The hospital had really serious accreditation problems (and heads rolled because of that) for a number of good reasons. It appears to have been a mismanaged and toxic place for a few years, a place where employees were afraid to speak out and patients actually died because of the culture there. The kowalskis suffered because of that mismanagement and toxicity. I hope this jury sends a message. No matter what happens on appeal, a jury verdict against this hospital would send a message to this and other hospitals to keep standards high or potentially spend millions of dollars on lawyers while suffering damage to reputation.

Every major hospital and children’s hospital employs and has their OWN hospital photographers and if THE Dr orders photos by physician order only they get signed consent and if consent is given the photos are taken in an appropriate private windowless setting with the door closed and a nurse witness uncovering one extremity or part of the body at a time while the rest of the body remains covered. There is never a need to have a social worker expose a patient on her hospital bed.especially a child.

Excellent closing Mr Shapiro. You did the hard working hospital proud. You used light and shade, were respectful and showed compassion towards Maya- I had shivers when you said she deserved to be happy. I’m in the UK and this is the first trial I’ve watched. I saw the Netflix doc and like many people with no agenda but critical thinking skills; it was obvious to me that the Kowalskis were dysfunctional. I think the closing statements summed up both sides. Anderson was like a drunk uncle at a wedding and then he was desperately trying to get the jurors calculators in deliberation. 💵 You however, made it clear and obvious how the caring and professional staff at JHACH had to put up with the sleazy lies and slandering from the plaintiffs. I hope Mr Anderson calling Cathy Beady a “mental case” is dealt with further.

Why did Maya walk out during defense closings? Could it be she did not want to be in there to listen, and have the cameras on her, when over an hour and a half of the truth came out in one fell swoop? And I can't help but feel that Kyle, listening to that, might be realizing that he was duped as well. Man, she was clinging to her rosaries for all to see for the past two days. Shapiro was amazing. He wrapped up the actual facts of this case and delivered them with a big beautiful bow! If after listening to his closing the jury does not get this right, then,IMO, there is something terribly wrong with the justice here. In the end,I believe we still have to respect them and their decision. My thoughts, prayers, and respect go out to the entire defense team and all of JHACH employees. To the employees: Thank you for everything you do everyday for sick and dying children. I, for one, greatly appreciate and respect all of you. the first thing i noticed was her sleeveless outfit n appearance, and the female attorney lent over and tucked her bra strap in... maybe they have different dress codes... the previous day Maya at times was clutching Rosary beads looped around her hand and the crucifix hanging down, very noticeable when drinking , as well as when she wasn't being quickly 'distracted' she was shallow breathing throughout... could be anxiety but no other signs of anxiety.... the Dad and herself were a lil too cosy with the jurors... I watched the Netflix doco which impo left me with too many red flags and very one sided... which then led me to follow the Trial. Sadly, I feel it was more so the conditioning of her Mother and her Mother had a deep seeded undiagnosed condition/s that quite a few people have mentioned.... I believe there was already troubles with the marriage before Maya's JH admission and no one sensitively addressed this... Beata ended up losing being in 'control' of everything and the only control she had left was having the last say in tragically ending her life... she sadly has left a trauma on her family to bear, even if not sound in mind, but she had intentions to carry out and not an impulsive act... i feel for Maya's brother whom will always remain in the shadows of his sister. I do wish the judge let Beata hug her daughter away from the cameras and with conditions. Beata's death has also made her family alot of money already and impo has lead to seeking more attention and obscene amounts of money, untruths and more opportunities than ever before. Lastly is a tragedy that Jack has an older daughter and on his first borns ` daughter's wedding day'... Beata and Maya don't attend... instead go to Mexico for a Ketamine Coma and Jack is then pulled away from after the wedding and connecting to his first-born daughter's celebrations and family... his having to fly out to Beata and Maya in Mexico... ironically Beata doesn't even mention Jacks older daughter... not in her third person notes that Beata journals whilst in Mexico, doesn't even mention her and Maya couldn't attend the Wedding... another possible reason why Beata has Jack on the next plane out and feeding the need to place all the attention and illness onto Jacks second daughter - Maya. Something not right there. These are just my personal opinion's only.... POV... i'll leave it at that...@@cheriesullivan1494

I’d be terrified if I was a young girl alone taken away from my mommy and daddy and brother and everyone else! Alone with most of these ladies! Especially if their telling me I’m a liar!!! And my mommy is a horrible person! Ahhhhh Gosh what he said about Beata Pushing her daughter out of the way from getting hit by a car. Knowing she’ll be hit. That hits hard. It’s so true. AND if Beata wanted to hurt or anything with her child she could’ve kept her home and did whatever. But she didn’t. She TRIED! The hospital messed up everything Mr Anderson did great. It’s 8pm and I’m trying to finish this before I see what the verdict is. If their done. I pray that Maya and her whole family get justice. This hospital knew they screwed up. That’s why defense held out some important crap and was hoping nobody would catch it. Thank God for that last witness! He was awesome and I would go to his hospital if it was in my area. @@AliceBowiemy feeling (because it’s what I’d do in this situation) is they went through all the individual claims immediately & answered the first question about liability to see where there was consensus in order to get that part out of the way, then will move on to damages on the agreed liability verdicts. Why bother having the Judge tell them to read each question & deside Guilty or Not Guilty & move onto the next question like every other Jury is told to do? Now all they will do if they are leaning towards the plaintiffs is not really read the other questions as they are required to do. The plaintiffs are allowed to do this because that's what every plaintiff lawyer does, that's normal. Defense lawyers usually do this too but this defense team knew it wouldn't help them in this case. There's no Guilty/Not Guilty, only liability - which is essentially just legal responsibility. Plaintiff lawyers on contingency usually take somewhere between 25%-45% before costs are taken out. Yep, that's a lot and it's not much different in Canada.

They also should have read the jury instructions which said the hospital isn't liable for damages under the court order etc... They clearly didn't factor this in. There were parameters around what the hospital could be liable for and the jury didn't sound as though they considered any of that. If one removes the "feelings' and stays focused on the law, defense won this case on most topics. JH most egregious act was the complete lack of caring about Beata's mental health. They didn't care. These are physicians and she told them she was suicidal. A gross act and morally reprehensible. The primary doctors (snake oil) are responsible for what happened to Maya. They convinced Beata her daughter had CRPS and must act on their dangerous treatments. They fooled her when she was in such a fragile state. The plaintiffs was relying on the jury to just fork over millions when they knew specifically what the verdict forms were going to entail. Whitney tried to give an emotional speech with little substance to help the jurors calculate. If it’s 300 a day for life, or is 100 a day, not even 1000 a day is enough. The juror that wrote that note is not wrong, but man the tone was one of exasperation.

It is safe to say they aren't getting 220 million. The hospital will appeal it until the Kowalskis give up because they cannot afford to maintain a lengthy lawsuit. There is very little substance in the plantiff's claims.

Sadly, it’s all about the $$. Obviously Maya has been through a lot in her very young years of life so far. My humble opinion though, how much money is enough in a case like this. People are always so afraid to touch this question but it’s reality. How much money does Maya and her family really need. 1mil, 5 mil, 10 or 20?? Anything north of 10 million is kind of crazy I think and I know, nobody cares what I think and I don’t really care. I’m just making my point. If this isn’t all about the mighty dollar then the family should donate 80% of the award $$ to their charity of choice. If they did that, id be stunned but it won’t.
@katego370 Жыл бұрын
This lawsuit was initiated when Maya was 12. I don't know if you've ever tried to get a teenager to comply to an extremely laborious and intense program of lies for 5 years while they're changing their style every few months but I promise you, you can't do that _this_ effectively. Additionally, if it was about the money, they would've settled. A 9 week trial, 5 years of litigation, numerous appeals, and another number of years of post-trial appeals is _extremely_ expensive. Plaintiff lawyers on contingency take anywhere between 25%-45%, usually _before_ costs and fees are taken out. A settlement cuts short on time, hatemail and criticism, preserves your privacy, saves you enormous amounts of stress and worry, and also eliminates appeals. The settlement amount would've been a lot lower and on far fewer counts, but it still would've been the preferred option if money was their motivation. They're lucky if they ever see 50% of the final verdict amount. The only reason anyone would take a case like this against a party like JHACH to trial in such a public way is because they want the world to know just how bad they've been harmed by this hospital.

This is classic munchowsen by proxy. The mom was recording and filming her child’s “experience” from day one. The mom is getting attention. Maya is too. She thinks she knows better than all doctors. Ketamine is not a fail safe drug. There are severe side effects. Anyone who has done it recreationally knows how strong a 100-200 mg/cc dose of ketamine esp through IV. That’s insane. The footage of Maya in John Hopkins hospital, does it look like she’s suffering and in agony? Now she’s cured all of a sudden also. No. This verdict will come back on appeal 100%. People don’t kill themselves like mayas mom unless they are ridden with extreme guilt. This is a disgrace. I feel bad for Maya and the dad. The mom was a piece of garbage
