Really. I sorta thought they at least brushed past the Constitution for 15 minutes of Academy training. Don't they swear to uphold the thing? So, I've been judging cops in these videos too harshly: They're not wanton, tyrannical thugs, willfully trampling on your fundamental human rights; it's just that they are IGNORANT of them. Oh, that's different!

@brianbarber5401 Well, with the case dropped the so would the no contact order. And there shouldn't be one to begin with. Second, that's poor speculation that the judge covered him. It's more likely he made a mistake, especially if he admitted on record his lack of knowledge and poor judgemental

That’s not actually an offense that warrants disbarment. I’d have to check the Mississippi bars rules but prosecutors are pretty much allowed to offer the dropping of charges on any condition they please.

As I remember from when I was a reporter in East Central Mississippi (Meridian), the judge hearing a traffic offense, in a case such as this, is a JCJ, a Justice Court Judge (formerly Justice of the Peace in Mississippi), the lowest judicial position in the state. The position is an elected office, and there is no requirement to have a degree in ANYTHING much less Law. All anyone has to do is be electable, and a JCJ doesn't remain electable by disagreeing with local LEOs who bring cases before him. Anyway, I've seen Troopers (Mississippi Highway Safety Patrol) abuse their authority and act like little storm troopers. I had the misfortune to be born in the state back in the 1950s, and I've been on the receiving end of Troopers such as Young. I moved out of state back in the early 1990s. Please forgive the following off point posting, but all of what is taking place is in Desoto County, MS, just south of Memphis, TN (where I did my BA), and my home state is so messed up, I feel the need to post the following to help explain the perspective of someone who fled Mississippi. Anyone remember the movie "Mississippi Burning?" That 1989 film was very loosely based on the actual 1964 murders of three civil rights workers by the KlKK in Neshoba County, MS. I was seven years old when it took place. FYI: The three murdered civil rights workers, the real-world victims, were ambushed, kidnapped, and murdered by the KKK who buried their bodies tens of feet down in an earthen dam holding back a lake. They were: 1. James Chaney, a 21-year-old black man from Meridian 2. Mickey Schwerner, a nice Jewish boy, 24 years old from Westchester County, NY 3. Andrew Goodman, another nice Jewish boy, 20 years old from NYC, NY At some point back in the 1980s, I calculated that from where I was growing up in my parent's house in 1964 in Meridian, it was about a 30-minute drive to where the bodies had been buried on the Old Jolly Farm off Hwy 19 from Meridian to Philadelphia, MS. What was so extraordinarily weird was that I never heard of these horrible crimes until I entered undergraduate college in 1974, a month after Nixon resigned the Presidency. My parents, of course, never told a seven-year-old about a terrible multiple murder or the subsequent federal civil rights trials that took place in 1967 in Meridian, MS, my hometown. The Feds tried the Klan members they were able to indict on Federal Civil Rights charges in federal court because the local DA at the time was unable to convince an all-white grand jury to indict Klan members on state charges for murdering civil rights workers. I found out later that the local newspaper, the Meridian Star, refused to cover the federal trial that was taking place literally across the street from the loading dock of their newspaper office. So, Mississippi is now and has been, from my perspective, a third world nation.

As long as someone who followed at least a 6 month initial training program can financially and emotionally bleed people without even risk of repercussions, those trusted to enforce the law will continue to fight it

There some cases at Germany, where freedom of speech was falsely taken by judges. Finally the highest German court had to stop some judges, which court cases became very personal and private with the accused people. Compensations are in Germany low, but you have your rights. And in some special cases only a constitutional courts are able to stop the county / town-courts from wrong use of law.

I agree that the judge should keep himself current with Civil rights and the Constitution. I do think it's possible and even likely that when a judge doesn't deal with such cases he could be unaware of new case law and SCOTUS rulings. We're I a judge I would consider it my obligation to keep up with such cases. I'm curious that way. Every time I get exposed to a law I was unaware of or that seems out of sync with good sense, I look it up. I'm not a lawyer and not a judge, I just like to know how to prevent getting screwed by a system that ignores police misconduct and how the government can screw up your life. Yep lol I mean, just listen to the judge try to explain that "the prosecution will drop the charges if he takes down the Facebook Group" which in my opinion makes the judge complicit the retaliation... He literally had to say it like ten times before it came out right... Know why? Because he knows he's doing something that's not right, The law does cover what he and the prosecution are doing IT'S A CRIME And that's why hes having such a hard time saying what hes trying to say. BET. The weirdest part about it to me though is that Jimbo hired an attorney and they're still trying to pull that shit, hiring an attorney usually makes the trial go the way it's supposed to. The sad truth is that just like in every other municipality in America there's layers of corruption here...

You’re all being to critical I think. He’s a criminal law Judge at a local or county level at best. He was elected for his work in criminal law. He did the right thing, he spoke on his short comings and recused himself. I give the Judge an B. Don’t like that he offered the deal but he didn’t step outside of his expertise and did the right thing altogether.

The judge also seemed to have a problem with perjury and filing a false report, as well. The cop should have been arrested. It seems he wasn’t even investigated for using tax payer funds. That tells me the higher ups in the department are just as corrupt

The laws are many and complex, so judges might specialize in certain kinds of law. That said, the 1st Amendment is pretty clear, and despite the SCOTUS eroding some of it's protections, there are numerous clear rulings around it. It wouldn't be too difficult for any properly qualified US judge to access the appropriate case law and come to a legal conclusion. This is just speculation, but I think the judge saw the writing on the wall and thought he'd have to rule against the officer, and he really didn't want to do that.

Bruh, I was like "mofo what?" A basic tenant of our inalienable rights, and you haven't dealt with it since law school? That is almost as bad as a supreme court justice not knowing one freedom that the 1st amendment secures. Because that happened. I mean WTF over, why are so many smart people stupid?

Classes on constitutional rights should be included during training at the academies. Private citizens shouldn't suffer for this acute lack of knowledge.

Except, officers DO get training at the academy on constitutional rights. That's the problem. People keep going, "but they aren't getting this training!", "they need to be trained", etc... and these people don't realize, they DO get this training... at the ACADEMY. It's when the officers get to their department and get told, "forget what the academy taught you", that all of that training goes out the window because the DEPARTMENT wants it that way.

@@experienceofchris1108 police will lie on their reports to do the EXACT same to innocent people. They are under oath to tell the truth, so why should they be cut any slack? Think of the hundreds of reports a single cop will lie on just to get the suspect more time in jail/prison, and or larger fines. They do it non-stop and nothing is done about it

If a judge doesn't preside over those kind of cases and has no reason to keep up with case law on decisions related to the first amendment, I can understand it. He did the right thing in recusing himself. Shows he has the appearance of wanting to be fair. I can't speak to his state of mind. Two sets of laws never ends well. Abolish qualified immunity Boycott Texas Arizona and Florida
