When I first checked what happened I had no idea what a "common law marriage" was. I thought it was a joke. But after checking it out I'm just quite surprised that such a thing even exists, in Italy there's no such thing (fortunately) and it's completely unheard of. After having studied Law in University here for a while, after hearing of certain proceedings in Common Law countries compared to Civil law, I'm really glad I live in a Civil Law country.

In this context it's being used for something pretty vile, but on paper it exists for a good reason. Imagine if you had a man and woman that were living together in the same house for 20 years and they had 3 years together, and during that time the woman gave up her career to take care of the house and kids, but they were never married. If the man in that case were to decide to just up and leave, all of the logic behind why a woman should get half in a normal marriage, would also apply here. She has given up her youth and her career in order to play housewife with him, and now he tries to just leave her with nothing. Obviously not what happened here though. I don't think Adept has a good case, unless XQC has been doing some stupid stuff behind the scenes.

To be fair, if you live with, and put up with someone's shit for 20 years, with or without kids (Bec you have to realize marriage in the US is a religious institution and the majority of the country disagrees with laws based on religious ideology, and conservative policy in general, so not all domestic partners want to marry, that being said) if you live with a partner, and you treat each other as spouses not only in your relationship but on things like taxes, cars, homes, insurance etc. If you 'break up' it cannot be treated like a normal breakup Bec you have shared assets, and on top of that if one side is a psycho, (which in this case is adept because she's literally taking joy in taking his car, violating her own TRO to show up and yell at him on stream etc. Just to get her money) in most dissolutions of domestic partnerships/common law marriage, requiring a divorce process is supposed to provide protections on both sides. The issue here, is as sexist and misogynistic of a country with a rampant patriarchy as the US is, family court in general, including child court and divorce court cases HEAVILY favor women. (Which doesn't really make sense when you think About the way this country treats women in general but I guess they have to favor women in at least one token area so they have their strawman arguments to try and present to say 'no we don't hate women, see?'

common law is meant to be a failsafe to prevent abuses generally speaking and help adjudicate arbitration between multiple parties. I think Adept will have a tough time invoking common law because a) she didn't really help him start a business or pay his bills and b) she doesn't have kids and c) unless XQC literally told everyone this is her official wife then it will be flimsy circumstantial evidence that is not going to hold up in court.

He doesn't say "new wife" he states "new girlfriend" and she doesn't even contest that statement. Any "wife" that is newly separated from their "husband" as they were (and undergoing a divorce according to her), at minimum would dispute that fact.

Reading the law doesn't help determine whether or not they were "married". You have to read case law to find out how judges interpret the law. Also she doesn't have a right to his total income, she access to income accrued. Which means any money left or saved at the time of filing. The judge can't force you to pay her for money already spent.

Unpopular opinion: if it's true that they filled out forms mentioning each other as spouses and got all the legal/financial benefits from a common law relationship, then XQC can't complain that he has to live with the consequences of those decisions. Is she spiteful? Yeah no doubt, but that doesn't suddenly mean their relationship doesn't count anymore. On the other hand if she's making all this up and they never had the advantage of common law benefits, then the court should throw the book at her.

I just found out about all this Sucks for xQc. But hopefully this does become a lesson for all the other dudes who aren't exactly pick up artists. BE VERY CAREFUL OF WHO YOU MARRY. Even if you think that person is trustworthy. It really doesn't take much to completely screw over the guy. All a woman has to say is "I felt bad around him," and that dude is screwed. There doesn't need to be evidence. All that has to happen is she says you made her feel uncomfortable. I just read a story of some guy who was a school principal for about 20 years. His wife called the cops on him because she got mad one night. She claimed he was being physically abusive, but later felt guilty about it and failed to clear his name. That former principal jumped off a parking structure to his end. He posted on his FaceBook that the legal system was completely unfair to men and left them with no outs. He decided the best way out of his predicament was self cancellation. That's how rough one woman falsely accusing a guy can go. Again, no evidence required. Just a claim.

Based on everything I would assume there's no real issue for xqc assuming he didn't sign any leases on his houses as a married couple, and they never filed taxes as a married couple. Those are the only two things that guarantee a common law marriage can be proven. He most likely gave up the cars due to not having the registration in his name, and I think one was a gift for her. Otherwise he will probably ask to recoup his money on his cars just for putting him through this. Also her case is damaged by her breaking the restraining order. The court is going to be pissed about that for sure.

The clip about her posing the question getting married or having a child right now and xQc said married with a prenup. He didn't need to drive which is why he never got a license. My stepdad pays $10,000 in alimony a month - in his case, it is absolutely like what Destiny says. She is (well I think she WAS.. I don't think she is still) entitled to it because she removed herself from the workforce to raise (6) children, and the longer she is not employed, the less she seems like a competitive candidate. Now, the fact that my stepfather has been paying that for 25 years (meaning she could have started to get back into the workforce) and all his children are over 21... that's a longer debate. It's extremely circumstantial (hello, prenup), but in certain cases, I believe a mother could be entitled to in alimony if the children are under 18 and she's been out of the workforce for ~2+ years, but also I kinda believe you should only get it for the same amount of time you weren't working, and to me, that's enough time to be an adult and stop being supported by your ex. (I'm only 17 minutes in, so I'm sure this is covered at some point).

You can't justify alimony without the existence of children? If there's a reasonable situation, where the spouse legitimately sacrifices their future earning potential, to accelerate the earning potential of the other, I can absolutely see it. A really easy example would be, "My spouse is doing a non-standard job, with little to no earnings for the first few years (streaming), and I am sacrificing my opportunity to risk my own personal finances, by taking a potentially lower paying, but more secure job. In order to support both of us at the same time, with the hope that one day, this will pay off for us together, as a union." The streamer in this case was enabled to take risk, specifically by the spouse. And if the streamer divorces the other partner, their success was only made possible by the spouse supporting them. The spouse (in my opinion) is entitled to the differential of whatever future earnings they sacrificed. So if they stuck with the $50k/year job, and could have gotten a $100k/year job, but instead made a sacrifice to enable the partner to have a $500k/year job, they should be entitled to (I'm not settled on an amount, but my best guess) $50k/year, maybe a bit more, maybe a bit less. Is that's what's happening here? No. But that's my justifications for alimony.

This might be a reach but I think Adept was talked into doing this by her family and xqc kissing that girl on his stream was icing on the cake for Adept to crucify him. Remember that girl wasn't suppose to come in the room until he was done streaming. Which means he definitely was trying to hide her but she fucked it all up.
