It's because our court systems are horrifically overburdened with cases. In some jurisdictions, there are not enough judges to hear cases. We are especially short of public defenders, because the pay is terrible and the caseloads are insane and the public doesn't understand the job of a public defender. If we want a functional justice system we will have to pay for it, but Americans are stingy about paying taxes. We want all the goodies but we don't want to pay for them.
