it's justified, loud music, cracked exhaust etc. Unfortunately he has to provide his driver's license and registration. Edit, he's still in the driver's seat behind the wheel.

Part of the heart of the problem is pure laziness. It's too hard to observe, and the person may not engage in any activity that allows you to run their license, so instead, they just lust after ID in the hopes that they can arrest someone, because that's so much easier than actually having to do any real work.

I had a border patrol agent do something similar to me out in Southern Arizona on a two-lane blacktop. He was driving slightly lower than the speed limit, he was okay with people passing him, but when I refused to pass him he pulled over and then pulled me over and said it was suspicious that I didn't pass him. They'll look for any reason to screw you over.

yeah, withholding anything/exercising your rights raises their suspicions, but we have to jump through hoops and play a game of tag to even get access to EDITED video from bodycams. but that isnt suspicious at all right? by their logic, "if you dont have anything to hide then why are you making it difficult and not cooperating?"

Speaking as someone who drives through winterville everyday and who was in that town 10 minutes ago, it's well know that the whole police force in that town is looking for any reason possible to arrest someone. I will not have dinner there because the police sit sit across from the restaurants every single night watching anyone coming and going, including tonight.
