LAND DISPUTE: KPLT FACTION BUILDS ILLEGAL HUTS AT PELE ANGAMI’S PROPERTY

Today, on 5th March a rumour of scuffle between the people of Assam and Nagaland was spread, and to clarify on this matter, Nagaland TV visited the spot and interacted with H.K. Sema, who stated that there was nothing like a scuffle or fist fight but a mutual talk between the two sides on the illegal land encroachment by building temporary huts inside Pele Angami’s property, which was bought in the year 2004 from the owner of Tea Estate located in Karbi Anglong. For a valid argument, they have all legal documents from the Court. It is said that one surrendered underground faction of Assam, namely KPLT members, tried to take over the land, and to stop their activity, friends and families of Pele verbally confronted them. Later on, district administration came over and handled the situation, and to have a mutual understanding, three representatives from both sides were invited to Khatkhati P.S.

Ok, Let me explain something that people don't seem to understand. The owner is actually Neelu Tea Estate (correct me if I'm wrong) and not a single person. Mr. Pele is the owner of the Tea Estate which is a "cooperative body". So in the tribal areas of Assam land is actually non-transferable. According to the "land rights acts" in Assam, a cooperative body in the interest/welfare of the people/state can own land in tribal areas. So land ownership is always with the tribal people of Assam and only transferable to the tribal people of Assam, like to Karbis or Kacharis. This is the same in Nagaland. Land transfer among the people and not transferable to non-natives unless it is open areas of course. Another issue with the land sale in Karbi Anglong by Karbi people to Nagas is that this is questionable, "has any Naga person bought land without the help of brokers and middlemen?". If by government law the ownership of land is non-transferable how did they make the paperwork legal? I understand that Naga people do not know the laws in Assam. But, let's be real, the brokers are fooling them of the legal rights of land in Assam. People think there are "squatters" in Assam but automatically that land becomes government land and does not get legal ownership. Look at what happened to the DUDU colony. The DC had no right to transfer ownership to that person. So, understand and realise that ownership of land is not transferable to non-natives and also if you own land, catch the broker and ask how they made the paperwork, I'm sure none have gone to the land revenue office to make the paperwork themselves in a place where land ownership is not transferable. Even, the recent case with New Market Gaon Bura who was a known land broker in Bukajan was the same. He arranged for the sale of land without disclosing the land rights in Assam to the Naga people. Many Naga ladies have married Karbis and Kacharis who do the same. We all know that. You can only be long-term tenants in reserved areas of Assam, even in reserved areas in cities parts of Assam like Guwahati, Jorhat, Nagaon, Nalbari, and Bongaigaon. Whatever the matter is now, it will have to be dealt with in the presence of the official Karbi Council same as how it happens in Nagaland with the village council. So these issues shouldn't be brought into the daily lives of people, both from Assam and Nagaland. But is a good awareness campaign. Don't try to buy land in a place where land ownership is non-transferable. And imagine, which lawyer will represent this? That lawyer's credibility will go down for not knowing the legal law of the land in a 6th scheduled place.

Now law is being strictly implemented . Nagas (or any other tribes) should refrain from buying land in Karbi Anglong except those Nagas who permanently resides in karbi anglong . Many Nagas have been fooled by sellers . There are many disputed land/house of nagas in Karbi Anglong . Instead buy lands in guwahati , jorhat , dibrugarh or even in Golaghat there won't be any problem but 6th schedule area is a protected area under indian constitution .
