Phone as device block toh nahi karte as far as we know ha number/sim card ya toh Indian hona chahiye ya phir roaming ho with international sim card depend on kaunsa mobile number hai of which company and its network availability in India .Custom duty lagega at the most wo bhi tab agar naya device kharid k laya ho toh and that duty also depend on value of item if it falls under range defined then might be very less to duty free.Agar personal use ka old phone hai not an import and able to prove that its not import its personally used item then as far as I know no import duty .
